A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING AND RATIFYING THE EXPENDITURE
OF FUNDS FOR SERVICES RELATED TO ENVIRONMENTAL PERMITS
AND PROFESSIONAL SERVICES PROVIDED BY THE CHAPPELL
GROUP, INC. FOR FISCAL YEAR 2016-2017 ENDING SEPTEMBER 30,
2017, THAT EXCEED AN ANNUAL VENDOR TOTAL AMOUNT OF
TWENTY FIVE THOUSAND DOLLARS ($25,000.00); PROVIDING FOR
CONFLICTS; PROVIDING FOR FUNDING; FURTHER, PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids if he is authorized to do so in
advance by a resolution adopted by the City Commission; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations",
Subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a
vendor each fiscal year; and
WHEREAS, the City of Dania Beach has previously expended Two Thousand Eight
Hundred Thirty One Dollars and Eighty Two Cents ($2,831.82) during Fiscal Year 2016-2017 to
The Chappell Group, Inc. (the "Consultant") for a Seagrass Benthic Resource Survey; and
WHEREAS, the City of Dania Beach already incurred additional expenses for the same
Consultant to prepare environmental resource permits for the dredging of the northern marina
basin, as the Consultant possesses the bathometric information for this project, is familiar with
the marina project and related environmental requirements and the permit process with the
Florida Department of Environmental Protection in the amount of Twenty Three Thousand Five
Hundred Sixty Six Dollars and Eighty Two Cents ($23,566.82); and
WHEREAS, the City has determined the northern basin of the marina is extremely
shallow at low-tide making operation of a vessel either difficult or impossible and dredging is
therefore a priority; and
WHEREAS, it has been determined that an additional bathymetric survey must be
performed at a total estimated proposed cost of Two Thousand Three Hundred Fifty Dollars
($2,350.00); and
WHEREAS, the Parks and Recreation Department is requesting an additional Five
Thousand dollars ($5,000.00) be authorized to address any additional unforeseen circumstances;
and
WHEREAS, the Parks and Recreation Department is seeking to ratify expenses not to
exceed Thirty Three Thousand Seven Hundred Forty Eight Dollars and Sixty Four cents
($33,748.64) for services for Fiscal Year 2016-2017 and waive the three (3) written quotes
required by the City's procurement policy;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the above "Whereas" clauses are approved and incorporated into this
Resolution.
Section 2. That the City Commission authorizes and ratifies expenses in the amount
of Seven Thousand Three Hundred Fifty Dollars ($7,350.00) which shall be appropriated and
transferred from the Marina Contingency Fund, Account #406-72-09-575-99-10 to the Marina
Professional Services Account #406-72-09-575-31-10 leaving a remaining balance of Seventy
Three Thousand Four Hundred Fifty Three Dollars($73,453.00)in contingency funds.
Section 3. That the proper City Officials are authorized to execute contracts with The
Chappell Group, Inc. to obtain environmental permits and perform related services for the
dredging of the northern basin of the City marina up to an annual amount not to exceed Thirty
Three Thousand Seven Hundred Forty Eight Dollars and Sixty Four Cents ($33,748.64).
Section 4. That the City Manager and City Attorney are authorized to make minor
revisions to such contracts as are deemed necessary and proper for the best interests of the City.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this resolution shall be in force and take effect immediately upon its
passage and adoption.
