Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Alle ig ance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from St. Ruth Missionary Baptist Church for their 109th Anniversary Picnic to be held at C.W. Thomas Park on August 20, 2017, from 11:00 a.m. —3:30 p.m. Commissioner Grace motioned to approve the Special Event request for the St. Ruth Missionary Baptist Church Anniversary Picnic; seconded by Commissioner Brandimarte. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Darlene Mosby, 111 SE 1st Street, Apt. 114, noted she has been harassed by homeless people, and is hoping to hear some suggestions on how to handle the situation. City Manager Baldwin noted BSO has a person that deals with homeless issues. Captain Daniel Marks, BSO Chief of Police, noted Deputy Weir is still recovering from an injury and will be back in a couple of weeks. BSO is looking at establishing a neighborhood response team to assist Deputy Weir. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity. He noted that National Night Out on Crime will be held at Frost Park on Tuesday, August 1st from 5:00 p.m. — 8:00 p.m., and introduced new members of Dania Beach BSO: Lt. Manfree, Sgt. Jeremy Hansen, and Lt. Darryl Stallings,the new Executive Officer. Timothy Keefe, Deputy Chief of Operations, BSO Fire Rescue, was present to represent Chief Joe Fernandez, who is in Charlotte for recertification of the Fire Department. 7. Mayor James provided a handout to the Commission so they could see some possibilities of how the LED could work with the rebranding. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,July 25,2017—7:00 p.m. Marc LaFerrier, Director of Community Development, noted Redline said it would be fine to go out to bid with the design proposed and add the different attachments at a later date. City Attorney Ansbro read the title of Resolution#2017-071. Commissioner Grace requested a timeline and cost. Brad Kaine, Public Services Director, noted the start date would be in 2018/19 and the cost is approximately $1.3 million. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2017-024. He noted that this only repeals the ordinance that is currently in place, which conflicts with the new state law. There is another item under Public Hearings that will go into more detail concerning dispensaries. Public Hearings and Site Plans City Attorney Ansbro advised Items 9.1, 9.6 and 9.7 were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.1 ORDINANCE#2017-017 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE REQUEST MADE BY BOWMAN CONSULTING GROUP, LTD., AGENT FOR THE PROPERTY OWNER GURU SHAKTI GROUP LLC, TO REZONE PROPERTY LOCATED AT 30 SW 16th STREET, DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM RESIDENTIAL OFFICE (RO) DISTRICT TO SOUTH FEDERAL HIGHWAY MIXED USE (SFED-MU) DISTRICT (APPLICATION NO. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2017-017. Corinne Lajoie, Principal City Planner, noted nothing has changed regarding the rezoning of the site since first reading. Heidi Davis, Gunster Yoakley& Stewart,provided a Power Point overview of the request, which is attached to and incorporated into these minutes. The presentation included the proposed site plan, which will go before the Planning &Zoning Board. Mayor James opened the Public Hearing. Dominic Koslow, 1402 SW 2nd Avenue, noted any upgrade to the facility will only help the community. John Daizovi, 41 SE 6u' Street, questioned what would happen to the gas tanks at the current 7- Eleven. Attorney Davis responded the property is deed restricted so no one else could come in and have a gas station there. Guillermo Verton, 3080 SW 44 Street, 7-Eleven manager, noted this will improve the City. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Salvino motioned to adopt Ordinance #2017-021, on second reading; seconded by Commissioner Grace. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,July 25,2017—7:00 p.m. Elizabeth Tsouroukdissian, Pulice Land Surveyors, responded she believes it is a Wyndham. Vice-Mayor Harris noted he wants an upscale mid-luxury brand hotel in order to attract visitors to the City. Mayor James opened the Public Hearing. Marcos Fintz, owner of the Rodeway Inn & Suite, 2440 State Road 84, expressed his concerns on the impact the new building will have by blocking the view of their hotel. He is willing to work with them to change the location of their building. Commissioner Brandimarte said she needs more information before making a decision, and thinks it should be tabled until another meeting. Commissioner Grace commented we do not know what type of hotel it will be; she would like to know what type of hotel it will be. She wants the applicant to work with the Rodeway Inn. Ms. Lajoie clarified this is the only reading for a plat; the site plan would come to the Commission for approval at a later date and hopefully the questions raised would be addressed then. A hotel cannot be disapproved because we do not like the name. Vice-Mayor Harris said he wants to do this right because the Super Bowl will be in South Florida in 2020. Discussion and Possible Action 10.1 Oasis Program- City Manager Baldwin City Manager Baldwin reviewed the memo that was included in the agenda packet. The third element of the Oasis Program is to build residential property and sell it. He wants the Commission to be in agreement with him to purchase these properties, and the program to build above-market homes on the properties would come back to the Commission. Commissioner Grace agreed on the direction we are taking. Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday,July 25,2017—7:00 p.m. Mayor James commented that a Habitat for Humanity home would be a good home for the Smith Store property. She felt the houses should be affordable for the community. City Attorney Ansbro clarified the process for the Commission regarding disposal of City-owned parcels. Commissioner Grace noted she wants us to build very nice homes on the Smith Store property and adjacent parcels. She wants to see upscale beautiful homes. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte noted she is happy with the proposed budget. 11.2 Commissioner Grace Commissioner Grace reported on dates and locations of back to school giveaways. Commissioner Grace asked Chief Marks if he has been working on her tickets for 50 children to attend the Miami game. Mayor James said she is working on it and should have an answer by the end of the week. 11.3 Commissioner Salvino Commissioner Salvino commented we need to add staff for Public Works in the budget. 11.4 Vice-Mayor Harris Vice-Mayor Harris questioned the status of the ordinance regarding Sober Homes. City Attorney responded we are waiting to see how the Delray Beach ordinance fares in Federal Court. Vice-Mayor Harris asked about the resolution for MPO for the I-95 corridor project. Vice-Mayor Harris said there are rumors and innuendoes about what the City Manager's plans are for the future, and asked what he wants to do and how we can help him do it. City Manager Baldwin responded he would talk to him about it. He will be leaving because of the Florida Retirement System and needs to look for something that is not in the FRS. Vice-Mayor Harris wants to know when the City Manager is leaving. Commissioner Brandimarte commented he will be leaving at the same time as Commissioner Grace. City Manager Baldwin noted he will provide advance notice. Minutes of Regular Meeting 13 Dania Beach City Commission Tuesday,July 25,2017—7:00 p.m. Commissioner Grace spoke of the transition process and felt City Manager Baldwin would give us direction. Mayor James noted she is concerned with ensuring that seasoned people make the decision on who should be the City Manager. It should be done before the next election. Commissioner Grace concurred with Mayor James. She also will not want to wait until she leaves before the hiring of a new City Manager. Vice-Mayor Harris commented on an email regarding Bryan Road from Scott Brunner, Broward County Traffic Engineering Division, which is attached to and incorporated into these minutes. Brad Kaine, Director of Public Services, noted Mr. Brunner suggested the City take over the road and be responsible for it. Commissioner Grace noted the traffic will triple on that road when Dania Pointe is developed. 11.5 Mayor James Mayor James said she will present Collins Elementary with something for becoming an A School at the next meeting. Mayor James commented she met with Ron Book and discussed a lot of grants that could be used for vacant property. She stated he is lobbying for grants, as well as for the airport, and asked for clarification on where we are on the contract with Anne Castro. City Attorney Ansbro noted the contract expired in April; it is a Commission decision on whether or not to renew. Mayor James felt we do not need to renew it. Commissioner Grace is comfortable with Ron Book; she will not vote to have a contract with Anne Castro. Commissioner Salvino noted he has been putting off bringing the contract back to the Commission; however, Anne Castro is still working every day to help the residents. People who call Ron Book for help with the airport will not receive a call back from him in a timely manner. He added he will put the contract on the next agenda. Commissioner Brandimarte said the mitigation programs are progressing and she will not vote to continue using two people for the airport. Mayor James noted she is opposed to Anne Castro, and wants to take action now; however, we can put it on the next agenda, but she does not want it. Mayor James commented she wants to look at setbacks on US-1 and Dania Beach Boulevard for future development to make sure we have walkable and outdoor dining areas. Minutes of Regular Meeting 14 Dania Beach City Commission Tuesday,July 25,2017—7:00 p.m. Mayor James spoke of FPL permits and noted they spent $200,000 on permit fees. She asked where this money goes. City Manager Baldwin responded the General Fund. Mayor James questioned if it can be used for the renovation of the Conference Room. Colin Donnelly, Assistant City Manager, noted he solicited contractors to look at renovating the conference room, and described possible renovations to it and the Commission office. He has two quotes, and will talk to the contractors next week. Staff should be able to provide additional information at the next meeting. Mayor James said she received emails about possibly changing to only one zip code due to insurance rates going up under Fort Lauderdale's zip code. The U.S. Postal Service said we can submit a detailed written request for review and consideration. The Commission consensus was to try. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin reported he met with FP&L concerning the Piccolo wellfield and our water allocation, and Fred Bloetscher is working on it. He noted we need the Piccolo well for drinking water. City Manager Baldwin noted he had a meeting with Ken Jenne and met Marcellus Osceola, the new Chairman of the Seminole Tribe. They have their own water treatment facility and the Chairman asked if we would be interested in buying water. Fred Bloetscher is looking at this too. If a signal was warranted per federal and state criteria, and the County concurred with the validity of its warranting determination,the County could potentially operate a traffic signal on the City's behalf through a separate signal maintenance agreement (like we do with FDOT). The City would retain traffic control authority on the roadway, but the County would simply serve as the maintaining contractor for the signal. However, County staff would not agree to operate and maintain a device that we determined to be unwarranted,or not yet warranted, but the City could nevertheless install and operate a signal under its own authority using a private contractor if it chose to keep the County out of the equation. As you know, Bryan Road is a County road, and therefore Florida Statutes grants original traffic control jurisdiction and authority to Broward County. In accordance with F.S. 316,traffic control authority can be transferred upward from a municipality to a county, but it cannot be transferred downward from a county to a municipality, so therefore your request for the County to transfer traffic control to the City at this individual intersection is not an option under Florida law. However, Bryan Road currently serves no County roadway function under the State's guidelines, so therefore County staff may have no objection to the roadway being transferred to the City's ownership, but that would need to be evaluated by the Highway Construction and Engineering Division, and approved by the Board of County Commissioners. Once transferred,the City gains all traffic control jurisdiction and can make traffic control decisions under their own engineering judgment and liability. If that was to be the case,the developer would be responsible for installing a traffic signal at its driveway at its own cost. If a signal did indeed become warranted, County staff would prefer that the signal be situated at a midpoint driveway along the development, preferably in proximity to NW 1st Street so that the signal would create traffic gaps for the adjacent residents to exit their community. The topic was redevelopment, specifically the Dania Pointe, impacts on the community, housing, and gentrification. One issue that was raised was for a change in traffic signaling at NW 1st Street and Bryan Road. Currently, there is a stop sign on NW 1st to turn on to Bryan Road. Bryan has no signals or signs. As it is today, it is very difficult and dangerous to turn out onto Bryan Road due to the speed and configuration of the intersection, especially if you need to make a left turn. We understood from the developer, that there needs to be a study to warrant any changes. As you know, Dania Pointe will be installing at least 4 entry points to the project. As 1-95 gets backed up, more people are coming off of Stirling and Griffin and cutting along Bryan Road. I have copied Captain Marks who can confirm such events in recent weeks/months. We would like to see if the MPO/Broward County Engineering can install a light at that intersection now and in anticipation of the development, or include it as part of the plan. We understand you are already signaling Old Griffin and Bryan. This intersection also needs to be have the same attention. If not a light, a three way stop?
