A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,URGING ALL MEMBERS OF THE FEDERAL AND STATE
OF FLORIDA GOVERNMENT TO OPPOSE PRESIDENT TRUMP'S
ADMINISTRATION'S DECISION AND THE DEPARTMENT OF JUSTICE
POSITION THAT THE CIVIL RIGHTS ACT DOES NOT AFFORD
PROTECTION FROM EMPLOYMENT DISCRIMINATION ON THE BASIS OF
SEXUAL ORIENTATION OR GENDER IDENTITY; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,on July 26, 2017,the Department of Justice ("DOJ"), although not a parry to
the subject litigation, filed a brief in an ongoing Second Circuit case, arguing that Title VII of the
Civil Rights Act of 1964(Title VII)—a major federal anti-discrimination statute—does not prohibit
discrimination based on sexual orientation; and
WHEREAS, the same day, President Trump announced that he would ban transgender
people from serving in the military; and
WHEREAS,the Equal Employment Opportunity Commission has argued for years in court
filings that sexual orientation discrimination is sex discrimination under Title VII; and
WHEREAS, the City Commission of the City of Dania Beach opposes all forms of
discrimination; and
WHEREAS,the City Commission opposes the position taken by President Trump and that
of the DOJ; and
WHEREAS,the City Commission believes the opposition of the position taken by President
Trump and that of the DOJ is in the best interests of the residents and businesses of the City of Dania
Beach,the State of Florida and the United States of America;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. The foregoing"Whereas"clauses are ratified and confirmed as being true and
correct, and they are made a specific part of and incorporated into this Resolution by this reference.
Section 2. The City Commission urges all members of the Federal and State of Florida
Government to oppose President Trump's Administration's claim that the Civil Rights Act does not
afford protection from employment discrimination on the basis of sexual orientation or gender
identity.
Section 3. The City Commission of the City of Dania Beach formally requests that
President Trump reconsider his discriminatory policy decision and direct the DOJ to maintain the
previous position of the United States that the Civil Rights Act prohibits discrimination against
minority groups and classes of people including,but not limited to,the LGBT community.
Section 4. The City Commission further directs City Administration to transmit a
certified copy of this Resolution to the National League of Cities,the Florida League of Cities,the
Broward League of Cities,the Broward Legislative Delegation,the U.S. Congressional Delegation
for Florida, President Trump, the White House and any other interested parties.
Section 5. That all resolutions or parts of resolutions in conflict with any portion of the
provisions in this Resolution are repealed to the extent of such conflict.
Section 6. This Resolution shall be in force and take effect immediately upon passage
and adoption.
