RESOLUTION NO. 2017-103 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-029-17) AND VARIANCE (VA-58-17) APPLICATIONS SUBMITTED BY SYNALOVSKI ROMANIK SAYE ON BEHALF OF THE PROPERTY OWNER MARINA INDUSTRIAL PARK, LLC FOR PROPERTY LOCATED AT 2401 SW 31 STREET IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT A, A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled,"Land Development Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements,"of Article 635, entitled,"Site Plans"of Section 635-20(A),provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Marina Industrial Park, LLC, ("Applicant"), is requesting approval of a site plan and variance for the development of the property located at 2401 SW 31 Street in the City of Dania Beach, Florida, as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this Resolution by this reference; and WHEREAS,the Applicant is requesting Site Plan approval to permit the future development and construction of professional office with accessory overnight fleet parking pursuant to and consistent with the attached Site Plan provided as Exhibit`B"; and WHEREAS,Part 6 of the LDC,Article 625,entitled"Variances",Section 625-40 states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS,the Applicant has requested a Variance to allow a side setback of thirteen(13) feet(VA-58-17),where the LDC requires twenty (20) feet per Section 205-10; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the Site Plan(SP-029-17)and Variance (VA-58-17) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements,"Article 635 "Site Plan,"the following Site Plan (SP-029- 17), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved subject to the conditions specified in Section 6 of this Resolution. Section 3. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements,"Article 625"Variances,"the following Variance application (VA-58-17) is approved consistent with the attached Site Plan provided in Exhibit`B". Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. For all projects resulting in buildout of the site,such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include,but is not limited to,location of equipment and material during construction.(PLANNING) 2. For all projects resulting in buildout of the site,such that construction staging cannot occur on site,the applicant must obtain Maintenance of Traffic Plan approval by the City 3. Engineer for period of construction prior to issuance of a building permit. (PLANNING) 4. On Sheet L-200,provide a list of which trees(quantity and species)are proposed to be installed to meet the mitigation requirements in the "plant schedule" table. (LANDSCAPE) 5. On Sheets L-200 and L-300, provide a special symbol or callout to indicate the location of trees proposed to be installed to meet mitigation requirements.Note that trees used to meet the minimum site requirements(buffers,NVOS,peninsulas etc.) may not be counted as mitigation trees. (LANDSCAPE) 2 RESOLUTION#2017-103 6. Please provide a detail sheet accompanying the Civil Plans with the following details (FIRE): a) Bollard/Impact Protection Detail for Hydrants, FDC's&DDCV's. b) Roadway Pavement Marker(RPM)Detail for Fire Hydrant Locations (Blue Reflective Markers). c) Signage Detail for the Fire Department Connections (where applicable). 7. Provide address Detail. (FIRE) 8. Provide an egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (FIRE) Section 5. That failure to adhere to the terms and conditions of approval above shall be considered a violation of the City Code and persons found violating the conditions shall be subject to the penalties prescribed by the City Code, including but not limited to, the revocation of the approvals granted by this Resolution. The Applicant understands and acknowledges that it must comply with all other applicable requirements of the City before it may commence construction or operation, and this Resolution may be revoked by the City Commission at any time upon a determination that Applicant is not in compliance with the City Code. Section 6. That pursuant to LDC Section 635-100"Expiration of Site Plans"and Section 625-50 "Expiration of variances", the Site Plan (SP-029-17) and Variance (VA-58-17) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18)months from the date of this Resolution. Section 7. That such application must be reviewed by the Broward County Aviation Department. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. 3 RESOLUTION#2017-103 Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 10.
