Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals There were no presentations on this agenda. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Linda Wilson, Friends of the Dania Beach Library, asked the Commission to consider everything they have done over the years, and she hopes the Commission will see the outreach they make and give them funding. Homer & Linda McDuffie, 120 NW 6ffi Avenue, voiced concern about their neighborhood, particularly loud music, marijuana smoking and drug sales, which go on every day. Mayor James noted she asked Ms. McDuffie to come up because she has received several complaints. It is unacceptable that people cannot submit anonymous complaints to the Sheriff's Office. She needs officers names if they are not brave enough to serve without giving out people's names; they should not serve. She will have Chief Marks speak to Ms. McDuffie. Commissioner Grace noted she has the same problem. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, said they spoke with the owner of the house and noted the property does smell; it is private property and people can be there if they are invited on the property. He noted if BSO receives a call, they will respond and do whatever they can. Commissioner Grace questioned if we could use Nuisance Abatement on the property. City Attorney Ansbro noted we would need to re-convene the board. He will work with the Police Chief. Commissioner Brandimarte noted this is not the only house that we have problems with; we cannot keep buying houses. Commissioner Salvino questioned if property could be taken after a certain number of complaints and fines rather than acquiring it financially. City Attorney Ansbro will work with Code Compliance to see if it could go before the Special Magistrate as a nuisance. He will also work with Chief Marks. Chief Marks reported on the Walk to School event and criminal activity. Sean Brown, Battalion Chief, BSO Fire Rescue, reported the Sound the Alarm smoke alarm event with the Red Cross has been postponed until March 2018. He addressed what Dania Beach did with ALFs as a follow-up to Hurricane Irma; overall, the facilities were in good shape. ALFs have 60 days to get generators installed as a result of Governor Scott's actions on September 16, 2017. He is concerned with how they will get permitting and installation in this time frame; the matter is confusing and they are trying to get clarification. Mayor James confirmed they have 45 days to submit a plan. She added this takes her discussion item off the agenda because it is mandated by the Governor. 7. The motion carried unanimously. 7.3 RESOLUTION 42017-112 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A DEVELOPMENT AGREEMENT AND ANY ADDITIONAL DOCUMENTS PERTAINING TO THE AGREEMENT AND TO TAKE ALL ACTIONS NECESSARY TO IMPLEMENT THE TERMS AND CONDITIONS OF THE AGREEMENT, WITH DANIA BEACH HOSPITALITY GROUP, LLC RELATED TO THE DEVELOPMENT OF THE WYNDHAM GARDEN HOTEL;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2017-112. Mayor James pulled this in the wake of Hurricane Irma, and noted there needs to be discussion about requiring hotels and gas stations to have generators. Commissioner Grace motioned to adopt Resolution #2017-112; seconded by Vice-Mayor Harris. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. City Attorney Ansbro read the title of Resolution#2017-118. Brad Kaine, Director of Public Services, explained this is for the rehabilitation of three lift stations. Vice-Mayor Harris motioned to adopt Resolution #2017-118; seconded by Commissioner Grace. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans There were no Public Hearings on this agenda. 10. Discussion and Possible Action 10.1 RESOLUTION 42017-119 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA, PERTAINING TO COMPENSATION FOR THE MAYOR AND CITY COMMISSIONERS; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2017-119. City Manager Baldwin noted the Commission asked for funds in the budget to increase the base salary of the Commissioners, and staff is looking for Commission direction. Commissioner Grace recommended $5,000.00 for the Mayor and Commissioners. Commissioner Grace motioned to increase the Commissioners salaries by $5,000.00; seconded by Vice-Mayor Harris. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Harris Yes Commissioner Grace Yes Mayor James Yes Commissioner Salvino Yes 10.2 Stellar Homes and Tropical Acres Agreement—Mayor James Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. Jack Studiale, owner of Tropical Acres, noted FDOT will not make any changes to the intersection, so it is a done deal; it is finished. Marc LaFerrier, Director of Community Development, noted the intersection of 26 Street and Griffin Road is the jurisdiction of Broward County and FDOT. He explained the issues involved with widening the road. A copy of the FDOT letter denying the request is attached to and incorporated into these minutes. Mayor James noted building the building was dependent on them getting the agreement, and said she needs to know our options. City Attorney Ansbro said the developer fulfilled the provision and they did work with Tropical Acres, and noted the last sentence states that if they cannot widen the road, the project could still be built. Mayor James says she is rescinding her vote since she conditioned it on them coming to an agreement. City Attorney Ansbro warned he is not sure legally that she can do it. Community Development Director LaFerrier commented this is a really tough situation for the applicant and Mr. Studiale in that a developer cannot be responsible for someone else's decision. Attorney Steve Wherry noted what was approved was a conversion of a previously approved project. They are receiving positive response to the development. They tried with FDOT, but they will not allow it because of the safety issues. They do not want to negatively affect the businesses on the east side of 25th Avenue. Mayor James stated she is not against the project which is why she voted for it in the first place; her concern is for the residents who already live here. To not have all the facts is very disappointing to her. Mr. Studiale said he got feedback from the neighbors, and they did not want to widen the road. City Attorney Ansbro explained if FDOT does not do this, none of us can make them do it. He addressed the process of an appeal and said the Commission wants Community Development Director LaFerrier to exhaust all possibilities. Vice-Mayor Harris noted he sees all sides of this and felt we should do the appeal. 10.3 Governor Scott's proposal for Rule changes for Assisted Living Facilities — Mayor James Mayor James noted this was discussed earlier. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. 10.4 Donation Policy—City Manager Baldwin City Manager Baldwin noted this policy has been discussed with the Commission and the proposal is to have the Commission or somebody other than staff make the decision. Colin Donnelly, Assistant City Manager, suggested a City Board make the recommendation to the Commission at a public hearing, for the Commission to decide. He noted it is a political decision, not a policy decision. The Parks & Recreation Board could be tasked with this or perhaps the Grant Advisory Board could be revived. Commissioner Grace said she is disappointed in the organizations that did not do anything during Hurricane Irma. The Friends of the Library do a fantastic job for the City and they are worthy of being on the list. She does not care what board gets it; it is all about Dania Beach. She said the MLK budget needs to be cut in half in the Parks and Recreation budget. She was elected to serve the residents of Dania Beach and she does what is positive for Dania Beach. We should not donate to some of the people on the list. City Manager Baldwin suggested the persons could meet with the Commissioners to decide who to give it to. Commissioner Grace felt the Parks & Recreation Board should make the list for the Commission and the Commission then cut the list and let it go. Commissioner Brandimarte suggested it go to the Grant Advisory Board and the Commission make the final decisions. Assistant City Manager Donnelly reviewed other elements of the policy that have not changed, including how appropriations are handled for groups such as the Seniors and MLK. Mayor James brought Ivie Cure to the podium to discuss the MLK Committee. Ms. Cure stated she has no idea where the money comes from or goes to; she does not deal with money. Mayor James noted she does not want to give a dime to any organization that does not submit a report, including the MLK Committee and the Dania Bears. Commissioner Grace confirmed the direction is for all budgeted payments to organizations, that in the past received a total donation for programs, will be made through Parks and Recreation with review of receipts before funds are issued. The Commission consensus was for the Parks and Recreation Board to review the charitable donations. 11. Commission Comments 11.1 Commissioner Brandimarte Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. Commissioner Brandimarte commended Bergeron on the tremendous job they are doing with the clean-up from the hurricane. 11.2 Commissioner Grace Commissioner Grace noted the City is getting back on track and has done a fantastic job of helping our residents. Commissioner Grace thanked Lauren Odman for all of her work after the hurricane. Commissioner Grace noted Lighthouse Community Church wants to help people in the Keys; supplies may be dropped off at the church. Commissioner Grace spoke of Dorothy's House in West Park and said a similar home is planned in Dania Beach. 11.3 Commissioner Salvino Commissioner Salvino thanked Public Works and asked the residents to separate their trash from the brush. 11.4 Vice-Mayor Harris Vice-Mayor Harris explained why he mentioned earlier the need for housing in Dania Beach. Vice-Mayor Harris said that aside from the post hurricane matters being dealt with, there are other things we have our eyes on: surplus properties, bus stops, sober homes, traffic light on Bryan Road at NW 1st, class and pay study, new budget, and entrance signs. 11.5 Mayor James Mayor James thanked Redline Media Marketing Group for providing ice to people who did not have power in the SW section, and thanked Master Developers and Robert Shapiro for their donations. Mayor James noted the Commission needs to decide what to do with City Hall; we need to make a decision and stick to it. Mayor James said she wants leniency on our residents for the debris. The City needs to have compassion. Mayor James addressed the Sun Sentinel article in which Commissioner Salvino spoke out about having a Commission meeting after Hurricane Irma. She said our employees were at City Hall working, and to ask the Commission to have a meeting to conduct City business, Commissioner Salvino's comments left a bad taste in her mouth because that is not operating as a team. She Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. was helping residents before, during and after the hurricane. She stated she is the leader of this team and he was disrespectful. Everyone helped residents except Commissioner Salvino, and other cities also had meetings the same week and night as us. She said this is negative dirty politics; he is barking up the wrong tree. Commissioner Salvino commented each of the Commissioners are leaders. He said he was boarding up people's houses, and he gives back a lot to the community. He fed homeless people out of his restaurant. He stated leadership does not divide. Mayor James reclaimed her time and said we are elected to serve the City of Dania Beach, no matter what happens at our house. She added Commissioner Salvino was disrespectful to the Commission by speaking to the press. Commissioner Salvino requested a vote on his absence at the September 12, 2017 City Commission meeting. Commissioner Grace motioned to excuse Commissioner Salvino's absence from the September 12, 2017 meetings, seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted we are moving forward with our projects and he will submit a report to the Commissioners. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday, September 26,2017—7:00 p.m. City Manager Baldwin spoke of debris removal and noted it will likely be at least 60 days before all debris is removed.
