OT-73-17 and Use of Height Incentive Submitted by Dania Airport Hotels RESOLUTION NO. 2017-135 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-002-17) AND ASSOCIATED DESIGN VARIATIONS (OT-76-17, OT-77-17, OT-78-17, OT- 79-17, OT-80-17), VARIANCES (VA-74-17, VA-81-17, VA-82-17, VA-84-17, VA-94-17) AND EXCEPTION (OT-73-17), AND USE OF HEIGHT INCENTIVE SUBMITTED BY DANIA AIRPORT HOTELS LLC, DANIA AIRPORT HOTELS 2 LLC AND DANIA BEACH INVEST, LLC FOR PROPERTIES GENERALLY LOCATED ON THE EAST SIDE OF NORTH FEDERAL HIGHWAY BETWEEN NE I STREET AND EAST DANIA BEACH BOULEVARD FOR THE HOTEL SITE AND ON THE EAST SIDE OF NE 1 COURT BETWEEN NE 1 STREET AND EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements", Article 635, entitled "Site Plans", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Dania Airport Hotels, LLC, Dania Airport Hotels 2, LLC and Dania Beach Invest, LLC (collectively the "Applicants") are requesting site plan approval to permit the development of a hotel project consisting of 115 hotel rooms and 997 square feet of commercial space to be located on the east side of North Federal Highway between NE l St Street and East Dania Beach Boulevard for the hotel site and on the east side of NE 1 Court between NE 1 Street between NE I Street and East Dania Beach Boulevard in the City of Dania Beach, Florida, (the "City"), as legally described in Exhibit"A"; and WHEREAS, Chapter 28, Part 3 of the LDC, entitled "Design District Overlay", Article 301 "Legal and Administrative Provisions", Section 301-50 "Variations in design; procedure for review of design variations", states that the City may waive design-based requirements as part of a site plan application; and WHEREAS, Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations", Article 510 "Principal Arterial Commercial Standards", Section 510-20 "Applicability", states that the City may approve exceptions to the guidelines as part of a site plan application; and WHEREAS, Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations", Article 505 "Sign Regulations", Section 505-180 "Relief from Requirements, Sign Variances", states that the City Commission may grant sign variances based upon a determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances", Section 625-40 states that the City may grant a variance based on its determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a design exception to not provide the required percentage of glass windows and doors where Section 510-30(H)provides that at least thirty-five (35%) of the primary elevation must be in glass windows and doors; and to provide more than three (3) colors in alternative colors on the external fagade of the building where Section 510-30 (I) of the LDC states that coloration of all buildings shall have a maximum of(3) colors in a "earth tone" or light pastel colors (OT-73-17); and WHEREAS, the Applicant has requested a design variation to provide parking in the first layer of property in the EDBB-MU zoning district where Section 303-60(E) of the LDC only permits parking in the second layer(OT-76-17); and WHEREAS, the Applicant has requested a design variation to provide no on-street parking where Sections 306-20 "On Street Parking Requirements" and 309-10(C) "Complete Streets" of the LDC require on-street parking (OT-77-17); and WHEREAS, the Applicant has requested a design variation from the provisions of Section 307-20 "Street landscaping and hardscaping" to provide Medjool/phoenix palms instead of the required Royal Palms; Oak trees and Pigeon Plums on NE 1st Avenue instead of the required Sabal Palms; and Oak Trees and Silver Buttonwoods on NE 1st Court instead of the required Sabal Palms (OT-78-17); and WHEREAS, the Applicant has requested a design variation to provide 63% translucent glazing on the ground floor where Section 311-20(E)(1) of the LDC requires a minimum of 70% (OT-79-17); and WHEREAS, the Applicant has requested a design variation to provide 62% of the building frontage on the Build-to-Line and 24' of depth on the first layer where Section 303- 2 RESOLUTION 42017-135 40(M) of the LDC requires a minimum of 70% building frontage on the Build-to-Line and a minimum of 30' in depth on the first layer(OT-80-17); and WHEREAS, the Applicant has requested a variance to provide 15'-6" of aisle width on the off-site valet parking lot without unobstructed access from the parking spaces to the drive aisle and 23' of stacking from property line to entrance of parking stall where Sections 265- 110(c)(2), (c)(5) and (c)(6) of the LDC requires a minimum of 24' of aisle width with unobstructed access from the parking space to the drive aisle and a minimum of 25' stacking required from the property line to the entrance of the first parking stall (VA-74-17) ; and WHEREAS, the Applicant has requested a sign variance to provide four (4) wall signs with a sign area of 38.5 square feet each for a total combined sign area of 154 square feet and a letter height of 36" where Section 505-90(V)(1) and (V)(4) of the LDC limits the property to 2 wall signs limited to a total of 187.5 square feet of combined sign area and a letter height not to exceed 24" (VA-81-17); and WHEREAS, the Applicant has requested a variance to provide 100% of the required parking as valet parking where Section 265-120 of the LDC limits valet parking to up to 10% of the required parking spaces (VA-82-17); and WHEREAS, the Applicant has requested a variance from the provisions of Section 275- 190 entitled "Plant material and installation requirements" to provide (i) less than the required shade/canopy trees where Section 275-190(D) of the LDC requires that 40% of the required number of trees shall be shade/canopy trees and (ii) to provide more palm trees than allowed by the LDC where Section 275-190(G) states that palms shall constitute no more than 20% of total trees (iii) to install trees with less than the required planting area where Section 275-190(H) requires a planting area of 225 sf with 15 feet being the in the smallest dimension for shade trees and 90 sf with 8 feet in smallest dimension for intermediate trees (VA-84-17); and WHEREAS, the Applicant has requested a variance to provide 12% of the vehicular use area in landscaping where Sec. 275-100(B) "Overall VUA landscape requirement" provides that 20% of the total vehicular use area (exclusive of landscape buffers) shall be devoted to interior vehicular use area landscaping (VA-94-17); and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and 3 RESOLUTION#2017-135 WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 002-17), Variances (VA-74-17, VA-82-17, VA-84-17, VA-94-17), Sign Variance (VA-81-17), Design Variations (OT-76-17, OT-77-17, OT-78-17, OT-79-17, OT-80-17), Design Exception (OT-73-17) and height incentives will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan(SP-002-17), attached as Exhibit`B" which is made a part of and incorporated into this Resolution by reference is approved. Section 3. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-74-17, VA-82-17, VA-84-17, VA-94-17) are approved consistent with the Site Plan provided in Exhibit`B". Section 4. That pursuant to Chapter 28 "Land Development Code," Part 3 "Design District Overlay," Article 301 "Legal and Administrative Provisions," Section 301-50 "Variations in design; procedures for review of design variations," the following Design Variations (OT-76-17, OT-77-17, OT-78-17, OT-79-17, OT-80-17) are approved consistent with the Site Plan provided in Exhibit`B". Section 5. That pursuant to Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations", Article 510 "Principal Arterial Commercial Standards," Section 510-20 "Applicability", the requested design exception (OT-73-17) is approved consistent with the Site Plan provided in Exhibit`B". Section 6. That pursuant to Chapter 28 "Land Development Code", Part 5 "Signage and Design Regulations", Section 505-180 "Relief from Requirements, Sign Variances", the 4 RESOLUTION#2017-135 requested sign variance (VA-81-17) is approved consistent with the Site Plan provided in Exhibit «B", Section 7. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Tree dispositions are not listed on the plans. Provide the disposition of each tree (remain, relocate, remove) and provide a legend for each disposition symbol on sheets LD-1 and LD-2 (LANDSCAPE CONSULTANT). 2. Several trees are listed in the arborist report as good candidates for relocation. These trees must be relocated or, per Sec. 825-90, demonstration that relocation is not possible on or offsite is required (LANDSCAPE CONSULTANT) 3. Provide a mitigation table listing the canopy area of each tree proposed for removal (in square feet), total canopy area proposed for removal (in square feet), and state how the mitigation will be met per Sec. 825-190. Provide the specimen tree value for specimen trees proposed for removal along with a statement stating that the specimen tree values will be donated to the City's tree trust fund(LANDSCAPE CONSULTANT). 4. There was one item that remains to submitted. This was discussed with the architect of record and the developer's lawyer during the last DRC meeting —we need to understand how the parking valet service will be operated (ENGINEERING). 5. Per Section 505-90(C) identify cumulative sign area permitted and used. 1.5 s.f. of sign area permitted per linear foot of occupant street frontage. The north and south sides of this property are not street frontages, therefore 0 s.f. of sign area is earned. Revise Allowed/Provided accordingly. 6. Per Section 505-40(0)(5) "Cabinet signs are prohibited, except where constructed of an opaque sign face with translucent cut outs for sign copy such that only the sign copy itself is illuminated and the background is not illuminated." Provide additional detail. Revise accordingly or request a variance. A variance request requires submittal of an application, an application fee of$2,000 for each requested variance, and a written justification statement addressing the variance criteria identified in Sec. 505-180 of the City's LDR's. The City also has a payment in lieu of parking which requires payment of $6,500 per parking space not provided on site ($6,500 X 19 = $123,500). Must be addressed with next submittal. 7. The proximity to the airport will require FAA, and BCAD review and approval. Contact William Castillo, Airport Planner with Broward County Aviation Department, located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. 3`d time requested. 8. Revise Sheet A-304, Signage SQ. FT. Requirements Table, removing the frontage notes for the north and south facades, as the north and south property lines internal side lot lines that do not have any street frontage, there for should be zero (0). Revise accordingly. 5 RESOLUTION#2017-135 9. Revise Sheet A-304, Signage SQ. FT. Requirements Table, removing the reference to CRA Sign Bonus and correcting the allowable sign area to 93.75 square foot sign area permitted per street frontage. Revise accordingly. 10. Per Section 265 — 120: o (B) `The approved site plan and an agreement between the city and property owner(s) and approved by the city attorney, shall identify the number and location of parking spaces reserved for valet parking, and shall require that any use of the property for which valet parking is provided in order to satisfy the required number of parking spaces, shall cease immediately if for any reason the valet service is not provided at all times during the operation of the uses for which the parking is provided." 3rd time requested. Provide copy of proposed agreement for staff and City Attorney review. o (C) "The site plan shall delineate the signage, and attendant-parking spaces. Td time requested. o (E) "The operator must possess a valid city local business tax receipt for a valet service. Each valet must be an employee of the operator and each must possess a valid State of Florida driver license. The operator shall have sufficient valets working at all times to avoid excessive stacking in the valet drop-off area. Excessive stacking shall exist when vehicles stacked for valet drop-off or pick-up extend into any drive aisle and impede the flow of routine traffic." Needed prior to issuance of a building permit. 2"d time requested. 11. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer, identifying the amount of RA mitigation for traffic impact due based on resolution No. 2014-049 which established a rate of$21.26 per p.m. peak hour trip. Traffic study provided identifies 81 PM peak hour trips, therefore $1,722.06 must be paid prior to issuance of a building permit. 12. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include, but is not limited to, location of equipment and material during construction. 13. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, the applicant must obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit. 14. Provide a unity of title to combine lots 9, 10, 13, & 14, as well as lots 1, 2, & 3 of Block 5. 2"d time requested. 15. Revise building elevations to ensure the building height matches the height identified on Sheet A-040, in the Site Data Table. 16. Based on the Incentive table on Sheet A-040, received on 10-13-17, the applicant is proposing to provide ten (10) public parking spaces via Payment in Lieu of Parking. Therefore a total of$65,000 must be paid to the City, of which half, or$32,500, must be 6 RESOLUTION#2017-135 paid prior to issuance of a building permit. The remaining $32,500 must be paid prior to issuance of the Certificate of Occupancy. 17. Based on the Incentive table on Sheet A-040, received on 10-13-17, the applicant is proposing to provide Public Park incentive payment in the amount of$26,501 (payment of$.50 per square foot of residential gross floor area — including hotels; 53,003 sf X .50 = $26,501). Therefore, payment of$26,501 must be paid prior to issuance of a building permit. 18. The City's LDC requires a total of ninety-six (96) parking spaces for the proposed hotel and retail space. The applicant is proposing to construct seventy-eight (78) parking spaces. The remaining eighteen (18) parking spaces must be provided for prior to issuance of a building permit. 19. The parking provided must be for the use of the hotel only. 20. Provide tables and chairs on the sidewalk adjacent to the building. Section 8. That pursuant to LDC Section 635-100 "Expiration of Site Plans", Section 625-50 "Expiration of Variances", the Site Plan (SP-02-17), Variances (VA-74-17, VA-82-17, VA-84-17, VA-94-17), Sign Variance (VA-81-71), Design Variations (OT-76-17, OT-77-17, OT-78-17, OT-79-17, OT-80-17), and Design Exception (OT-73-17) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18)months from the date of this Resolution. Section 9. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 10. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 11.
