RESOLUTION NO. 2017-138 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO PURCHASE A LIFEGUARD TOWER WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, FROM INDUSTRIAL DESIGN RESEARCH, INC. WHICH ITEM IS EXPECTED TO EXCEED THE ANNUAL VENDOR THRESHOLD OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00) FOR A SINGLE VENDOR IN A FISCAL YEAR; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part 111, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor for each fiscal year; and WHEREAS, the Parks & Recreation Director has obtained two (2) written quotes from the only two lifeguard tower manufacturing companies in the United States which quotes are attached as Exhibit"A"; and WHEREAS, initial estimates from the two (2) vendors indicate the project will be estimated to cost a not-to-exceed amount of Forty Four Thousand Dollars ($44,000.00) including freight and delivery; and WHEREAS, the Parks and Recreation Director recommends purchasing the lifeguard tower from Industrial Design Research, Inc., of Santa Ana, California, as the tower it manufactures is best suited to the needs of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the City Manager to purchase a lifeguard tower from Industrial Design Research, in an amount not to exceed Forty Four Thousand Dollars ($44,000.00) plus related freight costs without competitive bidding or advertisement for bid. Section 3. That funding for this purchase has been planned and appropriated in the Ocean Rescue Division Account No. 001-72-02-572-62-10. Remaining necessary funding will be transferred from Ocean Rescue Division Account No. 001-72-02-572-4650 Building Maintenance as purchase is expected not to exceed Forty Four Thousand Dollars ($44,000.00) including freight. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. Likewise inbound SE also has low capacity, meaning nobody is wanting to go into the SE. Many drivers are flying to Puerto Rico to help with their back-long.
