MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, NOVEMBER 14, 2017 - 7:00 P.M. 1. Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation of recognition plaque to Bergeron Emergency Services for outstanding service to the community during the cleanup of Hurricane Irma Brad Kaine, Director of Public Services, presented an award to Ron Bergeron, Sr., and his family. 3.2 Presentation of final branding concepts by Cima Georgevich, Redline Media Group Cima Georgevich, Redline Media Group, presented three proposals for the Commission to decide upon, a copy of which is attached to and incorporated into these minutes. On a 3-2 consensus, the Commission chose Concept#2, with Sea It, Live It, Love It. Mr. Georgevich noted they would move forward with developing all the other ancillary assets, a style guide for brand usage and the plan for rollout. Mayor James also wanted to change the City Seal to the same logo. Commissioners Brandimarte and Grace want to keep the current City Seal. Mayor James asked Mr. Georgevich to bring forward a design for a new City Seal. 3.4 Special Event request by Blue Ridge Farms to allow Christmas Tree sales from 11/17/2017 - 12/27/2017, at 4650 SW 30 Avenue, from 10:00 a.m. - 10:00 p.m. daily Commissioner Grace motioned to approve the Special Event request for Christmas Tree Sales; seconded by Commissioner Salvino. The motion carried unanimously. 3.5 Special Event request by the City of Dania Beach and the Dania Beach Lions Club for the 12th Annual Antique Motorcycle Show, to be held at Frost Park on 1/27/2018 from 10:00 a.m. - 5:00 p.m. Commissioner Grace questioned the parking arrangements with the Casino because of the trucks currently parking at the Casino. She also asked if the Casino had permission from the City for the parking. Clive Taylor noted the Casino will be charging $10.00 per car to park, and the Church will be charging $5.00 per car. Discussion ensued regarding the illegal parking arrangements at the Casino. Commissioner Grace motioned to approve the Special Event request for the 12th Annual Antique Motorcycle Show; seconded by Commissioner Salvino. The motion carried unanimously. 3.6 Special Event request for the City of Dania Beach Holiday Tree Lighting Event to be held at 100 W Dania Beach Boulevard on 11/30/2017 from 6:00 p.m. - 9:00 p.m. Commissioner Grace motioned to approve the Special Event request for the Holiday Tree Lighting Event; seconded by Commissioner Salvino. The motion carried unanimously. 3.7 Video from Family Fall Festival Event at C.W. Thomas Park- Commissioner Grace A video of the activities from the Family Fall Festival event was presented. 3.3 City of Dania Beach Water Supply Presentation- Fred Bloetscher Fred Bloetscher, President, PUMPS, presented a PowerPoint overview of the current issue with the water supply in Dania Beach, which is attached to and incorporated into these minutes. He noted the Brian Piccolo Agreement needs to be changed, and there will be ongoing conversations with the Commission on options. There needs to be a regional solution to the problem. He suggested multiple sources and noted cost is an issue. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,November 14,2017—7:00 p.m. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Daryl Maxwell, 2275 NE 12 Street, #20, Pompano Beach, Florida, noted he is being evicted because Dania Beach Housing Authority appointed an unqualified Hearing Officer, who lives in Hollywood. This is not about the Housing Authority, it is about injustice. Commissioner Grace clarified he was a prior resident of Dania Beach. Mayor James asked Mr. Maxwell if he was interested in being on the Dania Beach Housing Authority Board. He responded in the affirmative. City Attorney Ansbro noted he needs to meet the requirements. Emmanuel George, 17 NE 2nd Avenue, #106, suggested the City use a vacant property as an archive historical center. Commissioner Grace noted three people in the audience can provide information on Black History in Dania Beach; Rodney Collins, Jimmy Peterman, and Cheryl Baker. Mayor James noted we have surplus property and the Commission will make a decision. Gloria Fernandez, 3831 SW 56 Street, addressed traffic concerns on SW 40t'Avenue. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent activity in the City. Sean Brown, Battalion Chief, BSO Fire Rescue, noted there is a recall of 37.8 million household Kidde fire extinguishers. He also cautioned on the use of deep fryers for holiday turkey preparation. 7. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2017-038. Corinne Lajoie, Planning & Zoning Manager, explained the rezoning and flex request. Alicia Lewis, Greenspoon Marder, noted the request is now for 21 flex units, which is a reduction from the original request of 25 units. There would be a total of 60 townhomes constructed. 217 notices were sent out for each community meeting, however only 5-20 residents attended the three meetings. Commissioner Salvino has several concerns with this project, and would like to see a better presentation. Tom Hall, transportation planner and traffic engineer, noted the MPO has a project proposed for the roadway for pedestrian issues, not traffic issues. The developer has agreed to install traffic calming on the street. Marc LaFerrier, Director of Community Development, responded the MPO project will not happen for another 2.5 to 3 years; this project would be as quickly as possible. Vice-Mayor Harris questioned if everyone had seen the MPO plan. Joel Bary, developer, noted he is willing to contribute to the traffic calming project. He also noted the area is 70% owner occupied. Mayor James opened the Public Hearing. Steve Goldberg, 4010 SW 54 Court, expressed his concerns with traffic with the development of this project and the new hotel construction at the Hard Rock Casino. Traffic congestion is the problem; he is not opposed to the project. Robert Banks, 3831 SW 56 Street, spoke against the development. Elizabeth Donate, 5631 SW 40 Avenue, spoke against the development. Cathy Frawley, 3840 SW 56 Street, objected to the underhanded approval in 2015 because she never received notice; she is against the project. Timothy Frawley, 3840 SW 56 Street, spoke against the development. Grady Drake, 3901 Shady Ridge Road, spoke against the development. Megan Emery, 3839 SW 56 Street, spoke against the development. R. Marjorie Hodges, 3920 SW 56 Street, spoke against the development. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,November 14,2017—7:00 p.m. Pete Shaw, 3911 Shady Ridge Road, spoke against the development. David Sorg, 3920 SW 56 Court, spoke against the development. Dennis Marrone, 3951 SW 56 Court, spoke against the development. Steve Hardee, 5500 Woodland Lane, suggested traffic control be installed at Mapleridge, and suggested a right turn only for the project. David Steehler, 5501 Woodland Lane, spoke against the development. Cindy Harris, 3910 SW 56 Street, spoke in opposition to the development. Ms. Lewis noted they have taken a lot of notes and challenged the neighbors who did not attend the meeting to attend the next neighborhood meeting; then they could come back and answer the Commission's questions. Mr. Banks came back to the podium and explained their issue with the developer's meetings. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Salvino noted the problems are density and traffic; we need to find alternate routes to get out of the neighborhood. The MPO is putting their project in whether or not the residents like it. He suggested building single family homes for a higher cost as opposed to townhomes with less cost. He will vote for the project tonight so that he can see what happens at the second reading. Commissioner Brandimarte noted the people who are here have their minds made up no matter what. There is lack of interest from the community, and they are not willing to work with the developer. The City has to move ahead and it will. Commissioner Grace spoke of previous projects, and said she will vote for this project on first reading. Vice-Mayor Harris noted we all have the same problems living in an urban environment. Mayor James thanked everyone for voicing their opinions, and said there is very little trust between homeowners and developers. She cannot support this project because the homeowners do not want it in their neighborhood, and she feels we are developing at an alarming rate. Commissioner Grace motioned to adopt Ordinance #2017-038, on first reading; seconded by Commissioner Brandimarte. Discussion and Possible Action 10.1 Review and approve City Commission meeting dates for 2018 —City Clerk City Clerk Stilson suggested the Commission cancel the December 25, 2018 meeting. Commissioner Salvino motioned to approve the Commission meeting dates for 2018, as amended; seconded by Commissioner Grace. The motion carried unanimously. 10.2 MLK Activities—Mayor James Mayor James would like the Parks & Recreation Department to use the funds from the City for the MLK bash next year. Their organization, with our assistance, will still be hosting a parade, and they will still do their banquet and breakfast. She noted we also need to look for a more permanent solution to how we are going to run the MLK festivities. Commissioner Grace thinks Parks & Recreation can help with planning the parade, and we should not divvy out money to the organization this year. Everything that needs to be paid for will be paid by Parks &Recreation, with receipts. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,November 14,2017—7:00 p.m. Commissioner Brandimarte commented the parade is poorly attended, and questioned why we cannot use the money for a big bash and celebrate MLK Day. The consensus was to proceed as discussed. 10.3 Charitable Donations—Commissioner Grace Commissioner Grace said she was disappointed after Hurricane Irma that certain organizations did not step up to provide assistance. She wants us to focus on giving money to organizations in Dania Beach. Commissioner Salvino spoke of Veterans Day activities at CW Thomas Park and the American Legion. Commissioner Salvino also spoke of Jackie Beauzil. 11.4 Vice-Mayor Harris Vice-Mayor Harris noted he will be attending the NLC conference in Charlotte this week. Vice-Mayor Harris asked about the bus stops. City Manager Baldwin noted bids are due Friday. Vice-Mayor Harris thanked Public Services for an additional pick up of large debris that had been left behind. Vice-Mayor Harris asked about the status of the Class and Compensation study. City Manager Baldwin responded the proposals are being reviewed. Vice-Mayor Harris mentioned the traffic light at NW 1st and Bryan Road. He noted a director from MPO told him that we should void the ILA and put our own light up, and questioned if this is a possibility. Vice-Mayor Harris asked about the Commission Conference Room story board. Colin Donnelly, Assistant City Manager, said he just got the samples today and will contact the Commissioners during the week. Vice-Mayor Harris commented we need an upgrade to our AV technology in the Chamber. Vice-Mayor Harris noted he had mentioned to the City Manager that we need solar powered traffic lights for the next hurricane; this is something to think about. Vice-Mayor Harris spoke of the Post Office mailbox that was stolen on October 29tn 11.5 Mayor James Mayor James commented that the new Pizza Hut will not deliver after 5:00 p.m. in certain neighborhoods. Someone had been robbed and they are no longer delivering to the NW section. A supervisor said the robbery actually happened on Charleston Street, but a BSO Officer told him not to service those communities. She is disgusted and will not stand for this, and is very hurt. Appointments 12.1 Dania Beach Housing Authority Mayor James - 1 appointment for a 4-year term of a resident who is current in rent in a housing project, or a person of low income who is receiving rent subsidy through a project administered by the Authority (Tiffany Carlisle's term expired October 31, 2017, and she has expressed a desire to remain on the board) Mayor James noted the person she appointed at the last meeting does not fit the requirements. She will do her best to revamp the Housing Authority Board as there are a lot of residents who are not happy. She will not reappoint Ms. Carlisle; she will only appoint somebody that she knows. Current AADT for this road is about 6,600 per day(see site information from FDOT online traffic),which translates to my estimated peak hour volume of 660 vehicles per hour. Level of Service D for this type of road is about 1,330 vehicles per hour(see Table 4 below), which means that the SW 40th is currently operating at 50%capacity. Proposed development will generate a PM Peak of 41 vehicle trips.The Institute of Transportation Engineers(ITE) publication entitled "Transportation Impact Analyses for Site Development,2010" stipulates that a 100 or more added new trips may adversely impact existing traffic.This is not the case for this development.
