HomeMy WebLinkAboutR-2017-155 Approves the Site Plan (SP-107-17) Submitted by Joseph Denis on Behalf of Dania Live 1748, LLC for Property on the North Side of Stirling Rd. between Bryan Rd. & I-95 RESOLUTION NO.2017-155 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-107-17) SUBMITTED BY JOSEPH DENIS ON BEHALF OF DANIA LIVE 1748, LLC FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN BRYAN ROAD AND INTERSTATE 95 WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A,' A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635 "Development Review Procedures and Requirements," and Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-40 "Development Design Guidelines (DDG)," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, LDC Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-30(S) "Site plan approval," provides that site development shall comply with the established PMUD regulations and the approved DDG; and WHEREAS, Resolution No. 2016-160 approved a site plan for portions of Dania Pointe Phase II, consisting of approximately 473,418 square feet of commercial buildings to be located at the northwest corner of Stirling Road and Bryan Road in the City of Dania Beach, Florida(the "City"); and WHEREAS, Joseph Denis, on behalf of Dania Live 1748, LLC (the "Applicant") is requesting site plan approval to permit the development of additional areas of Dania Pointe Phase II, consisting of approximately 31,430 square feet of commercial uses and 350 hotel rooms to be located at the northwest corner of Stirling Road and Bryan Road in the City; and WHEREAS, the site plan application (SP-107-17) has been reviewed for compliance with the approved Dania Pointe DDG in accordance with Article 635 and Article 340 of the LDC; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-107-17) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635 "Development Review Procedures and Requirements," and Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-40 "Development Design Guidelines (DDG)," the Site Plan (SP-107-17), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions which must be addressed prior to issuance of a building permit, unless otherwise identified: CONDITIONS OF APPROVAL 1. COST RECOVERY: per Article 685, cost recovery funds may be utilized for various costs of the city's administrative and outside fee consultants for the processing and review of applications. Per City Attorney's request, please provide $5,000 cost recovery fee with next submittal. The cost recovery money can be returned if not utilized, or additional fees may be requested if addition fees are incurred(Planning). 2. RAC TRAFFIC IMPACT MITIGATION: Resolution No. 2014-049 established a rate of$21.26 per p.m. peak hour trip. Kimley-Horn identifies 245 PM Peak trips, therefore, $5,208.70 (245 X 21.26)is due prior to issuance of a building permit(Planning). 3. Applicant must obtain a statement from the City Engineer saying that the traffic study/statement submitted by the applicant is complete and accepted prior to public hearing(Planning). 4. Applicant must obtain statement from Ronnie Navarro, City Engineer, stating that adequate water supply exists for this project(Planning). 5. Per 0-2017-027, commercial properties under construction are required to provide security to fencing with screening showing project rendering when adjacent to ROW(Planning). 6. Per City's LDC, Section 635-50: (M) "The location, dimensions and character of construction of proposed curb cuts, entrances and exits, parking and loading areas (including number of parking spaces and loading spaces), pedestrian use areas, and vehicular use areas"; 2 RESOLUTION#2017-155 • Number of parking spaces required and provided not clear. Sheet A 1.02 and C-400A conflict (Patron areas & meeting room/ball room versus Commercial & Supporting uses) & Sheet C-400A does not include required/provided parking for hotel use. • Sheet A 1.02 identifies 292 parking spaces provided, but Sheet A2.03 shows 287 + 8 ADA=295. Revise accordingly. • Provide note on plan that identifies where parking for each use will be located. (Y)The following computations: (3) Total existing and proposed square footage of buildings and breakdowns by floor, use type, bay or tenant space, and dwelling unit, including required and provided minimum floor areas; o On Sheet A 1.02 must identify on site plan the square foot proposed on Floor 3 for ballroom/restaurant use in order to calculate required parking. 14. Identity the square footage of retail, restaurant, meeting rooms, ball rooms, etc. (totaling 31,430 sf), in parking table and identify the required and provided parking for these uses. The square footage of the 2nd floor is identified as 29,209, the parking requirements only account for 15,293sf. Same for 3rd floor. Identify all calculations ad related information (such as location of parking)o Sheet A1.02(Planning). 15. The parking designated for hotel use is required and will be for the exclusive use of the hotel in perpetuity(Planning). 16. Must identify required and provided parking for all uses: Hotel, restaurant, meeting/ballrooms, etc. in site plan calculations. 17. Identify where parking garage#4 is located on Sheet C-400A or provide note on Sheet C-400A. 18. On Sheet A4.13 revisit the transition blend; 9'6" provided run at 6.6%. The dimensions of Parking, 5d' Edition, a publication by The Urban Land Instituted and the National Parking Association, recommends 12' run (minimum) at 6% grade. Please accommodate this in your design(Engineering). 19. Sheet A2.01: Please revise ground floor plan to show proposed Finished Floor Elevations (Flood Plain Reviewer). 20. "Sector"sheets A3.01,A3.1,A3.21,A3.33 could not be located(Flood Plain Reviewer). 21. Overall, a determination cannot be made based on the submittal as to whether the project meets the flood provisions of Chapter 12 of the Dania Beach Code of Ordinances and the Florida Building Code(Flood Plain Reviewer). Section 4. That pursuant to Section 14 "Site Plan Submittals" of the Dania Pointe PMUD Design Development Guidelines, the Site Plan (SP-107-17) approval shall automatically expire and become null and void five (5) years from the effective date of this Resolution unless the Applicant files a complete building permit application and secures approval of building 3 RESOLUTION#2017-155 permits for the improvements shown on the Site Plan within the five (5) year time frame, unless an extension is granted by the City Commission. Section 5. That issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
