HomeMy WebLinkAboutR-2017-026 Support of HB93-S162 Plastic Bag Ban RESOLUTION NO. 2017-026 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA SUPPORTING THE STATE OF FLORIDA HOUSE AND SENATE BILL HB93/S162 WHICH WOULD ALLOW COASTAL MUNICIPALITIES IN FLORIDA WITH A POPULATION OF LESS THAN 100,000 TO CREATE A PILOT PROGRAM TO REGULATE OR BAN DISPOSABLE PLASTIC BAGS AND TO LESSEN THE NEGATIVE IMPACT OF SINGLE-USE PLASTIC BAGS ON THE ENVIRONMENT OF SUCH COMMUNITIES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida is diligent in its efforts to preserve the environment for the residents, businesses and visitors to the City; and WHEREAS, plastic bags are found to be environmentally detrimental because they do not fully degrade in oceans or land environments; they introduce unsafe chemicals into the environment and create the potential for injury and death to both land and marine animals through entanglement and ingestion; and WHEREAS, the expansive usage of single-use shopping bags and their disposal creates an impediment to the City's waste reduction and recycling goals while creating unsightly litter; and WHEREAS, reusable bags are considered to be a desirable option to reduce waste and litter,to protect wildlife and to conserve resources; and WHEREAS, the City Commission acknowledges that some businesses have taken affirmative steps to move towards use of reusable shopping bags and recognizes the proactive efforts of such businesses; and WHEREAS, it is in the public interest for the Florida Legislature to address the proliferation of single-use shopping bags; and WHEREAS, a Florida legislative bill, HB93/S162, is under consideration in the 2017 Session of the Florida Legislature which would allow coastal municipalities in Florida with populations of less than 100,000 to create a pilot program to regulate or ban disposable plastic bags and to lessen the negative impact of single-use plastic bags on the environment of such communities; and WHEREAS,the City supports the adoption of HB93/S 162; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the City Commission of the City of Dania Beach, Florida is committed to the long-term goal of reducing the harm of pollution attributed to the improper disposal of plastic products and is committed to ensuring a thriving, attractive and safe environment for current and future residents, businesses and tourists. To that end, the City supports initiatives to lessen the negative impact of single-use plastic bags and specifically, supports the promotion of reusable shopping bags as a desirable alternative to use of single-use plastic bags. Section 3. That the City supports the adoption by the Florida Legislature of HB93/S 162 to allow coastal municipalities in the State of Florida to participate in a proposed pilot program which would allow coastal municipalities in Florida with populations of less than 100,000 to create a pilot program to regulate or ban disposable plastic bags and to lessen the negative impact of single-use plastic bags on the environment of such communities. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED on March 28, 2017.
