AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING THE FUTURE LAND USE ELEMENT OF
THE DANIA BEACH COMPREHENSIVE PLAN TO CHANGE THE FUTURE
LAND USE TEXT TO ADD AN ELECTRICAL GENERATION FACILITIES
LAND USE CLASSIFICATION AS ATTACHED HERETO AND TO AMEND
THE FUTURE LAND USE PLAN MAP TO CHANGE THE DESIGNATION
OF APPROXIMATELY 373 GROSS ACRES AS LEGALLY DESCRIBED IN
EXHIBIT "A" ATTACHED TO THIS ORDINANCE, FROM UTILITIES AND
INDUSTRIAL TO ELECTRICAL GENERATION FACILITIES FOR
PROPERTY LOCATED AT 3051 SW 30' AVENUE, PURSUANT TO A
REQUEST SUBMITTED BY LEIGH ROBINSON KERR & ASSOCIATES,
INC./LEIGH R. KERR, AICP ON BEHALF OF THE PROPERTY OWNER,
FLORIDA POWER & LIGHT COMPANY (LU-87-17); PROVIDING FOR
TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL
AND STATE AGENCIES; PROVIDING FOR ADOPTION PURSUANT TO
SECTION 163.3184, FLORIDA STATUTES; REQUESTING
RECERTIFICATION FROM THE BROWARD COUNTY PLANNING
COUNCIL; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Article 650 "Land Use Plan Amendment", of Chapter 28,
"Land Development Code", of the City of Dania Beach (the "City") Code of Ordinances and
Section 163.3184, Florida Statutes, the Applicant, Leigh Robinson Kerr& Associates, Inc./Leigh
R. Kerr, AICP. on behalf of the property owner, Florida Power & Light Co., has applied to the
City for approval of a future land use text amendment to add an Electrical Generation Facilities
land use classification to the Future Land Use Element of the City's Comprehensive Plan as
provided in Exhibit "B", and a Future Land Use Map ("FLUM") Amendment to the
Comprehensive Plan from Utilities and Industrial to Electrical Generation Facilities on an
approximately 373 acre parcel located at 3051 SW 30t' Avenue as shown in Exhibit "C", and
legally described in Exhibit"A"; and
WHEREAS, the City Commission of the City of Dania Beach has conducted duly
noticed public hearings, in accordance with Section 163.3184(11), Florida Statutes, on the
proposed Amendments; and
WHEREAS, staff recommended approval of the requested Future Land Use Text
Amendment and the FLUM Amendment in its report dated September 12, 2017; and
WHEREAS, the City's Planning and Zoning Board, sitting as the Local Planning
Agency, reviewed this request at its August 16, 2017 meeting and voted to recommend approval
of this request; and
WHEREAS, after reviewing the Local Planning Agency's recommendation, the
recommendation of City staff, and the comments from the public, the City Commission finds the
proposed Future Land Use Text Amendment, attached as Exhibit`B" and the FLUM amendment
to the City's Comprehensive Plan, as shown in Exhibit "C" for property legally described in
Exhibit "A" to this Ordinance, are in compliance with and consistent with Florida law and its
adopted Comprehensive Plan;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing Whereas clauses are ratified and incorporated as the
legislative intent of this Ordinance.
Section 2. That pursuant to Section 163.3184, Florida Statutes, the Future Land Use
Text Amendment to add the Electrical Generation Facilities land use classification, attached as
Exhibit `B" and the FLUM Amendment to the Comprehensive Plan for the Property, legally
described in Exhibit "A," from Industrial and Utilities to Electrical Generation Facilities as
shown in Exhibit"C", are adopted.
Section 3. That the City staff is authorized to transmit the Amendment to the Florida
Department of Community Affairs and other state agencies pursuant to the requirements of
Chapter 163.3184, Florida Statutes.
Section 4. That City staff is authorized to transmit an application to the Broward
County Planning Council to request amendment of the Broward County Land Use Plan map and
to request recertification of the City's Future Land Use Plan including the Future Land Use Plan
Map.
Section 5. That the provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.

Section 6. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with the provisions of this Ordinance are repealed to the extent of such
conflict.
Section 7. That the effective date of this Amendment shall be after the second
reading and adoption of the amendment by the City Commission and, subsequently, the date a
final order is issued by the Florida Department of Community Affairs finding the amendment to
be in compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is
issued by the Administration Commission finding the amendment to be in compliance in
accordance with Chapter 163, Florida Statutes.

PASSED AND ADOPTED on second and final reading on January 9, 2018.

1. Permitted Uses for the City of Dania Beach Land Use Plan
U. Electrical Generation Facilities Use
Electrical Generation Facilities Uses are designated on the Land
Use Plan Map, to ensure the availability of land for electrical
power plants and associated ancillary uses are adequate to meet the
current and future needs of the City's and Broward County's
population.
The permitted uses in areas designated electrical generation
facilities are as follows:
Electrical power plants.
Other uses determined to be ancillg t�primar
Recreation and open space uses may also be permitted as long as
the location of the uses does not preclude or adversely affect the
fixture use of the surrounding areas for electrical generation
facilities.
