Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request by Dolphins Cycling Challenge, Inc. for the annual Miami Dolphins Charity Bike Ride Cancer Challenge to be held February 10, 2018, beginning and ending at the Hard Rock Stadium, 347 Don Shula Drive, Miami Gardens, Florida from 8:15 a.m. - 12:00 p.m. Commissioner Grace motioned to approve the Special Event request for the annual Miami Dolphins Charity Bike Ride Cancer Challenge; seconded by Commissioner Salvino. The motion carried unanimously. 3.2 Special Event request by the South Florida Regional Transportation Authority to have their annual "Rail Fun Day" on January 27, 2018 from 11:00 a.m. - 3:00 p.m., at the Tri Rail Station located at 500 Gulf Stream Way Commissioner Grace motioned to approve the Special Event request for the annual Rail Fun Day; seconded by Commissioner Salvino. The motion carried unanimously. 3.3 Special Event request by the City of Dania Beach to have various Martin Luther King, Jr. Day activities throughout the City between January 13-15, 2018. The applicant is requesting the following: Special Event fee waiver of $150.00; Port-o- lets for CW Thomas Park; BSO Police Escort Detail for the parade; and BSO Security Detail at C.W. Thomas Park for the festivities. Commissioner Grace motioned to approve the Special Event request for the Martin Luther King Jr. Day activities, including the fee waiver, port-o-lets, and BSO services; seconded by Commissioner Salvino. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Clive Taylor, 642 NE 3 Street, provided an update on the upcoming Antique Motorcycle Show. Christine Douglas, 4665 SW 38 Terrace, thanked the Commission for providing assistance to a resident in Davis Isles. Jose Armand, 50 SE 3 Avenue, invited the Commission and anyone who might be interested to attend the next Creative Arts Council Advisory Board meeting. Linda Wilson, Friends of the Dania Beach Paul DeMaio Library, thanked the Commission for their support, and provided information on upcoming programs. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, provided a report on burglaries and felonies during the holiday season. Sean Brown, Battalion Chief, BSO Fire Rescue, spoke of the boat fire at the Dania Beach Marina. Commissioner Brandimarte confirmed that the City does not allow live-aboards at the marina. Assistant City Manager Donnelly noted that part of the marina is set aside for transient boaters, who can live there temporarily. He will address the issue with Westrec and Director Felicetty,to insure that we do not have any live-aboards. 7. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Items #7.2 and 97.4; seconded by Commissioner Salvino. The motion carried unanimously. 7.2 Travel Requests: Request from Mayor Tamara James to attend the Annual Women Economic Forum (WEF) 2018 in New Delhi, India on April 25 - May 1, 2018 (Estimated cost $2,412.25-$2,715.31) Commissioner Brandimarte felt the Mayor should attend at her own expense. She does not feel this is City business and taxpayer dollars should not be spent on the trip. She will not vote for this and wants the record to reflect her reasons against this. Mayor James said they sought her out and Commissioners spend just as much money on conferences in the United States. She said this is a benefit to the City, and addressed several Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. things that are City-related as being the reasons why she should go. She noted it is a prestigious honor for her to go and network on the City's behalf. Commissioner Brandimarte noted the classes could be attended in Florida. Commissioner Grace thinks it is an honor for the Mayor to represent the City of Dania Beach. She refuses to go to Tallahassee because nothing gets done. She noted she will give her travel money to the Mayor to attend. Commissioner Grace motioned to approve the travel request for Mayor James' trip to New Delhi, India; seconded by Mayor James. The motion failed on the following 2-3 Roll Call vote: Commissioner Brandimarte No Vice-Mayor Harris No Commissioner Grace Yes Mayor James Yes Commissioner Salvino No 7.4 RESOLUTION#2018-005 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,REQUESTING ADVANCE APPROVAL FROM THE CITY COMMISSION OF THE CITY OF DANIA BEACH TO PROCEED WITH THE BID ADVERTISEMENT FOR THE PROJECT KNOWN AS THE PARKS & RECREATION DEPARTMENT TEN (10) YEAR MASTER PLAN PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-005. Mayor James wants to ensure that a Frost Park Community Center is included in the plan. Commissioner Grace motioned to adopt Resolution #2018-005, with the condition for a Community Center; seconded by Commissioner Brandimarte. Public Hearings and Site Plans Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. City Attorney Ansbro advised the remaining items, except Item 49.1, were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.1 ORDINANCE#2018-001 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00) FOR DEBRIS HAULING AND DISPOSAL SERVICES FROM BERGERON EMERGENCY SERVICES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from December 11,2017) City Attorney Ansbro read the title of Ordinance #2017-038, Resolution #2018-001 and Resolution#2018-002, as they involve the same property. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the rezoning, site plan, and plat requests. A new condition is being added to the Site Plan (revised resolution) for the 25t' unit. Staff recommends approval of the three items. Attorney Denis Mele, representing the applicant, presented a PowerPoint presentation which is attached to and incorporated into these minutes. They are installing a traffic circle at the intersection of SW 40 Avenue and SW 54 Court to address some of the speed and traffic concerns in the community. They already checked with Broward County and the circle can be built and will be approved. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. Mayor James opened the Public Hearings. Rosalind Hodges, 3920 SW 56 Street, spoke against the project, specifically the landscape. Megan Emery, 3839 SW 56 Street, spoke against the development. Colin Drummond, 3901 SW 56 Court, said he lives south of the development and has never received a notice for the meetings. He spoke against the development. Ronald Gossett, 3800 SW 56 Street, spoke against the project because it changes the character of his neighborhood. Susan Saver, 5551 SW 40 Avenue, spoke against the project. Dennis McGowan, 5551 SW 40 Avenue, spoke against the development. Robert Banks, 3831 SW 56 Street, spoke against the project. David Sorg, 3920 SW 56 Court, said he never received a notice for the meetings, and spoke against the development. Monica Sorg, 3920 SW 56 Court, spoke against the development. Lisa Stevens, 3860 SW 56 Court, questioned the accuracy of the traffic report, and does not like roundabouts. She does not agree with the project and said she never received a notice. Dennis Marrone, 3951 SW 56 Court, said he was never noticed for the meetings, and spoke against the development. Andi Palmer, 3930 SW 56 Street, questioned the accuracy of the traffic study. Christine Douglas, 4665 SW 38 Terrace, questioned if the entrance and exit could be rerouted to 441 and taken off of SW 40 Avenue. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Attorney Mele responded to the issues addressed in the comments. Joel Berry, for the developer, stated he believes they have addressed most of the residents' concerns and are trying to help as much as possible. Commissioner Salvino addressed his issues with the development, which included the delay in the original development, flex units going to only one developer, the townhome values, and the approach taken tonight. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. Vice-Mayor Harris agreed with Commissioner Salvino that the original 25 units permitted in 2015 have never begun. He questioned if the density of the project could be reduced. Attorney Mele noted the site plan was approved in 2015 and then they acquired the other properties and began talking to the City about developing the whole property. Ari Sklar, Architect for the project, prides himself in doing the best project possible for the location. He spoke highly of the developer for the project. Commissioner Grace motioned to adopt Ordinance #2017-038, on second reading; seconded by Commissioner Brandimarte. Steve Brown, Architect, reviewed the information provided in the agenda packet. Mayor James opened the Public Hearing. Eric Bigham, 3181 SW 44 Street, whose family used to own property to the north of this property, complained that the traffic is going to get worse with all the proposed development in the area. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Salvino motioned to adopt Resolution #2018-003; seconded by Vice-Mayor Harris. Discussion and Possible Action Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. 10.1 Special Designation of Code Fines for Branding - Mayor James Mayor James noted she asked the City Manager if code fines could be used for branding and marketing; Frost Park and City Hall sites will need an RFP or RFQ, and she would like to shift money. Assistant City Manager Donnelly responded $275,000 in revenue from code fines was designated in the current budget. This money would need to be replaced with other funds if it is used for branding. He noted the revenue from the fines is not uniform on a regular basis. Mayor James clarified that no study has been done to estimate the money needed for branding. Assistant City Manager Donnelly suggested we take it from contingency or reserves this year, and build it into the budget for future years. Commissioner Salvino noted he thought Redline volunteered their time to do this and another person said they would raise the funds for branding and marketing. Mayor James commented the rebranding is very expensive. Redline did a lot of work and did not charge the City. They are trying to compose a marketing council which would offset some of the funding needed. Commissioner Salvino questioned if the branding would need to go out to bid. Assistant City Manager Donnelly suggested an account could be set up for this year and it could be budgeted in future years. Mayor James said another suggestion would be to take it out of reserves. Commissioner Grace said it sets a bad example when we do things like this; we need to workshop this or take it out of contingency. Assistant City Manager Donnelly noted the Commission contingency is approximately$90,000. Mayor James said Redline will be at the next meeting, with numbers for the rebranding. She proposed we wait until the next meeting for a presentation, and then perhaps hold a workshop. 10.2 City Manager Recruitment Plan- Mayor James Mayor James noted she has been speaking to the City Manager about this for the past year. He is proposing to leave in June, but in her opinion that is too late. She does not want to go through a transition at budget time; she would rather it be sooner than later. This item has been on the agenda more than once and she wants to know the Commission's thoughts. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. Commissioner Grace does not feel it is right to discuss this when the City Manager is not here. There are a lot of positions that will need to be filled, including the Manager's. We are capable of filling the position before we get to the end of November. We can come up with a solution during workshops for when we start looking and what we are looking for. Commissioner Salvino agrees with Commissioner Grace that we should not have the discussion without him. He feels it is vital that the current City Manager be here for the next budget cycle. He is not opposed to hiring a second City Manager who can work in conjunction with the current City Manager during the transition until City Manager Baldwin leaves. Commissioner Brandimarte agrees we should not have this discussion without the City Manager being here. We should force the City Manager to stay during the transition of the new City Manager; we should get a contract with him until the transition is made and he leaves. She noted she does not believe he is staying until June, and questioned what we are going to do without a Manager. She added we should get a headhunter to begin the process. Mayor James proposed that the City Manager leave today and not be a consultant or part of this City. She has spoken to him on several occasions and this is not underhanded; he has knowledge of this. She added she has been very transparent with City Manager Baldwin. There are a lot of things we want to move forward and to work on for the next budget. She noted he can stay as a consultant, and he knew exactly what she was going to say tonight. Vice-Mayor Harris spoke to City Manager Baldwin last Friday and he thinks he is ready to leave. He suggested moving Public Services Director Kaine to the City Manager position, keeping City Manager Baldwin as a consultant and paying him out for the next three months. Commissioner Salvino noted we have no HR Department and the Parks & Recreation Director is leaving. We should hire these people and then move on to the City Manager. Commissioner Brandimarte noted the City Clerk is leaving also. Vice-Mayor Harris noted Public Services Director Kaine calls him back every time he calls, and he said he could handle both jobs at the same time. We could see how he does for the next couple months and if it does not work out, he could go back to Public Services. Then a recruiter would have to be hired, which costs a lot of money. The talent out there for managers for cities of our size is not that great. Mayor James noted we will have this discussion again on January 23rd. We need resumes of all persons who could be in the position in the interim so we are prepared to discuss the opportunities. Whether or not we decide to have City Manager Baldwin as a consultant during the transition, he said he will leave if one commissioner asks him to leave. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Grace Commissioner Grace said what happened in this room tonight did not set well with her. We should do what is correct and right, and we have to be about doing the business of the City of Dania Beach. Hopefully, we will be a team by the time she leaves in November. Commissioner Grace commented she was on the Commission when the Danes came to Dania Beach and Commissioner McElyea had a party for them, and when the City went to Denmark in 2004. She spoke of the County Delegations to Haiti and Jamaica, which she attended and paid her own way in order to represent our City. We have to think about some of the things that we say and do. She is going to represent the City of Dania Beach on every turn and on every dime of every promotional item she can think of to showcase the City, at the cost of the City. 11.3 Commissioner Salvino Commissioner Salvino had no comments. 11.4 Vice-Mayor Harris Vice-Mayor Harris noted he has a whole list of things that were not completed in the last year. Vice-Mayor Harris questioned if the COP program can take pictures of graffiti and send them to him. Captain Marks said yes. Vice-Mayor Harris asked about a Security Plan for the entrance to City Hall. Captain Marks said we are in the process of doing a CPTED assessment, which will provide suggestions to bring to the Commission. Vice-Mayor Harris addressed the microphones in the chamber and the AV system on the website; there are things we pay for that we do not need. Vice-Mayor Harris noted he is frustrated by the length of time it takes to get things done, such as the Class and Pay Study, the stop sign at NW 1st and Bryan Road, and the meeting room next door. 11.5 Mayor James Mayor James said she wanted to address a few things. It is important that people on the dais represent everyone who voted for them. We are not going to agree on everything, but we need to be respectful; there is a lot of disrespect up here. We are changing and we are changing fast. Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday,January 9,2018—7:00 p.m. Most of these new units being developed are not affordable for her or other people who live here; they are for people coming from elsewhere. We are living in a time where we need to be cultural. She noted she has traveled around the world, and asked that we all be respectful of each other and not have malice in our hearts. Mayor James asked how HR responsibilities are being spread out. Assistant City Manager Donnelly distributed memos to the Commission and explained what is happening. Mayor James questioned whether the HR Manager should be a Director; we have them in every other department. It was a suggestion brought to her and she thinks we should have one. Commissioner Grace commented we should have a person with those qualifications; it is an important job. Vice-Mayor Harris agrees with the Mayor; we need a trained professional to be the Director. Commissioner Salvino asked if a description of the difference between the positions could be brought to the Commission at the next meeting. Assistant City Manager Donnelly responded he will bring back a reorganization to the next meeting. Mayor James commented there are a lot of decisions that need to be made in the City and a lot of the positions are not filled and need to be filled. Mayor James noted she has been on a team her whole life, and we need to work as a team regardless of personal feelings. We are leaders of the community, and we need to be cautious and mindful of the way we are representing our City. 12. Appointments 12.1 Dania Beach Housing Authority Mayor James appointed Anna Hilliard for a 4-year term, if she qualifies. Discussion ensued regarding appointments to this board. Full scale drawings and power point explanation will be the best way to understand this plan. It appears that much of landscape removal is due to its proximity to hardscape of the project. There appears to be discrepancy in the charts as to which trees will be removed and which trees will remain. A detailed review is needed. I did attend the recent developer's meeting and have received an email of the landscaping plan. The information should be made available to all residents of this area that will be impacted. Consideration should be given to the environmental impact of landscape removal and the installation of significant hardscape in its place. Houston, Texas, is a prominent,recent example of the effects of over- development; it has been clearly stated that the loss of ground that could absorb water during a significant rain event was a great contributor to the flooding during the recent hurricane. I trust the commission will review and understand this landscape inventory and plan prior to a final approval of rezoning and plats. Thank you for your attention to this important matter. Division of Core Duties: • Worker's Compensation and General Liability Issues to include accident reporting-Lori Adams, City Attorney's Office • Payroll and benefits issues-Yeimy Guzman, Finance • Personnel file questions-Teresa Hines, City Clerk's Office • Employee issues and general questions-Colin Donnelly via Chris Lottier, City Manager's Office • Certificates of Insurance-Chris Lottier, City Manager's Office Assistance from key healthcare, consulting, and insurance vendors-The City's key health care and risk vendor are aware of the City's staffing issues and have agreed to provide enhanced service during the transition period. Consulting Contract-Kristin Milligan will be under temporary contract to assist in recruitment and general HR/risk issues. She will be working with staff at night and during weekends as needed. Recruitment Strategy-HR is looking to hire the Human Resource/Risk Manager first, then allow them to hire their staff. A first round of interviews are being scheduled. HR has candidate pools for the HR Assistant and HR Generalist positions. The Compensation and Classification Study will begin with a vendor kickoff meeting on January 12, 2018. HR staff is now compiling requested documents for the vendor. The Parks and Recreation Athletic Director position closed on 1/5/2018. Parks is reviewing the first batch of candidates. There is much interest in the position and there is a large candidate pool to review. Kristin Milligan was able to complete the American Care Act reporting and the Workmen's Compensation Insurance audit. These are two important regulatory reporting requirements.
