A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA AUTHORIZING THE CONVEYANCE OF SIX (6)
PARCELS OF CITY-OWNED LAND ("PROPERTY") WITHIN THE DANIA
BEACH COMMUNITY REDEVELOPMENT AREA AT A PRICE OF ONE
DOLLAR ($1.00) PER PARCEL TO THE DANIA BEACH COMMUNITY
REDEVELOPMENT AGENCY("CRA") FOR THE PURPOSE OF USING THE
PROPERTY TO FACILITATE SINGLE-FAMILY HOUSING
DEVELOPMENT IN THE COMMUNITY REDEVELOPMENT AREA;
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE DEEDS
AND RELATED DOCUMENTS FOR EACH PARCEL FOR THIS PURPOSE;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Florida Legislature enacted the Community Redevelopment Act of
1969, which is presently codified as Part III of Chapter 163, Florida Statutes, as amended from
time to time (the "Act"); and
WHEREAS, all powers arising through the Act are conferred by the Act upon counties
with Home Rule Charters, such as Broward County, Florida, which in turn are authorized to
delegate certain of their powers to a community redevelopment agency created pursuant to the
Act; and
WHEREAS, on March 19, 2002, the Board of County Commissioners of Broward
County, Florida (the "Board") adopted Resolution No. 2002-275, which declared that a slum or
blighted area exists in a geographic area(the "Redevelopment Area"), as described by the City of
Dania Beach in its Finding of Necessity for Redevelopment, and which demonstrated that it is
necessary and appropriate to redevelop such Redevelopment Area in accordance with the
provisions of the Act, as amended; and
WHEREAS, pursuant to the Resolution of Broward County, Florida, the Board
delegated to the City Commission of the City of Dania Beach, Florida (the "Commission") the
authority to exercise the redevelopment powers conferred upon the Board within the
Redevelopment Area in accordance with the Act, to enable the City Commission to declare the
need for, create and delegate power to a community redevelopment agency ("CRA") and to
prepare and adopt a plan of redevelopment for final approval by the Board; and
WHEREAS, the City Commission accepted a delegation of powers from the Board,
found a need for, and created the CRA, granted the CRA the power to exercise those powers
permitted by the Act which were delegated by the Board to the City and directed the preparation
and adoption of a community redevelopment plan (the "Plan"), updates to which have been
approved and adopted by the CRA Board on March 11, 2009 and June 3, 2015 respectively; and
WHEREAS, the redevelopment goals outlined in the updated Plan include (1) enhance
and reinforce the CRA sub areas; (2) eliminate substandard housing and provide affordable
housing alternatives; (3) redevelop the CRA in a manner that is energy efficient and sustainable;
(4) attract targeted new industries and retain and expand core industries; and (5) enhance
redevelopment activities through active marketing strategy that supports redevelopment
initiatives; and
WHEREAS, the City Commission is considerate of the needs of the CRA and the
Redevelopment Area and intends to support, foster or facilitate opportunities for the CRA to
accomplish the redevelopment goals outlined in the Plan; and
WHEREAS, at the January 9, 2018 CRA Board meeting, the CRA Board identified six
(6) vacant parcels (the "Property") in the Redevelopment Area which are owned by the City and
which the CRA Board, by motion and consensus, desires the City Commission to convey to the
CRA for the purpose of accomplishing the redevelopment goals outlined in the Plan; and
WHEREAS, the CRA believes that having site control of the City-owned properties will
facilitate identifying and securing private and public funding to develop viable projects while the
CRA has no available tax increment financing funds; and
WHEREAS, the desired City-owned Property is within the boundaries of the
Redevelopment Area, consisting of parcels located at (1) NW 2nd Street (Folio No. 5042-34-01-
0720); (2) NW 6ch Avenue (Folio No. 5042-34-01-0760); (3) NW 14 ' Avenue (Folio No. 5042-
33-01-0190); (4) NW 14th Avenue (Folio No. 5042-33-01-0060); (5) NW 10 Avenue (Folio.
No. 5042-33-01-0110); and (6) W. Dania Beach Boulevard (Folio. No. 5042-33-01-0130), which
are more fully described in Attachment "A", which is attached and incorporated by this reference
('Property"); and
WHEREAS, the Commission has identified that the Property can be used by the CRA as
a tool for housing development in the Redevelopment Area as all Property is zoned
Neighborhood Residential (NBHD-RES); and
WHEREAS, the Commission finds that pursuant to Section 125.38, Florida Statutes the
conveyance of the Property to the CRA serves the best interest of the City;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY DANIA BEACH, FLORIDA:
Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they
are made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission, pursuant to Section 125.38, Florida Statutes,
approves the conveyance of the Property, which is legally described in Attachment "A", to the
CRA at the price of one dollar($1.00)per parcel which is considered minimum consideration.
Section 3. That upon the conveyance of the Property, the CRA shall maintain the
property in accordance with all applicable laws,regulations, ordinances and codes.
Section 4. That pursuant to Section 125.411, Florida Statutes, the City Commission
authorizes the proper City officials to execute a Deed for each parcel, in substantially the form
approved by the City Attorney.
Section 5. That the proper City officials shall record in the County public records all
deeds and shall provide a copy of such recorded instruments to the Clerk of the City Commission
and CRA Board within thirty(30) days of execution and final acceptance.
Section 6. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 7. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
