RESOLUTION NO. 2018-013 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-118-17) SUBMITTED BY JOSEPH DENIS ON BEHALF OF DANIA LIVE 1748, LLC FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN BRYAN ROAD AND INTERSTATE 95 WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635 "Development Review Procedures and Requirements," and Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-40 "Development Design Guidelines (DDG)," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, LDC Article 340 "Planned Mixed-Use Development District (PMUD)," Section 340-30(S) "Site plan approval," provides that site development shall comply with the established PMUD regulations and the approved DDG; and WHEREAS, pursuant to Resolution No. 2016-160, the City of Dania Beach City Commission (the "City Commission") previously approved a Site Plan for portions of Dania Pointe Phase II, consisting of approximately 473,418 square feet of commercial buildings to be located at the northwest corner of Stirling Road and Bryan Road in the City of Dania Beach, Florida(the "City"); and WHEREAS, pursuant to Resolution No. 2017-155, the City Commission previously approved a Site Plan for portions of Dania Pointe Phase II, consisting of approximately 31,430 square feet of commercial buildings and 350 hotel rooms to be located at the northwest corner of Stirling Road and Bryan Road in the City; and WHEREAS, Joseph Denis, on behalf of Dania Live 1748, LLC (the "Applicant") is requesting Site Plan approval to permit the development of additional areas of Dania Pointe Phase II, consisting of two-hundred sixty four(264)residential dwelling units to be located at the northwest corner of Stirling Road and Bryan Road in the City, as legally described in Exhibit "A"• and WHEREAS, the Site Plan application (SP-118-17) has been reviewed for compliance with the approved Dania Pointe DDG in accordance with Article 635 and Article 340 of the LDC; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-118-17) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635 "Development Review Procedures and Requirements," and Article 340 "Planned Mixed-Use Development District(PMUD)," Section 340-40 "Development Design Guidelines (DDG), the Site Plan (SP-118-17), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. A detail sheet accompanying the Civil Plans with the following details: a. Fire Hydrant Detail b. Bollard/Impact Protection Detail for Hydrants, FDC's &DDCV's c. Roadway Pavement Marker(RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) d. Post Indicating Valve Detail (where applicable) e. Underground Gate Valve Detail (where applicable) f. Backflow Preventor/Double Detector Check Valve (DDCV) Detail (where applicable)that identifies the DDCV as being listed for Fire Use g. Signage Detail for the Fire Department Connections (where applicable)(BSO Fire). 2. Address Detail (BSO Fire). 3. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page (BSO Fire). 2 RESOLUTION#2018-013 4. Per the DDG and Sec. 275-60, a minimum of 50% of trees must be native species. This requirement is not being met. Provide a minimum of 50% native tree species (Landscape Consultant). 5. Although buffer trees are not required per the DDG, some buffer trees or palms should be installed on the west side of the parking garage to provide a breakup of the profile of the large structure (Landscape Consultant). 6. PLATTING: Provide copy of recorded plat note amendment prior to issuance of a building permit(Planning). 7. SCHOOLS: Obtain a letter from Broward County School Board regarding school impact fees (Planning). 8. SIGNS: Provide copy of all signs and details for compliance review or provide a note on the plans that signage will be submitted and reviewed separately(Planning). 9. ROOFTOP MECHANICAL EQUIPMENT: Must meet regulations in DDG, Section (G) entitled Service Structures and Uses (1)(ii). Identify how rooftop equipment will be screened from view of the public right-of-way and provide material details (Planning). 10. RAC TRAFFIC IMPACT MITIGATION: Kimley Horn analysis provided identifies 103 PM Peak hour trips will be generated by this development. Therefore, $2,189.78 ($21.2 X 103) must be paid prior to issuance of a building permit(Planning). 11. The applicant is encouraged to contact neighbors adjacent to, as well as condominiums and neighborhood associations to advise of this property. Please provide acknowledgement and/or documentation of any public outreach(Planning). 12. For any building 5-stories or greater, provide a shadow study identifying how adjacent properties will be affected (Planning). 13. Applicant must obtain statement from Ronnie Navarro, City Engineer, stating that adequate water supply exists for this project(Planning). 14. Sheet C-402 shows Building K. Clarify if Building K is included in this site plan review for"Residential A". If not, remove from drawing (Planning). 15. The following information is identified on Sheet C-402 entitled, "Residential A Site Plan" in the Site Date table but not shown on site plan drawing on same sheet. Provide missing information on site plan drawing or relabel sheet(Planning). • Building area • Impervious area • Pervious area • Building setbacks • Parking 3 RESOLUTION 42018-013 16. Sheet C-402 Development Breakdown, data provided does not match Entitlement Summary table provided in "Apartment Traffic Generation Statement". Revise accordingly (Planning). 17. The parking calculations provided on Sheet C-402 does not match the drawings provided on Sheets A3.01 — A3.06. For example, only 136 parking spaces + 2 ADA spaces are shown on Sheet A3.04; Sheet C-402 identified 141 parking spaces. I believe this is true for each level. Revise accordingly (Planning). 18. Sheet A3.01 — A3.06 shows turn arrows on levels 2- of the parking garage where access to the garage is provided on ground level. Revise accordingly (Planning). 19. Identify location of dumpster enclosure, per DDG, Section 5, (G) entitled Service Structures and Uses (2) identify enclosure/screen walls proposed to ensure compliance (Planning). Section 4. That such application must be reviewed by Broward County Aviation Department. That pursuant to Section 14 "Site Plan Submittals" of the Dania Pointe PMUD Design Development Guidelines, the Site Plan (SP-118-17) approval shall automatically expire and become null and void five (5) years from the effective date of this Resolution unless the Applicant files a complete building permit application and secures approval of building permits for the improvements shown on the Site Plan within the five (5) year time frame, unless an extension is granted by the City Commission. Section 6. That issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 4 RESOLUTION#2018-013 Section 8.
