A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA,APPROVING THE"STIRLING HILLS"PLAT(PL-030-17)
SUBMITTED BY PULICE LAND SURVEYORS, INC., ON BEHALF OF
SUNSHINE REO XI,LLC AND CF&A HILL FAMILY,LTD,FOR PROPERTY
GENERALLY LOCATED NORTH OF STIRLING ROAD, SOUTH OF SW 1ST
STREET, EAST OF SW 11TH AVENUE AND WEST OF PHIPPEN ROAD IN
THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN
EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;
PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS,pursuant to Chapter 28 of the Code of Ordinances of the City of Dania Beach
(the "Code"), which chapter contains the City Land Development Code (the "LDC"), pursuant to
Part 6, "Development Review Procedures and Requirements", Article 640 "Plats", it is stated that
since June 4, 1953,no principal building may be constructed on any lot unless a plat including the lot
has been approved by both the City Commission and Broward County Commission,and recorded in
the official records of Broward County; and
WHEREAS,Pulice Land Surveyors,Inc.,on behalf of Sunshine REO XI,LLC and CF&A
Hill Family,LTD(the"Applicants"),are requesting plat approval(PL-030-17),for property legally
described in attached Exhibit"A",which is made a part of and is incorporated into this Resolution
by this reference; and
WHEREAS, the "Stirling Hills" Plat (PL-030-17), is restricted to 127,000 square feet of
self-storage use; and
WHEREAS,on March 27,2017,the City's Development Review Committee(the"DRC"),
which includes representatives from the Broward Sheriff's Office,Broward Fire Department,Public
Services Department,the City's landscape consultant and the Planning Division staff,reviewed the
plat for compliance with all applicable regulations; and
WHEREAS, staff recommends approval of the plat for the future development of self-
storage use; and
WHEREAS, the City Commission conducted a duly noticed public hearing in accordance
with Article 640 of the LDC; and
WHEREAS,the City Commission finds that the approval of the proposed plat will protect
the public health, safety and welfare of residents of the City, and furthers the purposes, goals,
objectives and policies of the City's Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being
true and correct, and they are made a specific part of this Resolution.
Section 2. That the application for the"Stirling Hills"Plat (PL-030-17),a copy of which
is attached as composite Exhibit`B",which is made a part of and incorporated into this Resolution
by this reference, is approved.
Section 3. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and
does not create any liability on the part of the municipality for issuance of the permit if the Applicant
fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal
agency, or undertakes actions that result in a violation of state or federal law.
Section 4. That such application must be reviewed by the Broward County Aviation
Department;the point of contact is William Castillo,Airport Planner located at 220 S.W.45 Street,
Suite 101, Dania Beach, Florida, 33312, (954) 359-6100.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.

passage and adoption.
