RESOLUTION NO. 2018-015 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-114-17), EXCEPTIONS FROM DESIGN STANDARDS (OT-141-17, OT-142-17), SIGN VARIANCES (VA-133-17, VA-134-17, VA-135-17), VARIANCES (VA-136- 17, VA-137-17, VA-138-17, VA-139-17, VA-140-17), AND SPECIAL EXCEPTION (SE-113-17) SUBMITTED BY CF & A HILL FAMILY LTD, SUNSHINE REO XI LLC, AND JSRJ INC. FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN 12Tx AVENUE AND PHIPPEN WAITERS ROAD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements", Article 635, entitled "Site Plans", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, CF & A HILL FAMILY LTD, SUNSHINE REO XI LLC, and JSRJ INC. (collectively the "Applicants") are requesting Site Plan (SP-114-17) approval to permit the development of a 21,998 square foot free-standing grocery store ("Grocery Store") and a 9,750 square foot multi-tenant commercial building with drive-thru on the western end of that building ("Commercial Building") on Parcel 1 of the Property and a 124,950 square foot self-storage facility ("Storage Facility") on Parcel 2 of the Property in the project referred to as Stirling Square located on the north side of Stirling Road between SW 12t' Avenue and Phippen Waiters Road in the City of Dania Beach, Florida, (the "City"), as legally described in Exhibit"A"; and WHEREAS, Chapter 28, Part 5 of the LDC, Article 510, entitled "Principal Arterial Commercial Standards", Section 510-20(C) provides that the City Commission may approve exceptions to this Article as conditions to a Site Plan approval upon the following findings: (1) there are circumstances peculiar to the site or the intended use that makes compliance with a particular requirement of this article impracticable; and (2) the Applicant has offered significant enhancements to other pertinent aspects of the site that the City Commission determines will offset any negative impact that an exception to these standards might otherwise create; and WHEREAS, the Applicant has requested an exception from the provisions of Section 510-30(D) of the LDC, to provide a flat roof for the Grocery Store and Commercial Building with canopy at the Grocery Store entrance feature instead of a pitched roof with a generous overhang as required by the LDC (OT-141-17); and WHEREAS, the Applicant has requested an exception from the provisions of Section 510-30(E) of the LDC,to allow the Applicant to use opaque surfaces at ground level visible from the sidewalk for the Grocery Store where the LDC prohibits such opaque surfaces (OT-141-17); and WHEREAS, the Applicant has requested an exception from the provisions of Section 510-30(H) of the LDC, to allow the Applicant to utilize 4.6% of glass windows and doors for the primary elevation of the Grocery Store where the LDC requires 35% and also allow the Applicant to utilize 8% of glass windows and doors for the secondary elevation of the Grocery Store where the LDC requires 15% (OT-141-17); and WHEREAS, the Applicant has requested an exception from the provisions of Section 510-30(I) of the LDC, to permit the Applicant to utilize four (4) colors for the Commercial Building and seven (7) colors on the Grocery Store instead of a maximum of three (3) colors as required by the LDC (OT-141-17); and WHEREAS, the Applicant has requested an exception from the provisions of Section 510-30(K) of the LDC, to allow the Applicant to provide additional landscape materials on Parcel 1 to conceal the doors on the east elevation of the Grocery Store where the LDC prohibits work area or storage doors and open bays to open towards or otherwise be visible from a principal road(OT-141-17); and WHEREAS, Chapter 28, Part 5 of the LDC, Article 511, entitled "Industrial Design Standards", Section 511-20 "Applicability", states that the City may approve exceptions to the guidelines as part of a site plan application; and WHEREAS, the Applicant has requested an exception from the provisions of Section 511-30(J) of the LDC, to allow five (5) colors on the Storage Facility instead of a maximum of three (3) colors as required by the LDC (OT-142-17); and WHEREAS, Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations", Article 505 "Sign Regulations", Section 505-180 "Relief from Requirements, Sign Variances", states that the City Commission may grant sign variances based upon a determination that the 2 RESOLUTION#2018-015 petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested the following wall sign variances for the Storage Facility located on Parcel 2 : (i) a variance to permit five (5) wall signs where Section 505-120(0) of the LDC permits a maximum of two (2) wall signs, (ii) a variance of 39.3 square feet to allow a total sign area of 156.8 square feet on the east elevation including 101.3 square feet (Sign Type #1), 53.2 square feet (Sign Type #2) and 2.3 square feet (Sign Type #3) where Section 505-120(0)(2) of the LDC permits a maximum of 117.5 square feet of wall sign area, (iii) a variance of nine inches (9") to allow thirty-three inch (33") high letters on a wall sign under 75 square feet on the east elevation where Section 505-120(0)(6) of the LDC permits a maximum of twenty-four inch (24") high letters on wall signs under 75 square feet, (iv) a variance of 72.75 square feet to allow a total wall sign area of 154.5 square feet including 101.3 square feet (Sign Type #1) and 53.2 square feet (Sign Type 42) where Section 505-120(0)(2) of the LDC permits a maximum total of 81.75 square feet of wall sign area on the south elevation, and (v) a variance of nine inches (9") to allow thirty-three inch (33") high letters on a wall sign under 75 square feet where Section 505-120(0)(6) of the LDC permits a maximum of twenty- four inch(24")high letters on wall signs under 75 square feet(VA-133-17); and WHEREAS, the Applicant has requested the following monument sign variance for the Storage Facility located on Parcel 2: a variance of six (6) square feet to allow a forty-eight (48) square foot monument sign, where Section 505-120 (L) of the LDC permits a maximum of forty- two (42) square feet(VA-134-17); and WHEREAS, the Applicant has requested the following monument sign variances for the Grocery Store and Commercial Building located on Parcel 1: (i) a variance to allow up to seven (7) establishments to be identified on a multi-tenant sign, where Section 505-40(K)(4)(b) of the LDC permits a maximum of up to six (6) establishments to be identified on each sign, (ii) Section 505-40(K)(4)(c) of the LDC requires that the name of the development be displayed at the top of the sign with minimum letter height of ten inches (10") and the Applicant is requesting to not include the development name on the sign despite that not all establishments are included on the sign, and (iii) Section 505-110(M)(1) of the LDC allows shopping centers with at least 500 feet of street frontage one (1) monument or entrance feature sign not to exceed sixty-four (64) square feet in area and eight (8) feet in height, or two (2) signs with an equivalent combined 3 RESOLUTION#2018-015 area and the Applicant is requesting two (2)monument signs with a combined area of eighty (80) square feet (a variance of sixteen (16) square feet) and the Applicant is requesting that the multi- tenant identification sign be ten (10) feet in height (a variance of two (2) feet) and the Grocery Store sign be nine (9) feet in height (a variance of one (1) foot) (VA-135-17); and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances", Section 625-40, entitled "Variance Review Criteria; City Action", states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested the following front yard and interior side lot setback variances for the Storage Facility located on Parcel 2: (i) a 3.41 foot front yard setback variance (north) to permit a front yard setback of 31.59 feet, where Section 205-10 of the LDC requires a minimum front yard setback of 35 feet, and (ii) a 10.28 foot interior side yard setback variance (west) to permit an interior side yard setback of 14.72 feet, where Section 205-10 of the LDC requires a minimum interior side yard setback of 25 feet(VA-136-17) ; and WHEREAS, the Applicant has requested a variance of twenty-three (23) feet to permit a building height of fifty-eight (58) feet for the Storage Facility, where Section 205-10(D) of the LDC permits a maximum building height of 35 feet(VA-137-17); and WHEREAS,the Applicant has requested a street landscaping variance on Parcel I where Section 307-20(A) of the LDC requires the installation of street trees of the species and at the spacing intervals required pursuant to resolution of the City Commission for the particular street. In the absence of a resolution passed by the City Commission, as is the case for the subject Property, the default requirement is Royal Palms on trafficways spaced twenty (20) feet on center, and Sabal Palms spaced fifteen (15) feet on center along all other streets. The Applicant is requesting a variance to group three (3) Coconut Palms (not Royal Palms) spaced fifty feet (50') on center along the Stirling Road trafficway, along with tiered shrubs, ground covers, a hedge, and accent shrubs (VA-138-17); and WHEREAS,the Applicant has requested a perimeter buffer landscape variance on Parcel 1 to allow a 3.57 foot encroachment into the required perimeter landscape buffer for the proposed new bus shelter's concrete pad, where Section 275-120 of the LDC requires a minimum ten foot(10') landscape buffer around the perimeter of all properties located within the C-3 zoning district(VA-139-17); and 4 RESOLUTION#2018-015 WHEREAS, the Applicant has requested a parking variance of fifty-five (55) parking spaces for the Storage Facility located on Parcel 2 to permit eighteen (18) parking spaces (including one (1) ADA space), where Section 265-50 of the LDC (parking ratio of 1 space per 2,000 square feet of self-storage or warehouse use) requires a minimum sixty-three (63) parking spaces (VA-140-17); and WHEREAS, Chapter 28, Part 6 of the LDC, Article 630, "Special Exception Uses," provides that the City Commission may grant a Special Exception based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, pursuant to Section 110-20 of the LDC, the Applicant has requested a Special Exception (SE-113-17) to permit a drive-through service on the western end of the Commercial Building located on Parcel 1 within the C-3 zoning district; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 114-17), Exceptions to Design Standards (OT-141-17and OT-142-17), Sign Variances (VA-133- 17, VA-134-17 and VA-135-17), Variances (VA-136-17, VA-137-17, VA-138-17, VA-139-17, and VA-140-17), and Special Exception (SE-113-17), will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan(SP-114-17), attached as Exhibit`B" which is made a part of and incorporated into this Resolution by reference is approved. 5 RESOLUTION#2018-015 Section 3. That pursuant to Chapter 28, Part 5 of the LDC, entitled "Principal Arterial Commercial Standards" the requested Exceptions to Design Standards (OT-141-17) are approved consistent with the Site Plan provided in Exhibit`B". Section 4. That pursuant to Chapter 28, Part 5 of the LDC, entitled"Industrial Design Standards," the requested Exception to Design Standards (OT-142-17) is approved consistent with the Site Plan provided in Exhibit`B". Section 5. That pursuant to Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations", Article 505 "Sign Regulations", Section 505-180 "Relief from Requirements, Sign Variances", the requested sign variances (VA-133-17, VA-134-17 and VA- 135-17) are approved consistent with the Site Plan provided in Exhibit"B". Section 6. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-136-17, VA-137-17, VA-138-17, VA-139-17, VA-140-17) are approved consistent with the Site Plan provided in Exhibit`B". Section 7. That pursuant to Chapter 28, Part 6 of the LDC, Article 630, "Special Exception Uses", the Special Exception (SE-113-17) is approved consistent with the Site Plan provided in Exhibit`B". Section 8. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Sheets SP-11 and SP-12: Elevation of FPL Transformer Pads not indicated. Mechanical equipment shall be installed at or above Design Flood Elevation (Base Flood Elevation+ 1 Foot) (Flood Review). 2. Survey, Note 3: Please revise note to indicate that property is within Flood Zones AE 6 and AH6 (Flood Review). 3. Provide the canopy (in SF) to be mitigated for the removal on exotic species on sheet L-2 (Landscape). 4. Show on sheet L-1 all trees located within and adjacent to the site (Show exotic species' locations. If individual stems cannot be delineated, an area representation is acceptable with estimated stem count)(Landscape). 5. Proposed offsite relocations must be approved by FDOT. Provide documentation of approval for these relocations (Landscape). 6 RESOLUTION#2018-015 6. One specimen live oak is proposed for removal (tree #107). Provide justification on why this tree is not a candidate for relocation or retention(Landscape). 7. Identify via special symbol or callout the 16 Category 1 terminal island trees located outside the terminal islands. One Category 1 tree per terminal island is acceptable pending alternative location approval (Landscape). 8. Provide a clarification on sheet L-4 that the finished grade of all landscape areas within and adjacent to VUA will be at or below the final VUA grade per Sec. 275-190(N) (Landscape). 9. Root barrier detail and description is provided; however root barrier locations are not clearly visible on sheet L-3. Show all areas where root barriers are to be installed meeting Sec. 275-190 requirements (Landscape). 10. Provide an irrigation plan meeting all Sec. 275-80 requirements (Landscape). 11. A PDF copy of the plans must accompany each subsequent submittal in order to receive comments (Landscape). 12. Provide estimate of pm peak hour trip, based on the latest ITE Manual (9th or loth editions only). Traffic Impact Study shall be based latest editions of the following: Transportation Impact Analyses for Site Development: An ITE Recommended Practice, 2010; the 2014 FDOT Transportation Site Impact Handbook; 2013 FDOT Quality/Level of Service Handbook; the 2014 Broward County Comprehensive Plan — Transportation Element; the City of Dania Beach Land Development Code and other related published literatures (Engineering). 13. Provide stormwater management calculations (signed and sealed by a registered professional engineer) for the on-site drainage system. The calculations shall show how the minimum road crown and finished floor elevations are met, and how the 25-year, 3- day storm event is maintained on site with zero discharge to the ROW and adjacent properties. The site must store at least the 25-year, 3-day event onsite with NO EXCEPTIONS (Engineering). 14. Provide a copy of pre- and post-development stormwater management and drainage calculations. The City specifically needs the following information: 10-year, 25-year, and 100-year, 24-hour and 72-hour flood stage elevations (Engineering). 15. Proposed grading and drainage plan shall be based on the stormwater management calculations (Engineering). 16. Indicate current FEMA base flood elevation (BFE). Finished floor elevation (FFE) shall be one (1) foot above BFE (Engineering). 7 RESOLUTION#2018-015 17. French Drain appears to be proposed between drainage structures, provide calculations and geotechnical information supporting the proposed design. Include the design criteria and calculations for the proposed drainage well (Engineering). 18. Driveway aprons and swales must be graded such that rainwater is contained within the property line and not the City ROW (Engineering). 19. Provide typical cross-sections and section profiles along all property lines, and show how the existing and proposed grades will tie to one another. Also, show spot elevations and the perimeter(property lines) on the paving and grading plan (Engineering). 20. Add signage to the road marking plan(Engineering). 21. Provide location of building roof drains, and their proposed connections(s) to the on-site drainage system(Engineering). 22. Provide vehicle swept path analysis (AutoTURN or Vehicle Tracking) based on freight container design vehicle anticipated for this development especially at proposed ingress/egress locations (Engineering). 23. Show sight distance analysis using FDOT Index No. 546 at proposed driveways (Engineering). 24. Provide site triangles for entrance(s) and exit(s) (Engineering). 25. If pedestrian lighting is proposed, discuss the possibility of the addition of ped lighting along the City ROW(Engineering). 26. Any road cuts for utilities or curb cuts with the City ROW shall be restored to full lane width for 50' minimum length centered on the proposed cut (Engineering). 27. Provide a proposed "Staging Plan" including employee parking, material storage, etc (Engineering). 28. Provide Fire Department conceptual approval (Engineering). 29. Backflow preventers will not encroach on sidewalks (Engineering). 30. Meet with Public Services, separately, to discuss water and sewer connections. Request meeting through the City Engineer(Engineering). 31. Per Dania Code of Ordinances (Article 415 — Sidewalks and Swales), Owner is responsible for sidewalks and swale improvements within the road ROW(Engineering). 8 RESOLUTION#2018-015 32. In compliance with 805 of the City Code of Ordinances, applicant shall provide projected water demand, and sewage and solid waste generation amounts in tabular format on the civil site plan(Engineering). 33. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 34. Per Sec. 635-40 (D), provide a draft of any required or proposed restrictive covenants, written sureties, and common area maintenance association documents, including those for the preservation of common open space areas; grants of easement for access, drainage, utilities or other purpose; or other restrictions to be imposed upon the use of the land and buildings (Planning). 35. Per Sec. 635-40 (C) provide the recorded plat for the 2 southernmost folios and any agreements modifying the plat (example: amendment to the restrictive note or non- vehicular access line (NVAL)), if the property has been platted(Planning). 36. The proposed plat for the parcel to the northwest (parcel 2) restricts the site the 100,000 SF of self-storage use. Per sheet SP-02, 125,000 SF are proposed. Revise plans and applications accordingly (Planning). 37. Provide letter from Broward County identifying whether this property needs to be platted or replatted. *NOTE: Because the platting determination process is lengthy, applicants are encouraged to request their letter of determination from Broward County as soon as possible (Planning). 38. Provide recorded plat documents for entire site prior to issuance of a building permit (Planning). 39. On site data table, separate all calculations by building instead of parcels (Planning). 40. Provide a shadow study identifying how adjacent properties will be affected by self- storage building (Planning). 41. Photometric plans indicate different phases for the development. Per Sec. 635-50 (AA) provide a phasing plan with beginning and ending dates of construction of the entire project, and beginning and ending dates for all phases of the project(Planning). 42. Provide a separate square footage for each of the following proposed uses on plans: grocery store, retail, restaurant, self-storage (Planning). 43. Per Sec. 115-50 (2) the architectural treatment of a self-storage facility in the IG zoning district shall resemble that of an office building, particularly in those portions of the building(s) facing public rights-of-way and adjoining residential areas. This may include use of substantial construction materials (ex: stucco or stone over concrete for exterior 9 RESOLUTION#2018-015 building walls), pedestrian scale architectural treatment, significant use of window and door glass, landscaping directly adjacent to a building, and overhead doors and loading activities to be located to the rear of buildings, within interior areas between buildings, or within interior side yards. Revise elevations accordingly. Provide a reference on site plan to each of the buildings shown on the elevations (Planning). 44. Per Sec. 815-20, complete streets in accordance with the CRA Redevelopment Plan, are required along Phippen Road and SW 1 Street. Revise plans accordingly (Planning). 45. Per Sec. 309-10 (C), the construction of on-street parking, sidewalks and street furniture is required along Phippen Waiters Rd. and SW 1 Street. See Figure CE-4 of the CRA Plan (attached) for the approved design of the Phippen right-of-way, and Figure CE-3 (attached) for SW 1 Street. Revise plans accordingly and indicate which of the 3 following options will be pursued by the developer,per Sec. 309-10 (C): 1. Construct the sidewalk and on-street parking, and provide and install street furniture (including, but not limited to, benches, transit shelters, street lights, waste bins, and bike racks or lockers) for the street frontage abutting the property line of the development site, pursuant to the specifications approved by the city commission in the CRA redevelopment plan; or 2. Provide for construction of these street improvements through private agreement with one (1) or more adjacent developers along the abutting right-of-way, by which one (1) or more developers construct and install the street improvements along the right-of-way and are reimbursed by the adjacent developers in proportion to their respective shares of right-of-way abutting each developer's parcel; or 3. Make payment in lieu of the construction of the improvements pursuant to subsection (D), at the city's option. For each development which is required to comply with this section, the community development director, in coordination with the public services director, shall review the proposed development plan and location, and determine whether the developer shall be recommended to comply with this section through construction of the required street improvements or through payment to the city in lieu of construction in accordance with Sec. 309-10 (D) of the LDC. Applicant to provide cost estimate for city to confirm value of payment in lieu(Planning). 46. RIGHT-OF-WAY: Identify if R-O-W dedication is required along Stirling Road. See City Engineer for additional comment. Provide copy of recorded dedication prior to issuance of permit(Planning). 47. Per Sec. 215-130, the impervious area of the commercial parcel (Parcel 1), may not exceed 75% of the lot area. Revise calculations accordingly (Planning). 48. Identify projected water demand for the project(Planning). 49. Provide the signage calculation table for the entire site on one sheet. Identify the cumulative sign area permitted and total sign area used (Planning). 10 RESOLUTION#2018-015 50. Provide bike racks per the requirements listed in Sec. 265-51. Identify location on site plan; provide detail of bike racks and the number of required/provided in data table. (Planning). 51. Per Sec. 270-20, provide off-street loading spaces and applicable screening in accordance with Article 270. Identify location of loading spaces and include calculation in site data table (Planning). 52. The proximity to the airport will be required FAA/BCAD review and approval. Per the traffic study provided by Traf Tech, 179 PM peak hour trips will be generating. Based on resolution No. 2014-049 which established a rate of$21.26 per p.m. peak hour trip $3,805.54 (179 X 21.26) is due prior to issuance of a building permit(Planning). 54. Identify dimension overhang at Aldi entrance (Planning). 55. Provide property survey with new lot lines after ROW dedication and with new 7' sidewalks dedication of easement needed for sidewalks (Planning). 56. Provide recorded bus shelter dedication for new location prior to issuance of a building permit(Planning). 57. Provide bus shelter provide detail on plans (Planning). 58. Identify on site plan location of cart storage for Aldi (Planning). 59. Add glass window to north building elevation of storage building facing NW 1 Street (Planning). 60. Per Section 635-50, the following information is missing, C, I, J, S, T, & U. Provide missing information on plans (Planning). 61. Provide copy of recorded unity of control agreement, as well as all easements, covenants, & restrictions on the property prior to issuance of a building permit. The City Attorney must review and approve before all documents prior to recordation(Planning). 62. Per Section 505-40(K)(3) Internally illuminated cabinet signs must be constructed of an opaque sign face with translucent cut-outs for sign copy, such that only the sign copy itself is illuminated, and the background is not illuminated (Planning). 11 RESOLUTION#2018-015 63. Identify the location of the third monument sign on overall site plan, Sheet SP-02 (Planning). 65.
