Dania Beach Blvd. RESOLUTION NO. 2018-018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-100-17) AS SUBMITTED BY GREENBERG TRAURIG P.A., REPRESENTING THE APPLICANT, ATLANTIC PACIFIC COMMUNITIES, LLC, FOR THE DEVELOPMENT OF THE PROPERTY LOCATED AT 705-815 WEST DANIA BEACH BOULEVARD AND 1105-1165 WEST DANIA BEACH BOULEVARD, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS,Greenberg Traurig P.A.,representing Atlantic Pacific Communities,LLC(the "Applicant")is requesting Site Plan approval to permit the construction of a proposed one hundred seventy-two (172) unit multi-family, affordable and elderly housing residential development (SP- 100-17)as referenced in Exhibit`B,"for property located at 705-815 West Dania Beach Boulevard and 1105-1165 West Dania Beach Boulevard in the City of Dania Beach, Florida (the "City"), as legally described in Exhibit "A", both Exhibits are made a part of and incorporated into this Resolution by this reference;and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP-100- 17) is consistent with the City's Land Development Code and Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plan,"the Site Plan(SP-100-17),attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Provide copy of recorded plat and plat note amendment prior to issuance of a building permit. (PLANNING) 2. Dedicate the roadway easement located on the west side of Saratoga Crossing West site as right-of-way. Provide recorded dedication prior to issuance of a building permit. (PLANNING) 3. Provide revised open space and pervious area calculations for Saratoga Crossing West. (PLANNING). 4. Provide revised pervious area calculations after dedication. Section 303-90(G) requires a minimum of 37%pervious area. (PLANNING) 5. Per the traffic study provided by Traf Tech, Inc., dated October 2017, 28 net new PM peak hour trips will be generating. Based on resolution No. 2014-049 which established a rate of $21.26 per p.m. peak hour trip (28 X 21.26 = 595.28), therefore $595.28 is due prior to issuance of a building permit(Planning). 6. On Sheet L-200, provide a list of which trees (quantity and species) are proposed to be installed to meet the mitigation requirements in the"plant schedule"table. (LANDSCAPE) 7. On Sheets L-200 and L-300, provide a special symbol or callout to indicate the location of trees proposed to be installed to meet mitigation requirements.Note that trees used to meet the minimum site requirements (buffers, NVOS, peninsulas etc.) may not be counted as mitigation trees. (LANDSCAPE) 8. Please provide a detail sheet accompanying the Civil Plans with the following details(FIRE): a. Bollard/Impact Protection Detail for Hydrants, FDC's &DDCV's. b. Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers). c. Signage Detail for the Fire Department Connections (where applicable). 9. Provide address Detail. (FIRE) 10. Provide an egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. (FIRE) 2 RESOLUTION#2018-018 Section 4. That such application must be reviewed by Broward County Aviation Department. Pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan (SP-100-17) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. PASSED AND ADOPTED on January 23, 2018.
