Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals There were no presentations at this meeting. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Rich Aube, 675 SE 2nd Avenue, spoke favorably of the MLK parade and events. He also spoke of Lions Club activities and the South Broward Learning Center. Gaetan Bernier, 120 SW 7t' Avenue, questioned if he would have a right of way once the Hill property is rezoned. Marc LaFerrier, Director of Community Development, will speak with Mr. Bernier. Henry Graham, 2525 Raleigh Street, Hollywood, thanked the Commission for their involvement in the MLK events. His organization offers work skills training to people in Hollywood and they would like to involve more people from Dania Beach, but that would require funding. Vivek Golikeri, 301 SE 3rd Street, proposed a code of ethics for outdoor DJ's, entertainers and performers. Georgette Lasley, 5220 Wiley Street, Hollywood, spoke of an upcoming event called Juneteenth on June 16, 2018. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke of a drug arrest and other criminal activity. He noted Shred-a-thon and Operation Medicine Cabinet will be at Bass Pro Shop on March 31Sc Sean Brown, Battalion Chief, BSO Fire Rescue, was available to answer questions. 7. The motion carried unanimously. 7.3 RESOLUTION#2018-008 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO APPROVE CHANGE ORDER NO. 5 IN THE AMOUNT OF NINETEEN THOUSAND FIFTY SEVEN DOLLARS AND FIFTY CENTS ($19,057.50) TO MBR CONSTRUCTION INC. FOR THE DANIA BEACH OCEAN PARK REVITALIZATION-PHASE I CONSTRUCTION PROJECT;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-008. Commissioner Salvino questioned where the gates were being installed. City Manager Baldwin explained they are necessary at the crossovers due to beach erosion. Commissioner Grace motioned to adopt Resolution #2018-008; seconded by Commissioner Salvino. The motion carried unanimously. 7.5 RESOLUTION#2018-010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO PURCHASE SERVICES FROM DECOTA CONSTRUCTION IN THE AMOUNT OF THIRTY-NINE THOUSAND EIGHT HUNDRED DOLLARS ($39,800.00) FOR THE DEMOLITION OF PROPERTY LOCATED AT 242 SW 7TH STREET WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, FOR A PROJECT THAT WILL EXCEED THE ANNUAL VENDOR THRESHOLD OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00) Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,January 23,2018—7:00 p.m. FOR A SINGLE VENDOR IN A FISCAL YEAR; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-010. Commissioner Salvino questioned the closeness of the bids and noted the company selected has run behind on several projects for the City. He questioned if this was the best choice. City Manager Baldwin responded staff tends to recommend the low bidder and this is a demolition project. Commissioner Grace motioned to adopt Resolution #2018-010; seconded by Commissioner Brandimarte. The motion carried on the following 4-1 vote: Commissioner Brandimarte Yes Vice-Mayor Harris Yes Commissioner Grace Yes Mayor James Yes Commissioner Salvino No 7.6 RESOLUTION#2018-011 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE CONVEYANCE OF SIX (6) PARCELS OF CITY-OWNED LAND ("PROPERTY") WITHIN THE DANIA BEACH COMMUNITY REDEVELOPMENT AREA AT A PRICE OF ONE DOLLAR ($1.00) PER PARCEL TO THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY ("CRA") FOR THE PURPOSE OF USING THE PROPERTY TO FACILITATE SINGLE-FAMILY HOUSING DEVELOPMENT IN THE COMMUNITY REDEVELOPMENT AREA; AUTHORIZING THE PROPER CITY OFFICIAL TO EXECUTE A DEED FOR EACH PARCEL FOR THIS PURPOSE; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE DEEDS AND RELATED DOCUMENTS; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-011. Mayor James noted the resolution does not state that the remaining properties would not be declared surplus. Also, we do not want to restrict the CRA to single-family homes, and she questioned who wrote the resolution. Commissioner Brandimarte noted this is also a pilot program to see where they go with it; the developments need to be affordable and of good quality. Commissioner Grace said it was clear we want quality family homes. She is comfortable we will build something affordable for the neighborhoods. Commissioner Grace motioned to adopt Resolution #2018-011; seconded by Commissioner Salvino. The motion carried unanimously. 8. Jim Brady, representing the applicant, noted this will be a great change in the area. Mayor James opened the Public Hearing. Daniel & Tina Longman, 4470 Ravenswood Road, spoke in favor of the text change. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. (FIRST READING) Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,January 23,2018—7:00 p.m. City Attorney Ansbro read the title of Ordinance #2018-005, and noted staff is requesting a continuance until the February 13, 2018 City Commission meeting. Mayor James opened the Public Hearing. Bryan Grossman, 315 N. Federal Highway, requested clarification should the ordinance be adopted that automobile uses will not be nullified. He stressed, as the owner of 4300 Ravenswood Boulevard, while he was trying to sell the property, the highest demand was for vehicular related uses. Corinne Lajoie, Planning & Zoning Manager, clarified their intent is not to undo what was just approved; they are not looking at the regulations in the IROM-AA at this point. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Grace motioned to continue Ordinance#2018-005, on first reading, until the February 13, 2018 City Commission meeting at 7:00 p.m.; seconded by Commissioner Salvino. A, questioned the difference between what is proposed and what was built on East Dania Beach Boulevard. Commissioner Salvino responded we need more places for people to live while they work in Dania Beach. She noted the following condition has been added to the site plan resolution: All vehicular egress from the site onto SW lst Street shall be restricted to outbound left turn only. Mayor James opened the Public Hearings. Albert Jones, 722 SW P Street, questioned if we were setting a precedent with all the variances requested. He is in favor of the project. Dennis Mele, representing the applicant, noted that allowing a variance on one site does not mean it would be allowed on another site. Mayor James wants to be sure that all the exceptions will conform with the neighborhood. Mr. Jones questioned if there was any shared parking. Mr. Mele responded the only reduction in parking is for the self-storage; the code is set up for working warehouse,not for this type of use. Marissa Neufeld, Greenberg Traurig, P.A., representing the applicant, noted she has 33 letters of support from residents, and a letter of support from St. Ruth Missionary Baptist Church, which she will submit to the clerk for the record. Mayor James opened the Public Hearings. Nefertia Jones, 1155 W Dania Beach Boulevard, Apt. B, did not want to speak. Cecilia Brown, representing Jennifer, 725 Dania Beach Boulevard, Apt. B, spoke in support of the project. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,January 23,2018—7:00 p.m. Tamora Brown, 1125 W Dania Beach Boulevard, Apt. C, spoke in favor of the development, but questioned why the community is not advised of job opportunities with all the development in the City. Mayor James noted the information is out there; the community has to get more engaged. Commissioner Grace addressed Ms. Brown's concern. The only thing she objects to is using taxpayer dollars to help build the development. Mayor James said it is not the City's responsibility to give money to HUD, this is a loan; it is not our property. Commissioner Brandimarte requested clarification in that tonight's hearings are not for funding. City Attorney Ansbro confirmed tonight is not about funding. Commissioner Brandimarte said they better come up with the funding because she will not approve it. Sharon Higgs, 1115 W Dania Beach Boulevard, Unit C, spoke in favor of the development, and thanked Anne Castro for trying. Nicole Graham, 1165 W Dania Beach Boulevard, Apt. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,January 23,2018—7:00 p.m. Commissioner Grace said we heard everyone tonight and understand the plight of having affordable housing in the City. She noted we are not anti-housing, and spoke of the Dania Economic and Development Corporation housing and everything she did to bring affordable housing to Dania Beach. We are not in the business of giving money to people to build housing that the City has no authority over. Commissioner Brandimarte commented it is amazing it had to get to this point before anything was done to improve the living conditions. She is in favor of the project, but not in favor of providing funding. Mayor James questioned the parking spaces, as some residents will have more than one vehicle. She noted not all of the units are vouchers. Ms.Neufeld responded that a study found that the requested parking is sufficient; it is a tried and true formula. Commissioner Salvino noted someone needs to explain how the loan is being requested and how it will be repaid. We are not adding any positions, but upgrading the current positions. Assistant City Manager Donnelly described the three proposed positions for the HR Department (HR Director, Risk Specialist, and HR Specialist). An Administrative Assistant could be added during the budget process to bring the total positions to four. Commissioner Grace noted it is apparent we need to hire someone ASAP; there is no one who can help the retirees. She questioned how many people have applied for the vacant positions and what the pay would be. Assistant City Manager Donnelly addressed the applications received and the salary ranges for the positions. Commissioner Salvino questioned why a Department Director is needed if there is an HR Specialist and Risk Specialist. City Manager Baldwin responded that with a Director, there would be less involvement from the City Manager's Office. Vice-Mayor Harris questioned the pay scale. Assistant City Manager Donnelly explained the origins of the pay scales for the three proposed positions, and noted they could be vetted through the process of the pay and class study. Commissioner Salvino motioned to hire an HR Director, seconded by Commissioner Grace. The motion passed unanimously. 10.2 Recruitment and Selection of City Manager—City Manager Baldwin City Manager Baldwin recommended the Commission engage the services of a professional management recruitment company, which would provide a turnkey process including advertising to attract candidates, selection criteria and interview processes, and a variety of recommendations and input to bring forth a qualified city manager. He thought the process could be completed in 90 days. Commissioner Salvino suggested the recruitment company not be local in order to avoid any bias. He thinks it would be a good idea for future vacancies to be given extra points for being Dania Beach residents. Commissioner Grace asked the City Manager if he would be comfortable with the Commission putting a Department Head in the position, or if he would stay until another manager is hired. Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday,January 23,2018—7:00 p.m. City Manager Baldwin said it would be better to proceed with his recommendation to hire a headhunter. Commissioner Brandimarte wants the City Manager to stay on as a consultant until the new city manager is trained. City Manager Baldwin noted the Commission should proceed with his recommendation to look for a recruiter. He needs to look for other employment opportunities; he cannot commit to stay until someone else is hired and trained. It could take 60-90 days to fill the position. Vice-Mayor Harris said the $25,000 cost for a headhunter would be better served by hiring a full-time employee in the Parks Department. We should get a qualified current employee who could be the city manager and save our money. It could be very expensive to pay for travel and relocation costs. Commissioner Grace questioned if this would be similar to what we did for the CRA Director. City Manager Baldwin noted it was done through HR. Commissioner Grace commented we might have qualified people who work in the City of Dania Beach, but we do not want to do favorites. Mayor James does not see anything wrong with an interim, if we are going with a headhunter. We have to be careful when we automatically disqualify anyone who works for us currently. She indicated an interim city manager would have an opportunity to show us if they are qualified and could fill the position while we are looking for a city manager. Vice-Mayor Harris agreed with allowing an interim who knows the streets and alleys of the City, and what we have been through, especially in the past year. This gives them a chance to prove themselves. Mayor James noted we have a lot of vacancies and will go through a lot of change. There will be a period of adjustment. With all of the vacancies, we need to be careful of everyone being new at the same time because there is a lot of possibility for chaos. Commissioner Salvino said we do not know if any of the department heads want to take the position. Anyone who wants to apply from within should give their application to City Manager Baldwin before we go out and get a headhunter. He believes in hiring from within, but the person needs to be qualified for the job. City Manager Baldwin will speak to the employees if the Commission approves a headhunter. Commissioner Brandimarte said there is not one department head that the Commissioners have not talked bad about to the City Manager. Anyone hired from within will get a lot of crap from her, because the Commissioners should not have the right to personally know someone they hire. We should use a headhunter. There should be something the Commission could do to send a letter to let them know that those residents should be treated humanely. 11.5 Mayor James Mayor James said she needs clarification on Saratoga Crossings. She remembers needing help when she was a little girl and we have to make sure our residents are taken care of. She would be in favor of providing funds if all of her conditions are met. She has a lot of issues with the Housing Authority Board and will attend their next meeting, and added there are no training programs for the residents. Grace Commissioner Marco A. Salvino, Sr. From: Robert Baldwin, City Manager Re: Projects We are getting back on track with the numerous projects that are currently underway. This is an update of several of these projects. Most of them are capital projects and infrastructure-related; however, a number of them are related to studies and service- oriented projects. 1. Budget Priorities. We are continuing to process and implement the City Commission's budgetary priorities for FY17/18. Among those items: a. Adding 3 new Firefighter/Paramedic positions to create a three-paramedic med unit at Station 17. This is now completed. An additional Firefighter/Paramedic position will be added in April. I expect to present an updated BSO Fire Rescue contract that reflects the staffing changes. b. Adding 2 new Deputy Positions. The 2 new positions authorized for October 1, 2018 are being recruited. BSO is actively filling the four new open positions as quickly as possible. The three additional Deputy positions that were approved for April are not included in the four active recruitments. c. Adding 1 Lifeguard. This position was added to provide lifeguard protection north of the pier. This position is filled. The tower is now being constructed. d. Adding an Athletic Director and Facilities Manager. Parks has just completed their review of 84 candidates. HR will soon be setting up interviews. e. Adding 3 full-time Recreation Assistants from 3 part-time positions. These positions are now filled. f. Opening parks on Mondays. This has been implemented. g. Conducting a Citywide Classification and Pay Analysis. A kick off meeting was held January 12, 2018 with Evergreen Consulting. Staff is compiling the requisite information for Evergreen. The project completion date is slated for May 15, 2018. h. Conducting a Parks and Recreation Facilities Study. The bid documents are expected to be finalized and advertised during the week of January 29, 2018. i. Grant Writer—An RFP has been issued for grant writers. Responses are due to the City on February 1. j. Oasis 15 — SW 25 Terrace — Staff identified this location and it is in the design phase. 2. Bus Shelters. A kick off meeting with the contractor was held. Plans will be submitted for permits next week. 3. Smith's Store. The store has been demolished. The appraisals have been completed for adjacent residential properties. A tentative agreement has been reached which is being reviewed by the City Attorney. It will then be brought to the City Commission for action. 4. Oasis 12 (NW 8th Avenue). The contractor is working and the job is expected to be completed by the end of the month with exceptions of the decorative street signs. 5. Oasis 13 (NE 1st Street). The project is underway and the contractor is expected to be completed by the end of next week with the exception of the solar lights and decorative street signs. 6. Oasis 14. Staff has identified the location for Oasis 14 as SE 13 Terr.; SE 13 Street, and SE 14 Street, This project location is in-line with the City Commission's previous direction. This will be a CDBG funded project. It is now being designed. 7. 4-Way Stop Sign on Bryan Road. Broward County has informed us that the City could place a 4-way stop sign on Bryan Road, providing Bryan Road "became a City street." Presumably, the City would have to approach Broward County to transfer the County jurisdiction to the City, and the City would take the responsibility for improvements and incur liability for the roadway, similar to other City streets. The City will do an analysis of the advantages/disadvantages of taking over the jurisdiction. A meeting is being scheduled including Broward County Traffic Engineering, City Manager, Public Services and the Vice Mayor. 8. Olsen Middle School Property. Broward School submitted three appraisals for the site and all were multi-million dollar appraisals. Following a December conference call between the City and Broward Schools it appears that they have reverted to their old position of two years ago. 9. Commission Offices. The Building Department has issued a Certificate of Completion. The contractor needs to address some minor items. Staff is seeking additional furniture vendor proposals and anticipates providing options for the Commission's review presently. . 10. SW 26th Terrace Stormwater Project. Project is 100% complete. 11. SE Stormwater Project. Final bid documents are with City Attorney's office and require review by the project consultant. Bidding will be open for approximately 75 days. 12. Beach Revitalization. Construction documents are being prepared for the second beach bathroom. This should take approximately six months. We are waiting on contract from FPL for the underground wiring. 13.Taylor Lane Roadway Improvement. The storm water improvements have been completed and appear to be working as designed. A guard rail is being installed and the final paving of the road will follow in February. 14. Melaleuca Gardens Water Main. The bids were received and exceeded the engineer's estimate. The award of the contact and a request for additional funding will go to the City Commission at the February 26, 2018 Commission meeting. 15. Hurricane Action Plan. We will be preparing a Hurricane debriefing and action plan to evaluate our response to Hurricane Irma. The City will be using a contractor to conduct employee after action interviews. The plan will incorporate improvements and recommendations concerning our hurricane preparedness and response pre-, during, and post hurricanes. The structure analysis City Hall has been completed and we are awaiting the report. Many elements of the plan to be scheduled and implemented prior to next hurricane season. 16.Mold Report—A follow up mold report was completed in December 2017 at City Hall. Mold returned in one non occupied area and the initial remediation is complete. Further cleaning and testing will be on-going 17.Solar Light Repairs — Recently, 87 Solar lights have been repaired, 14 batteries replaced and the Estates of Fort Lauderdale lights are repaired. 18.FDOT funded Bus Shelters — FDOT is funding seven new bus shelters on Federal Highway. These are to supplement, not replace existing shelters. Public Services is reviewing shelter designs that meet the City's requirements for size, maintenance and consistency of design. We are awaiting a report to send to the City Commission. 19.Additional properties are being appraised for negotiation and purchase. 20. The 2018 Ashphalt Microsurfacing Project will be presented to the City Commission during the meeting of February 12, 2018. 21. The next Oasis Clean-up Day is being scheduled for April 29, 2018.22. 22. The Dania READY Hurricane Preparedness Conference is being scheduled for Saturday, June 2, 2018. 23. The Whisky Creek Dredging Project is in design. A Florida Inland Navigation District grant application is being prepared to offset the cost of the dredging. A resolution authorizing the grant will be before the City Commission in February 2018. 24. Water Use Permit - The Administration continues to seek a long term solution to the City's water supply needs. 25. Entryway Sign - The bid documents have been prepared for the Abbate design. Staff and the Consultants have been meeting with permitting agencies to receive their initial comments. Subsequently, meetings with Redline and the Commission have indicated a desire to incorporate the City's new logo. Staff and the Consultants will be meeting with Redline in the upcoming weeks to coordinate design alternatives and an approval by the City Commission. Further action pending City Commission consensus on the final design. These are several of the projects currently underway.
