Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Vice -Mayor: Commissioners City Manager: City Attorney: City Clerk: Tamara James Marco A. Salvino, Sr. Joyce L. Davis Lori Lewellen Lauren Odman Ana M. Garcia, ICMA-CM Thomas Ansbro Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Update on Olsen Middle School by Principal Valerie Harris - requested by Mayor James Principal Harris gave an update on Olsen Middle School, noting they welcomed back to school over 700 students, some of whom have been out of school for a year. She discussed how she is bringing the City into Olsen Middle School as a community partner and the events and activities planned to accomplish this. 3.2 Parks and Recreation Presentation Eric Brown, Director of Parks & Recreation, gave an overview of projects, including Construction Manager at Risk for the Parks Master Plan projects, Tootie Adler Park, IT Parker, Melaleuca Park, Milliken Park, Precious Paws Dog Park, improvements to the dog park, Mildred Jones Park, PJ Meli Park, SW Community Center, and soft re -opening for our rentals. Cassi Waren, Assistant Director of Parks & Recreation, gave an update on recent programs and events happening within the department, including the Rising Star program, e-sports program, adult kickball, adult holiday 5 on 5 tournament at PJ Meli, flea market at Frost Park, holiday lighting events, t-ball at Frost Park, Southeast Turf Rodeo in collaboration with FRPA, and ongoing programs. Mayor James asked about adding more lighting at Melaleuca Park that would not impede upon the neighbors. Parks & Recreation Director Brown noted all our passive parks are open dawn to dusk; he does not recommend lighting it up, but he will look into it as a CIP project and bring something back to the Commission. Vice -Mayor Salvino questioned the t-ball league and if there is a plan for volunteer coaches, and the possibility of boys' baseball and girls' softball. Parks & Recreation Director Brown said they would investigate to see if we can get volunteer coaches. Mayor James asked about the seniors' program and upcoming events and when they could be re- activated. Parks & Recreation Director Brown noted he has discussed this with the seniors' leaders, and we will wait until after the December meeting to see where we are with the pandemic. 3.3 Special Event request from the City of Dania Beach Community Redevelopment Agency for Dania After Dark events to be held on SW 1st Avenue between Dania Beach Boulevard and SW 1st Street, on December 4, 2021, and on the second Saturday of each month in 2022, up to and including November 12, 2022 from 5:00 p.m. to 10:00 p.m. The applicant is also requesting road closures on SW 1st Avenue, and BSO Police and Fire Services. (Parks & Recreation) Vice -Mayor Salvino motioned to approve the Special Event request for Dania After Dark events including road closures and BSO Police and Fire Services; seconded by Commissioner Davis. The motion carried unanimously. 4. Proclamations 4.1 Family Court Awareness Month - Mayor James Mayor James read the proclamation for Family Court Awareness Month. 4.2 Small Business Saturday - Mayor James Mayor James read the proclamation for Small Business Saturday. 4.3 Veterans and Military Families Month - Mayor James Minutes of Virtual Regular Meeting 2 Dania Beach City Commission Tuesday, November 9, 2021— 7:00 p.m. Mayor James read the proclamation for Veterans and Military Families Month. 5. Citizen Comments Coral Springs Commissioner Nancy Metayer, 8767 Shadowwood Boulevard, Apt. 306, Coral Springs, spoke in support of item 7.6. Paul R. Wiggins, 321 SE 3rd Street, thanked the Commission for what they do and spoke about the agenda item regarding a historic district in the NW section. Yordanos Molla, 2000 Gandy Boulevard, St. Petersburg, spoke in favor of item 7.6 on behalf of the Equality Florida Coalition for Reproductive Freedom. Mary Eakins, 241 NW 53rd Street, Oakland Park, spoke in support of item 7.6. Ashley Chinai-Sierra, Family Court Awareness Month Committee, 850 NE 3rd Street, thanked Mayor James for the Family Court Awareness Month proclamation and addressed Family Court issues and concerns faced by women and children. Emmanuel George, 17 NE 2nd Avenue #106, expressed support of Dania Beach possibly being designated a historic district since it is the first city in Broward County. Hallandale Beach Commissioner Sabrina Javellana, 810 NE 27th Avenue, Hallandale Beach, spoke in favor of item 7.6. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City, and gave updates on school zone patrols, speed trailer, homeless outreach, and issues at 225 SW 15th Street. Captain Sergio Pellecer, BSO District Fire Chief, gave an update on departmental activities including Fire Suppression Month inspections, call volumes, Red Ribbon Week at Collins Elementary, and the Fire Fighters' Toy Drive on November 26th and 27th at Five Below in Dania Pointe. 7. (Mayor James) City Attorney Ansbro read the title of Resolution #2021-178. Mayor James said she pulled the item for discussion for transparency purposes and spoke of Broward County passing a similar resolution. The issue needs to be addressed since there are efforts across the country to prevent women's reproductive rights. Commission Davis understands it is a contentious item and does not feel it belongs on the Consent Agenda. She noted she supports the item. Vice -Mayor Salvino said there are so many comments about this issue, and he does not see how a definitive answer can be given. He does not want to make a choice for a woman; he does not want to get into his beliefs, and he will vote no. Commissioner Lewellen noted the law of the land at this time is Roe v. Wade. Sometimes doing things like this will open the opportunity for more challenges. Commissioner Lewellen motioned to adopt Resolution #2021-178; seconded by Commissioner Davis. He asked the Commission to disclose any communication they had on this matter. Richard Lorber, Planning & Zoning Manager, gave an overview of the rezoning request for Academy Bus. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Virtual Regular Meeting Dania Beach City Commission Tuesday, November 9, 2021— 7:00 p.m. Commissioner Lewellen motioned to adopt Ordinance #2021-026, on second reading; seconded by Commissioner Davis. The motion carried unanimously. 9.2 ORDINANCE #2021-028 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 22, OF THE CITY CODE OF ORDINANCES, WHICH CHAPTER IS ENTITLED "STREETS AND SIDEWALKS" AT ARTICLE I, ENTITLED "IN GENERAL" BY CREATING SECTION 22-7A OF THE CITY CODE OF ORDINANCES TO BE ENTITLED "AUTHORITY OF CITY COMMISSION TO CO -DESIGNATE ROADS AND STREETS, ETC." (SECOND READING) (Community Development) City Attorney Ansbro read the title of Ordinance #2021-028. Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the code amendment and reviewed the changes made to the ordinance, which were requested by the Commission at first reading. Commissioner Davis felt the definition of retired needs to be more specific because someone could be retired and then they come back, particularly an elected office. The language should state cannot be actively working in their career now or in the future. Commissioner Odman questioned if they should be retired from what they are acknowledged for. Assistant City Attorney Boutsis explained that language could be added. Commissioner Davis said if we could add the language, it would make it more definitive. City Attorney Ansbro noted the language permanently retired from his or her principal career would be added to the ordinance. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Davis motioned to adopt Ordinance #2021-028, on second reading, as amended; seconded by Vice -Mayor Salvino. Minutes of Virtual Regular Meeting 10 Dania Beach City Commission Tuesday, November 9, 2021 — 7:00 p.m. Corinne Lajoie, Assistant Director of Community Development, gave a presentation on the site plan modification for Seaview. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Davis motioned to adopt Resolution #2021-179; seconded by Commissioner Odman. The motion carried unanimously. 10. Discussion and Possible Action 10.1 City/CRA initiative regarding wayfinding signs - Mayor James Mayor James asked that the City and CRA work together on wayfinding signs and asked for support for the City Manager to bring us back a wayfinding sign program. She believes this will be a great joint venture that will stretch from the beach to 441. Vice -Mayor Salvino asked how much this would cost. Mayor James said we do not know yet and she is asking City Manager Garcia to come back with different options. There are different infrastructure funding and different grants that we may be able to apply for to get it funded. Vice -Mayor Salvino commented if we start adding stuff in the middle of the Strategic Plan and if they cannot find ways to do this regarding the funding, it could wait as he does not want to deter from our budget. City Manager Garcia noted we have a great grant administrator. Wayfinding signs are not in this year's budget, but working with the CRA, we can explore any and all avenues to fund wayfinding signs via grants, the penny tax, and/or other funding sources. Vice -Mayor Salvino reiterated he does not want to deter from our budget, but he feels it is a great idea. Mayor James said the City Manager would start with the work now and it would take six months to a year to get it done. Commissioner Davis noted we give the City Manager so much to do; she wants to be sure that we are giving the time for the checklist on their Strategic Plan. We should be mindful of the things we prioritized; this was not included in the plan. We all love it but let us focus on the things we had on our checklist. Mayor James confirmed she had the City Manager's support before she put this item on the agenda. She just wanted the Manager to be able to start the work. Minutes of Virtual Regular Meeting 11 Dania Beach City Commission Tuesday, November 9, 2021 — 7:00 p.m. City Manager Garcia said this requires partnering with a consultant; we can have CIP and Grants Administrator Donnelly look for a grant and then being able to align with the proper consultant to help us. We can begin the legwork now, whether it is mid -year budget adjustment or next year's budget. Commissioner Lewellen questioned whether we really need a consultant and if we used one the first time this was investigated with CDBG. City Manager Garcia said we did not as we were just investigating the CDBG funding for it. She is also looking to the penny tax for funding. Commissioner Lewellen is in favor of this but would just like to see how much this would be; however, if we need to wait to the next budget, she is okay with that. 10.2 Historic District - Mayor James Mayor James asked if there is support to allow Community Development to go out and create a historic district in the City. Commissioner Odman noted this is something she intended to do when she came on the Commission; however, she decided she was not in favor of it because it would restrict the City from needed improvements such as climate resiliency and solar panels. City Manager Garcia said that after discussion with Community Development, we should have a consultant investigate it. She had never thought of a house not being able to change the windows and resiliency. It is exciting in some way but challenging. Commissioner Odman noted she does not have a problem with us moving forward and investigating this but wants to ensure that we do it properly. Corinne Lajoie, Assistant Director of Community Development, explained typically a historic designation will create an additional level of review; it does not prohibit or stop changes, but it will have an additional review process. Commissioner Lewellen said she is familiar with historic districts and likes them, but it can be complicated, expensive and a time-consuming process. Although it does not necessarily preclude changes, it can be very difficult and complex, and she used the Nyberg -Swanson house as an example. She has some trepidation with it because once you do it, it could impact people living in the district and impact buildings. It is going to need a consultant and perhaps we should have a workshop to discuss it in detail. There are pros to it but there are a lot of cons. Commissioner Davis agreed to the sentiment to a degree. She believes if any city should have a historic designation, it should be Broward's first city. We should do it the right way and she would like to see it happen for our City. She said this is one more thing we are putting on our plate and does not want to spread the staff too thin; however, in the long term she is in support of it. Minutes of Virtual Regular Meeting 12 Dania Beach City Commission Tuesday, November 9, 2021 — 7:00 p.m. Mayor James said she is aware of this and has had a conversation with Community Development and the City Manager and everyone was comfortable with it. Community Development was excited about it, and this is a project where we will learn a lot of new things. We want people to understand where they are moving, the pros, the cons, and the history behind where they are living. As the first city in Broward, it is important to have this historic designation. Vice -Mayor Salvino noted we have already started developing our City and part of our historical downtown is US-1 where we have the antique shops. A lot of that has already been torn down, windows and doors have already been changed, losing the historic value. Behind Dania shopping center, there are a bunch of homes and people are going to sell the property because the values are high. In the area of CW Thomas and Byrd Pointe, there are some old houses there. He is not opposed to a historic district, but we have a challenge in front of us especially in today's world. Commissioner Lewellen suggested we get an estimate for the cost of a consultant. It is not in the budget and approved and she is not sure it is aligned with our Strategic Plan. It might make more sense to get an estimate as to how much it would cost to bring in a consultant and do the initial work on it. Mayor James said she would first like to see if we have consensus on the item brought forth and questioned Finance Director DiPaolo on how much we have in our Commission contingency. Finance Director DiPaolo responded $200,000.00 for the collective contingency and $25,000.00 per elected official. Mayor James asked City Manager Garcia if there is an issue with the Strategic Plan with this proj ect. City Manager Garcia said she would recommend for Assistant Director of Community Development Lajoie to seek costs for a consultant, and we would come back to the Commission with a cost in either December or January. She wants to make sure we do not drop the ball; we do not want to be a victim of our own success. She recommends Assistant Director of Community Development Lajoie investigate how much a consultant would cost and then we could come back. The Commission consensus was to move forward with this process. 10.3 Options for in -person Commission meetings - Commissioner Odman Commissioner Odman said when we come back to in -person meetings at the second meeting in January, she would like options for being away for a meeting. As long as there are three in person for a quorum, you would still be able to vote. That is not anything new, we already have that. Minutes of Virtual Regular Meeting 13 Dania Beach City Commission Tuesday, November 9, 2021— 7:00 p.m. Assistant City Attorney Boutsis said the State of Florida is very conservative and does not allow other exceptions. For the state legislature and some of the other organizations that they control, they have lots of way for them to hold meetings virtually. They do not allow city or county commissions to do the same. The only exception that the State has recognized is if there is an illness and then if there is a quorum, the person is able to participate and vote but there are no other exceptions recognized under the State. Vice -Mayor Salvino recalled issues in the past regarding sickness and missing meetings. He stated we are elected officials and it is our job to be there. If we cannot be there, he would hope this would not be a consistent thing. If we are coming back, it is our job to be at City Hall; there should be no exception unless it is something very vital. Commissioner Odman said this is not intended for those with a chronic illness. This is for those of you with a cold. If you have a cold, please do not come to a Commission meeting right now. We should utilize the technology we have available and is working well. She reiterated this is not meant for chronic illnesses. Vice -Mayor Salvino noted he has not seen this come up before and he has seen issues with microphones breaking down and freezing up. If we were to vote, he would vote no on it. He does not want to deal with one person at home and the rest at City Hall unless it is necessary. We should judge it by each case and if it becomes a habit, then we should take a different approach. Mayor James said the pandemic has changed so much for so many of us. None of us were elected to abuse power. There needs to be some placeholders; if we see someone abusing it, we bring it back and make the necessary adjustments. Commissioner Odman clarified we already have this in place with the law that allows us to telephonically phone in. There is no new language that we need to put in and nothing to vote on. Mayor James asked if there was Commission consensus to move this forward. Assistant City Attorney Boutsis explained she does not think we need to take action. The Attorney General has implied that the Commission can do this. The Commissioner brought it on the agenda for discussion and possible action because she was looking to do something broader, but the law prohibits anything broader. 10.4 City Attorney request to seek Court authorized inspection warrant for 225 SW 15th Street Assistant City Attorney Boutsis reviewed the memo included in the agenda packet and noted the City Attorney's office is seeking authorization from the Commission to proceed with an inspection warrant for 225 SW 15ffi Street. Mayor James, Commissioner Davis, and Commissioner Lewellen had no objection. Minutes of Virtual Regular Meeting 14 Dania Beach City Commission Tuesday, November 9, 2021— 7:00 p.m. Vice -Mayor Salvino said he thought we had a nuisance abatement process that would have taken them to the Special Magistrate and then taken the property. Assistant City Attorney Boutsis explained we cannot take away a homesteaded property and addressed all the violations listed in the memo included in the agenda packet. Vice -Mayor Salvino asked what good it is to cite them if we do nothing about it. Assistant City Attorney Boutsis said the point of the inspection warrant is to allow us to go in to find out what other violations there are and perhaps have the Court order telling him he must do certain things; in addition, if it is a life safety issue, we can go in and do the repair. Vice -Mayor Salvino noted his question was still not answered and wanted to know if they have these violations, if they will have to go in front of the magistrate to settle the fine and if they do not settle the fine, what happens. Assistant City Attorney Boutsis stated a lot of them have turned into liens against the property and we even have a judgment against the property. If he ever goes to sell the property that is homesteaded, then we can collect. Additionally, we are trying again to have the homestead exemption removed since we know he is not living there. The Commission consensus was to authorize the City Attorney's office to file for an inspection warrant, and for any other remedies in Court against 225 SW 15th Street. 10.5 Review and approve City Commission meeting dates for 2022 - City Clerk City Clerk Schneider reviewed the information included in the agenda packet. The Commission consensus was to approve the City Commission meeting dates for 2022, as amended, to re -schedule the November 8, 2022 meeting to Wednesday, November 9, 2022, to re- schedule the November 22, 2022 to Monday, November 21, 2022 following the Organization Meeting, and to cancel the December 27, 2022 meeting. City Clerk Schneider noted the CRA Board meeting dates for 2022 would mirror the dates of the first Commission meeting of every month. 11. Commission Comments 11.1 Commissioner Davis Commissioner Davis said she attended the Dania Elementary Read for the Record Day, and it was a wonderful day. We need to take as many opportunities as possible to visit our elementary and middle schools. She also attended WMODA and noted it was featured on Deco Drive and it is brining great media attention to our City. She thanked Public Services for being proactive Minutes of Virtual Regular Meeting 15 Dania Beach City Commission Tuesday, November 9, 2021— 7:00 p.m. with the King Tides. We have previously talked about monetizing different items as people want to be part of the City and want to wear our logo. She would like to see that brought back up. Commissioner Davis noted a week from today she will have been a City Commissioner for one year and she is thankful and grateful to her colleagues. She thanked our City Manager and Assistant City Manager and all our staff. She wished a Happy Thanksgiving to everyone, and said she is grateful to work with a great team of people to move our City forward. 11.2 Commissioner Lewellen Commissioner Lewellen said she attended the fall festival at CW Thomas Park and was glad to see the nice turnout as she was concerned with everything that has been going on. There were quite a few kids present and BSO Fire & Rescue did a great job entertaining the kids as well. It was nice to see the C.O.P. program running again. She thanked our veterans and wished everyone a Happy Thanksgiving. 11.3 Commissioner Odman Commissioner Odman wished everyone a Happy Thanksgiving. She noted for those who are considering getting flu shots for their younger ones, CVS did a great job. There are lots of places doing clinics and they are getting us back to normal. 11.4 Vice -Mayor Salvino Vice -Mayor Salvino said it has been a year back on the dais and he has really enjoyed himself. He cannot think of any disagreements at length; we shine, we have had a good year and great times. He thanked the City Manager and Assistant City Manager and all our City administration. He wished everyone a Happy Thanksgiving and hopes they stay healthy and safe. 11.5 Mayor James Mayor James felt the Commission's arguments are healthy and bring out the best in us. With differences and different strengths, we are putting each other in the best position to win. She thanked the residents for being so active in this community regardless of the section of the City that they live in. We are only as good as our residents. We have raised the bar on what it is to be a public servant and elected official. Mayor James spoke of attending a pep rally at Dania Elementary today with Embrace Girls Foundation. Mayor James noted she attended the fall festival and initially was concerned we would not have a good turnout, but we did. She thanked the lst, 2"d, and 3rd place winners for decorating their trunks, and gave kudos to the Parks and Recreation staff. Regarding Commissioner Davis bringing up the City merchandise, she is going to revisit a conversation she had with the CRA Director. Either the CRA or Chamber of Commerce shall have a storefront, and she has not forgotten about this: City Manager Garcia noted the letter she attached to her report was sent to the MPO; the bridge project will be history. We wanted to make sure the $4 million will be allocated back to our City; there needs to be equity among municipalities. City Manager Garcia said she had spoken to the Mayor and Commissioner Lewellen to continue the proactive efforts with our testing sight at City Hall. We were able to extend the program with Broward Health through December 30t' and she reiterated that this does not cost the City a penny. City Manager Garcia reported we started a dialogue with Dania Pointe with upcoming special events. Additionally, we now have a report Captain Marks produces which will also be sent to Dania Pointe because we are working on adding to our law enforcement team and we want them to be aware of our proactive efforts regarding security and public safety.
