A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO APPLY FOR
THE BROWARD METROPOLITAN PLANNING ORGANIZATION's (MPO's)
"2021/2022 COMPLETE STREETS AND OTHER LOCALIZED INITIATIVES
PROGRAM" ("CSLIP"), TO SEEK GRANT FUNDING FOR THE
IMPROVEMENT OF NW AND SW 1ST AVENUE, BETWEEN SW 3RD STREET
AND NW 3'm STREET, WITHIN THE MUNICIPAL BOUNDARIES OF THE
CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on July 9, 2015, the Broward Metropolitan Planning Organization (MPO)
approved the "Complete Streets and other Localized Initiatives Program" ("CSLIP"); and
WHEREAS, the Broward MPO CSLIP program provides funding for the design and
construction of small transportation projects that will improve mobility and safety for all
transportation users; and
WHEREAS, CSLIP improvements along SW and NW lst Avenue, between SW 3rd Street
and NW 3rd Street, (the "I" Avenue Project") will be evaluated and ranked by the MPO, and then
vetted to determine programmability in accordance with CSLIP policies; and
WHEREAS, a resolution from the City Commission of the City of Dania Beach stating
support for the project is required to establish funding eligibility; and
WHEREAS, federally funded projects off the state highway system are delivered using the
federally mandated Local Agency Program (LAP) process, and the Broward CSLIP funding requires
compliance with the LAP process; and
WHEREAS, the City of Dania Beach commits to administer and deliver the project under
LAP; and
WHEREAS, the LAP program agreement provides for a reimbursement -based process for
local projects; and
WHEREAS, the City of Dania Beach commits to funding upfront costs for design,
Construction Engineering and Inspection (CEI) services, and construction to be then reimbursed as
provided for under the LAP agreement; and
WHEREAS, the City of Dania Beach commits to program funding for construction
contingency per the requirements of LAP; and
WHEREAS, the 1st Avenue Project, between SW 3rd Street and NW 3rd Street, will be
constructed within the agency's right-of-way; and
WHEREAS, it is the responsibility of the City of Dania Beach, to maintain or coordinate the
maintenance of the roadways after the project's completion; and
WHEREAS, the proposed grant related transportation project was presented to the CRA
Board at its September 26, 2017 meeting, and street improvements were identified in the adopted
CRA Plan; and
WHEREAS, the City of Dania Beach (the "City") will be submitting an application for the
2021/2022 CSLIP with a request for approximately One Million, Nine Hundred Seventy -Six
Thousand, Seven Hundred Thirty -Six Dollars ($1,976,736.00) to provide funding for CSLIP
improvements along NW and SW 1st Avenue, between SW 3rd Street and NW 3rd Street; and
WHEREAS, the proposed 1st Avenue improvements are supported by the City of Dania
Beach and are generally described to include NW and SW 1st Avenue (from SW 3rd Street to NW 3rd
Street) — roadway reconstruction, paving, drainage, on -street parking, sidewalks, bike and sharrow
lanes, pavement markings, and signage; and
WHEREAS, the City owns, operates and maintains the NW and SW 1st Avenue right-of-
way; and
WHEREAS, the CSLIP does not require a City match, however the City will be responsible
for any construction costs exceeding the CSLIP cap of Three Million Dollars ($3,000,000.00); and
WHEREAS, the City is responsible for all operations and maintenance costs or additional
enhancements applicable to the 1st Avenue Project; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are made apart of and incorporated
into this Resolution by this reference.
Section 2. That the 2021 /2022 CSLIP application for the 1st Avenue Project in the City
of Dania Beach, to be submitted by the City of Dania Beach, Florida to the Broward County MPO, is
approved.
Section 3. That the City Manager and City Attorney are authorized to make minor
revisions to the application and agreement as are deemed necessary and proper for the best interests
of the City and grant eligibility.

Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 5. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
