RESOLUTION NO.2021-197 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP-46- 21MOD), SUBMITTED BY KIMLEY-HORN & ASSOCIATES, INC., FOR PROPERTY GENERALLY LOCATED WEST OF BRYAN ROAD, BETWEEN NW 2 STREET AND RADIANT DRIVE, WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), WHICH EXHIBIT IS MADE A PART OF AND INCORPORATED BY REFERENCE INTO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," provides that site plan approval is required as a condition to the issuance of a building permit, and Section 635-80, entitled "Site Plan Modifications or Deviations", which provides that modifications be approved in the same manner as new site plans unless it meets all of the criteria for administrative approval in Article 635 and Section 340-40(D), entitled "Development Design Guidelines," for properties located within the Planned Mixed -Use Development District (PMUD); and WHEREAS, on September 13, 2021, the City Commission approved a site plan (SP-46- 21) to permit the development of a 180,222 square -foot office building, a 108,085 square -foot training center and parking garage with 998 parking spaces on the Property (R-2021-139), generally located west of Bryan Road, between NW 2 Street and Radiant Drive, within the City of Dania Beach, Florida, as legally described in Exhibit "A" ("Property"); and WHEREAS, Kimley-Horn and Associates, Inc., (the "Applicant") is requesting Site Plan Modification approval (SP-46-21MOD) to permit the development of an additional, mixed -use structure of up to 13,400-square feet on the property; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC, Article 610; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan Modification (SP-046-21 MOD) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, the following Site Plan Modification (SP-046-21MOD), attached as Exhibit "B," which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following condition: 1. Use of the cafeteria and fitness center is restricted to Spirit employees only. 2. Show also all existing and proposed utilities on the landscape plans for potential conflicts (Planning). 3. LOADING: On plans, call out the location and dimensions of the loading space(s) which will serve the cafeteria.; per DP DDG Section (7)(3). (Planning) 4. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved (Engineering). 5. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type Retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV (Engineering). 6. All pavement markings shall be alkyd based thermoplastic and fully retro reflectorized, per BCTED specifications with the exception of parking stall striping (Engineering). 7. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida, if applicable (Engineering). 2 RESOLUTION #2021-197 8. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 9. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc (Engineering). 10. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and 'in accordance with Americans with Disability Act (ADA) (Engineering). 11. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 12. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (Broward County Surface Water License, Broward County EPGMD Wastewater Permit, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). 13. Any cost recovery account balances must be satisfied with the Community Development Department prior to approval of any Building Permit. (Planning) 14. Provide a Construction Staging Plan to be approved by the Community Development Director prior to issuance of a building permit. The Construction Staging Plan must include, but is not limited to, all construction employee parking locations and location of equipment and material during construction (Planning). 15. PUBLIC ART PROGRAM: Per Article 811 - Based on the construction value provided by the applicant this project is estimated to contribute $250,000 into the City's Public Art fund. Alternatively, they may choose to install public art on site equal to half of the required contribution and provide payment into the City's Public Art fund equal to $125,000. 3 RESOLUTION #2021-197 16. RAC TRAFFIC IMPACT FEES: Per the November 19, 2021, traffic statement prepared by Kimley-Horn and Associates, the development as whole is expected generate 417 PM peak hour trips which amounts to $8,865.42 in RAC Traffic Impact Fees (417 x $21.26 per p.m. peak hour trip; per R-2014-49). Section 4. That pursuant to Chapter 28, Part 6 of the LDC, Article 635, Section 635- 100 entitled "Expiration of site plans; procedure for extension," the Site Plan Modification approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan Modification, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
