A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-035-20) AND DESIGN
VARIATION (OT-054-20) SUBMITTED BY GREENSPOON MARDER, LLP,
ON BEHALF OF PRH-DANIA BEACH, LLC, FOR PROPERTY LOCATED AT
901 E. DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH,
FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH
IS ATTACHED TO AND INCORPORATED INTO TO THIS RESOLUTION;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Greenspoon Marder, LLP, on behalf of PRH-Dania Beach, LLC (the
"Applicant") is requesting approval of a Site Plan (SP-035-20) and Design Variation (OT-054-20)
to permit the future development and construction of multi -family for property located at 901 E.
Dania Beach Boulevard in the City of Dania Beach, Florida (the "City") as legally described in
Exhibit "A", a copy of which is made a part of and incorporated into this resolution by this
reference; and
WHEREAS, the City Code of Ordinances, Chapter 28, entitled, "Land Development
Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements," of
Article 635, entitled, "Site Plans" of Section 635-20, entitled "Applicability," at Subsection (A),
which provides that site plan approval is required prior to commencement of construction; and
WHEREAS, the Applicant is requesting Site Plan approval to permit the future
redevelopment of the subject property pursuant to and consistent with the attached Site Plan
provided as Exhibit `B", a copy of which is made a part of and incorporated into this resolution
by this reference; and
WHEREAS, Chapter 28, Part 3, entitled, "Special Zoning Districts," of Subpart 1, entitled,
"Community Redevelopment Area ("CRA") Form -Based Zoning District" of Article 301, entitled,
"Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design;
Procedures For Review Of Design Variations", provides that the City Commission is authorized
to approve design variations within certain districts, if they are consistent with the intent of that
section in lieu of the variance process provided for in Article 625, entitled, "Variances", of the
LDC; and
WHEREAS, the Applicant is requesting a Design Variation (OT-054-20) to waive the
requirement for active liner at street frontage where Article 530 Entitled "Parking Structure Design"
at Subsection (D)(1), which provides for the appearance and architectural treatments to minimize
visual impacts by including the use of false fagades, liner buildings, or opaque or substantially
opaque screening along the perimeter of such structures to conceal parked vehicles from public
view; and
WHEREAS, the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the LDC; and
WHEREAS, the City Commission finds that the approval of the Site Plan (SP-035-20)
and Design Variation (OT-054-20) will protect the health, safety, and welfare of the residents of
the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct and they are made a specific part of this Resolution.
Section 2. That pursuant to Chapter 28 entitled "Land Development Code," Part 6
entitled "Development Review Procedures and Requirements," at Article 635, entitled "Site Plan,"
the Site Plan (SP-035-20), attached as Exhibit `B" is approved.
Section 3. That pursuant to Part 3, of the LDC, entitled, "Special Zoning Districts," of
Subpart 1, entitled, "Community Redevelopment Area ("CRA") Form -Based Zoning District" of
Article 301, entitled, "Legal and Administrative Provisions" of Section 301-50, entitled,
"Variations In Design; Procedures For Review Of Design Variations" the application for Design
Variation contained in the Site Plan attached as Exhibit `B", under application (OT-054-20) is
approved.
Section 4. That the approvals granted by this Resolution are subject to the Applicant's
compliance with the following conditions:
1. A STOP sign should be installed for exiting vehicles of the site driveway onto East Dania
Beach Boulevard. A RIGHT TURN ONLY sign should also be included for exiting
vehicles. The installation of these signs should comply with the Manual of Uniform Traffic
Control Devices (MUTCD). (Traffic Engineering)

2. The ground floor parking area shows a connection to an emergency access on the east side
of the property. Proper signage should be installed to prohibit other than emergency
vehicles from utilizing that driveway from accessing from the ground floor parking area.

3. A DO NOT ENTER sign should be installed at the end of the emergency access next to
East Dania Beach Boulevard to prohibit vehicles from entering the site from that driveway.
Installation of this sign should comply with the MUTCD. (Traffic Engineering)
4. Please provide sight distance analysis for the main access for this site onto East Dania
Beach Boulevard. (Traffic Engineering)
5. A sign should be provided for the traffic entering the site to direct them to either the parking
area, garage, or the location for drop-off. This should minimize potential confusion from
drivers entering the site and prevent conflicts with other entering/exiting vehicles. (Traffic
Engineering)
6. Please show striping for the 5-foot section next to the 12-foot right turn lane directing
drivers onto the site. (Traffic Engineering)
7. Location, character, size, height and orientation of proposed signs, including building
signage details shown on plan elevation and method of illumination. Monument sign design
provided. Meets the criteria set forth in 505-90(0) and 505-210 for an architectural sign.
Design includes a coral stone finish site wall. Proposed 12" letters will be surface mounted
on top of wall and uplit. Address will be mounted within the wall with 12" letters.
Development name equals 12.67SF while the address equals 9.5 SF for a total of 22.17SF.
Calculation equals the square footage around the lettering and not the entire wall area.

8. SCHOOLS: Obtain a SCAD report from Broward County School Board regarding school
impact fees. (Planning & Zoning)
9. IMPACT FEES: Impact fees that will be required for the project are required prior to
issuance of a building permit. (Planning & Zoning)
10. The proximity to the airport will be required FAA & BCAD review and approval. Contact
William Castillo, Airport Planner with Broward County Aviation Department, located at
2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. Application

11. WILDLIFE PROTECTION: Provide wildlife protection report pursuant to Sec. 250-
10.A.1. (Planning & Zoning)
12. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a
certified engineer, identifying the amount of CRA mitigation for traffic impact due based
on resolution No. 2014-049, which established a rate of $21.26 per p.m. peak hour trip.
Therefore, applicant must pay $2,721.28 (128 PM trips X $21.26) prior to issuance of a

building permit. Updated per traffic study provided by TrafTech Engineering, as revised
May 6, 2020. (Planning & Zoning)
13. Per Resolution No. 2015-071, $1,825.00 per Single-Family/Townhouse dwelling,
$1,364.00 per Multifamily Dwelling, $1,140.00 per Mobile Home must be paid for
Recreation and Open Space Impact Fee at time of building permit issuance. Therefore,
applicant must pay $404,700.00 ($1,140 X 355 units) prior to issuance of a building permit.

14. For the purpose of evaluating flood and roadway conditions and mitigation related to the
future development project, all topographic information will include LIDAR spot
elevations within 150 feet of the subject property boundaries. Will provide elevations (not

15. SHEET Al. 1, identify the setback dimension of the following features:
a. Parking lot at SW corner from west property line. 11'3" dimension shown from
parking space. Dimension of parking area south of this location at SW corner
should be shown.
b. "Path" from south property line. 27'4" from property line (within turn lane)
c. Emergency Vehicle Access Drive from East property line. 6'6" (Planning &

16. PUBLIC ART PROGRAM: Per 0-2019-025, New development and redevelopment in
non-residential, mixed -use and multi -family zoning districts shall provide fee for the
creation, acquisition and installation of public art in the city.
a. Pay In -Lieu Public Art Fee: Pay one-half of one percent (0.5%) of the cost of
the proposed development project, as an "in -lieu" public art fee, with a
minimum payment of $5,000 and a maximum payment of $250,000; or
b. Combination of In -Lieu Public Art Fee and Placement of Art on Site: Placement
of art on the site of the development project, which shall have a minimum value
of one -quarter of one percent (0.25%) of the cost of the proposed development
project combined along with a one -quarter of one percent (0.25%) payment of
an "in -lieu" public art fee. The owner shall provide documentation to the City
that the art fee has been deposited into an escrow account for said purpose prior
to the issuance of a building permit. Prior to placement on the development site,
the art must be approved by the Community Services Director or designed and
conform to the adopted public art guidelines. (Planning & Zoning)
17. Any cost recovery account balances must be satisfied with the Community Development
Department prior to approval of any Building Permit. (Planning & Zoning)
18. Per Section 265-110 (H)(2) "The perimeter of a VUA shall be constructed with a six inch
( 6") raised type "D" of "F" curb..." The Applicant shall identify location of the curbs

required on the plans. Add note or arrow showing "D" type curb parallel to southeastern
portion of building from Stair 5 to front of building. (Planning & Zoning) (Engineering)
19. The turn lane is required per FDOT's direction since the site is generating approximately
80 PM trips as illustrated on Figure 2 of the traffic study, at page 8 of 60. A signed and
sealed Traffic Study is required. (Engineering) To be provided prior to the issuance of
building permit.
20. FDOT Driveway, Drainage, Construction Agreement, and any other required FDOT
permits must be obtained prior to City approval of Building Permit. (Engineering)
21. Broward County Surface Water Management license is required. (Engineering)
22. If the lift station downstream needs to be upgraded due to the proposed development, the
Applicant is responsible for the upgrades. (Engineering)
23. Applicant is responsible for all water and fire improvements to support the project. All
infrastructure and roadway improvements to support the development is the Applicant's
responsibility. (Engineering)
24. Must meet the required Berm Elevation. (Engineering)
25. Please show all dedicated right-of-way (R/W), easements and existing R/W on Site Plan
and engineering plans (plan view). If new Utility Easements proposed that shall be included
in the Plat application and proposed Plat. (Engineering)
26. Please identify and call out offsite improvements, R/W improvements (Bike Lane, Turn
Lane, (Engineering)
27. Sidewalk, Curb) on Site Plan. Existing full R/W, all lanes, median shall be shown on Site
Plan. (Engineering)
28. Please provide existing elevations for onsite and adjacent properties. The provided survey
is missing full onsite topographic information. (Engineering)
29. Please provide Civil plans identifying ROW lines, NVAL lines, ROW widths, ROW
improvements, offsite drainage improvements, all easements, and sufficient details.
Sufficient dimensions shall be provided to verify compliance. Please provide a Pavement
Marking and Signage Plan for onsite and offsite improvements. Site Plan shall include
onsite/offsite striping and signage. (Engineering)
30. Please demonstrate that proposed offsite improvements are acceptable to FDOT. On
Section AA, please show existing R/W line and dedicated R/W line. Buffered bike lane
shall be shown. R/W dedication width shall be shown on Section A -A. Section A -A does
not match with Site Plan improvements. Please verify that if 5' wide sidewalk is acceptable
to FDOT. (Engineering)

31. Please provide drainage calculations to demonstrate that the proposed development can
meet drainage design criteria and can meet jurisdictional agencies requirements. The
design shall be based on BC future water table map elevations.
a. Please provide a cross section across proposed driveway showing ADA compliant
sidewalk and acceptable driveway cross slope.
b. Please provide plans for offsite improvements including offsite drainage
improvements.
c. Please demonstrate that the proposed exfiltration trench is sufficient to serve the
proposed project.
d. Please provide Broward County/FDEP approval for proposed wetlands/mangrove
impacts. (Engineering)
32. Please show the proposed Water Mater location and Backflow preventer location on the
plans. Water meter shall be placed in R/W limits or adjacent Utility Easement per standard
details. The proposed DDCV shall be placed within R/W or adjacent utility easements per
the standard detail shown. (Engineering)
33. The proposed looped Fire Main and onsite Fire Hydrants shall be called out as Private. The
City will not maintain those facilities. (Engineering)
34. The Fire Hydrant along Dania Beach Boulevard shall be placed in R/W limits or Utility
Easements. (Engineering)
35. Building Permit plans to verify that the existing Sanitary Manhole and gravity main exists
as shown on plans. Rim elevation, invert elevations, pipe sizes are missing. Must
demonstrate that Sewer slope is adequate up to the service location of the Building. Show
the sewer line up to the point of connection at the proposed building. Verify if a private lift
station is required to serve the proposed project. (Engineering)
36. Additional pavement restoration shall be required for sewer service connection. Proposed
cleanout shall be placed in R/W or Easements per standard details. (Engineering)
37. The City recommends connecting the sewer at the existing manhole located at west
driveway entrance of Motel 6 development. (Engineering)
38. Please show sight triangles per Code of Ordinances and FDOT standards. (Engineering)
39. Section C-C shows Type D curb which is missing in Plan View and Site Plan. Show
proposed improvements, site grading, wetlands/Mangrove in Section C-C. (Engineering)
40. All curb ramps shall be shown on Site Plan and engineering plans. (Engineering)
41. Sheet A2.4 renderings did not include bike lane or offsite improvements correctly.

45. Pavement markings for parking facilities shall be provided in conformance with the
Manual on Uniform Traffic Control Devices, latest edition. (Engineering)
46. All required off-street parking spaces shall be clearly delineated by a single four -inch wide,
white, painted striping wherever a hard -paved parking surface is required, except that
striping shall not be required for: (a) Stacked parking, where permitted within residential
driveways; (b) Brickpavered parking surfaces, in which case wheel stops or alternating
paver colors shall be substituted for striping in order to clearly delineate parking space

Section 6. That pursuant to LDC Section 635-100 "Expiration of Site Plans," the Site
Plan (SP-035-20) approval shall automatically expire and become null and void unless the
Applicant commences with construction of the improvements shown on the Site Plan, within
eighteen (18) months from the date of this Resolution.
Section 7. That the issuance of a development order by a municipality does not in any
way create any right on the part of an Applicant to obtain a permit from a state or federal agency
and does not create any liability on the part of the municipality for issuance of the development

order if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed
by a state or federal agency or undertakes actions that result in a violation of state or federal law.
Section 8. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 9. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
