Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event request from The Field Irish Pub and Eatery, 3281 Griffin Road, for their annual St. Patrick's Day Celebration to be held on March 17, 2018 from 11:00 a.m. - 11:00 p.m. The applicant is also requesting a road closure on Griffin Road, fence, temporary signage, and BSO Detail. Commissioner Grace motioned to approve the Special Event request for the St. Patrick's Day Celebration; seconded by Commissioner Salvino. The motion carried unanimously. 3.2 Special Event Request from the Marine Industries Association of South Florida for their "41 st Annual Broward County Waterway Cleanup" to be held on March 3, 2018, from 9:00 a.m. - 1:00 p.m. This event will be held in various locations around Dania Beach such as Dania Beach Pier, Marina, Secret Woods, Harbour Towne and Dr. Von D. Mizell-Eula Johnson State Park. The applicant is also requesting the following: a Special Event fee waiver of$150.00, waiver of parking fees for volunteers, and for the City to provide dumpsters for all cleanup sites. Commissioner Grace motioned to approve the Special Event request for the 41st Annual Broward County Waterway Cleanup; seconded by Commissioner Salvino. The motion carried unanimously. Commissioner Grace motioned to approve a waiver of fees for Frost Park for the Lions Club 69th Anniversary event; seconded by Commissioner Salvino. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Charlotte Newbury, 1314 SE 5h Court, addressed issues with trees on the north side of the Sleep Inn, and requested they be removed and no trees planted to replace them. Karena Pinzon, 1318 SE 5th Court, also spoke of problems with the Sleep Inn property. Randall Wright, 4391 SW 34th Lane, spoke of problems with windows and doors installed through the BCAD mitigation of his home. He requested the County Commission hire a firm to review that installations were done to code. Patricia Chukerman, 545 SE 4th Court, noted there is an unlicensed Airbnb across the street from her house. The address is 530 SE 4th Court. Discussion ensued on legislation and City Codes pertaining to the issue. Tom McManus, 565 SE 4th Court, also spoke of the problems with the Airbnb at 530 SE 41h Court. Emmanuel George, 17 NE 2nd Avenue, #106, requested a historical site for Dania Beach's Black History. Commissioner Grace requested he show his video on Black History at the next Commission meeting. Tiffany Grantham, 1612 N 17th Avenue, Hollywood, wants the Commission to ask FPL to build a first generation renewable plant, not a last generation fracked gas plant. 6. Public Safety Reports Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,February 13,2018—7:00 p.m. Captain Daniel Marks, BSO Chief of Police, welcomed Sergeant Gelvez. He noted that he provided the City Manager with the findings of the recent CPTED Study of City Hall. He also reported on recent criminal activity, and noted Shred-a-thon and Operation Medicine Cabinet will be at Bass Pro Shop on March 31 st Commissioner Grace requested that Chief Marks reinstate the Front Porch program. Sean Brown, Battalion Chief, BSO Fire Rescue, was available to answer questions. 7. Consent Agenda Items removed from Consent Agenda: #7.6 7.1 Minutes: Approve Minutes of January 23, 2018 City Commission Meeting 7.2 Travel Requests: Request from Eleanor Norena, Community Development Operations Manager, to attend the Florida Floodplain Managers Association (FFMA) Annual Conference in Orlando, Florida on April 9-13, 2018, for educational purposes. City Attorney Ansbro read the title of Resolution 92018-022. Commissioner Brandimarte said this is a federal government issue, not the City's. Commissioner Grace motioned to adopt Resolution #2018-022; seconded by Mayor James. Corinne Lajoie, Planning & Zoning Manager, explained the land use, rezoning, site plan and variances requested by the applicant. Mayor James opened the Public Hearings. James Valsin, 18 NW 3rd Street, spoke against the FPL frack plant. Seeing as there was no one to speak in favor or opposition, Mayor James closed the Public Hearings. Commissioner Grace motioned to adopt Ordinance #2017-004, amending the Future Land Use Plan Map, on second reading; seconded by Commissioner Brandimarte. Corinne Lajoie, Planning & Zoning Manager, reviewed the requests for the development and noted letters of objection, which are attached to these minutes, were received and provided to the Commission. The residents' concerns have been addressed by the applicant and the additional conditions have been placed in the resolution. Bill Hamel, on behalf of the developer, noted he appreciates the Commission reviewing the project and is available to answer questions. Mayor James opened the Public Hearing. Discussion and Possible Action 10.1 RESOLUTION#2018-028 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A LOAN TO PARTIALLY FINANCE DEVELOPMENT OF THE SARATOGA CROSSINGS HOUSING DEVELOPMENT AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE LOAN DOCUMENTS; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-028. A representative of Atlantic Pacific Communities presented a PowerPoint, which is attached to and incorporated into these minutes. Commissioner Brandimarte questioned if the residents would need to be re-screened when they come back. She felt it would need to be in writing that every one of the residents would be entitled to come back. Derrick Hankerson, 746 SW 3`d Street, who sits on the DBHA Board, responded to the questions and explained HUD requirements for qualification. Mayor James said there will be different screenings with this development. The representative of Atlantic Pacific Communities noted there will be 44 project based voucher units within this development. There are no market rate units. Mayor James opened a public hearing. Sharon Higgs, 1115 W Dania Beach Boulevard, Unit C, explained they have inspections every year, and they have to comply with regulations every year. Mayor James said they can add additional things to the screening for those returning. The Atlantic Pacific Communities representative noted there will not be more stringent standards applied to returning residents. Kacey Elders, 1115 W Dania Beach Boulevard, said she is grateful to have housing, and spoke of the problems with the current housing development. Tamora Brown, 1125 W Dania Beach Boulevard, said she is the new Commissioner on the Housing Board, and asked everyone to think about it and look at how they are living. The loan is Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,February 13,2018—7:00 p.m. a lot of money, but it is for the betterment of the residents. She noted they have to follow rules and regulations. Commissioner Brandimarte stated she fights for second chances; in her heart she does not have faith enough in the re-screening process. Mayor James said she knows the executive director wants to evict Tamora Brown. The Board should have been held accountable for the problems; it is the residents' responsibility to insure that they have a safe place. She questioned what programs the Housing Authority Board had for the residents. Derrick Hankerson noted the units were built several decades ago. He served on the Board in 2008; a previous executive director had him removed from the Board because he was gay. He explained how this project would be a catalyst for change in the neighborhood. Amonica Kelsey, 1125 W Dania Beach Boulevard, Unit D, said families did not participate in toy drives. James Valsic, 18 NW 3rd Street, said this is gentrification. The Commission should protect the residents and forget about the developers. Vice-Mayor Harris said this is the time for the Commission to change the life of the residents in Dania Beach. This will be a safe place for residents during hurricanes and this will be our legacy that we helped people. He urged the Commissioners to make the City a better place for our community. Commissioner Brandimarte noted we do not have a hurricane shelter for the 30,000 residents who live here. The Mayor wants branding and a gymnasium; these cost money. She does not have the trust for the people who will find another place to live for one year, and their children will not get in trouble for one year. She stated the residents never asked for help in the past, and she is appalled that people try to take advantage of poor people. Commissioner Grace said she is insulted by a Commissioner who read his statement off a paper. She made sure we had quality housing in NW Dania Beach. Bob Mikes stuck by her to make sure we had no more apartments in Dania Beach, only single family homes. The residents of Saratoga should not have lived with the problems they are describing without complaining and protesting for a better quality of life. She is appalled that the Housing Authority director did not show her face tonight to ask for money and that they are promising something they cannot deliver; she is not going to take the money from the City of Dania Beach to give to this project. She noted she represents everyone in Dania Beach, whether they voted for her or not. She does not see good faith in this project at all, and will motion to deny the request. Vice-Mayor Harris apologized to Commissioner Grace. He said we need to have the faith and opportunity to make the community a better place; he feels the opportunity is here. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,February 13,2018—7:00 p.m. Commissioner Salvino commented we have to do what is best for the community and the residents. The problem seems to be directed to the housing director, and questioned if there were problems with the previous director. Commissioner Grace said she had problems with the previous directors. She will always have a problem when they mistreat her residents. Mayor James stated she does not have a personal vendetta with the executive director; she looks at their resumes and fruit of their labor. She noted she listens to the phone calls she receives. Commissioner Grace motioned to deny Resolution #2018-028; seconded by Commissioner Brandimarte. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte spoke of recent deaths in the community and the upcoming midget wrestling event. 11.2 Commissioner Grace Commissioner Grace does not want anyone to think she doesn't have a heart because she does. Commissioner Grace spoke of the NAACP housing in her home town, and said we have a moral obligation to make sure every resident in Dania Beach is treated fairly. Commissioner Grace asked the Mayor to do two things: send a letter to Congressman John Lewis to be the keynote speaker for the MLK celebration next year, with copies to U.S. Representatives Hastings, Wasserman Schultz, and Wilson; and prepare a Black History Proclamation for this month. 11.3 Commissioner Salvino Commissioner Salvino had no comments. 11.4 Vice-Mayor Harris Vice-Mayor Harris said he loves all the Commissioners and is here to serve. 11.5 Mayor James Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,February 13,2018—7:00 p.m. Mayor James said it is our goal to serve the residents of the community. Mayor James noted she is getting a lot of feedback from residents about people sleeping on their boats and dumping waste at the marina, in back of Dockers and other locations. Mayor James questioned the status of the HR Director and Athletic Director positions. City Manager Baldwin gave a brief update. Mayor James said the elevator at Quarterdeck is out and there is an issue with the original design. City Manager Baldwin noted it was poorly designed and a replacement would need to be budgeted; he was told the cost could be $100,000. Mayor James commented the lights being down at the beach is scary; parks need to be safe and lighting is a priority. This is an issue of hers for some time now. City Manager Baldwin responded temporary lighting will be installed; this is a potential CDBG project for solar lighting. Brad Kaine, Director of Public Services, noted staff is meeting with FPL on Friday to look at various locations, including CW Thomas Park; we will have answers next week. Mayor James noted she has ideas that are not as expensive and will talk to Public Services Director Kaine. 12. Salvino, Sr. From: Robert Baldwin, City Manager Re: Recruitment and Selection of City Manager— UPDATE At the City Commission Meeting of January 23, 2018, the administration recommended that the City engage a professional management recruiting company to conduct recruitment and selection processes for the next City Manager (attached). The City Commission directed staff to first allow city employees one week to apply for the City Manager position. The Commission decided to allow each Commission member to first interview each employee-applicant individually and then interview candidates publically by the entire City Commission. In the event there were no employee candidates to be interviewed, the Administration proceed with an RLI to seek professional executive recruiters. Two employees applied by the established deadline and one of those employees then withdrew. The City Attorney and/or I talked to each of the members of the City Commission, and it was decided not to interview the remaining applicant. The Administration then contacted several firms that recruit in Florida to make them aware of the RLI. The RLI was also posted. The closing for submitting is next Tuesday, February 20. We will see how many firms apply and distribute the submittals to the Commission members for individual review with the Administration. I further told this Commission that after the 2017 holidays I would bring forth a recommendation on recruiting and selecting a city manager. The transition to a new city manager can be disruptive and difficult; however, if done appropriately the process can be completed very successfully without undue consternation. In order to do this, I believe the most successful recruitments are accomplished by engaging a professional management recruitment company to provide the City Commission with a turnkey process including City advertising to attract candidates, selection criteria and interview processes, and a variety of recommendations and input to bring you a qualified city manager. This is the same process the City of Dania Beach utilized during its last search for a city manager. If the City Commission concurs, the City will immediately advertise for Letters of Interest from professional management recruitment companies to submit their qualifications to the City to conduct a recruitment and selection process for a new city manager. We should be able to bring a list of interested, qualified recruiters to you in February and the City Commission can make a selection to begin the recruitment process. This agreement is similar to other street light agreements we have with Broward County and requires that the City pay the costs for the maintenance, replacement, repair and electrical charges for the lights. Joe Denis of KIMCO recently contacted us and requested that the City expedite the City's commitment to Broward County that we will maintain and operate the street lights. This commitment will allow Dania Pointe to gain approval by Broward County to install the street lights along Bryan Road and complete the road ASAP. Due to the timeliness of this matter and at the request by Kimco and Broward County — I am seeking the Commission's consensus to send a letter to Broward County expressing the City's commitment as required. The formal agreement will be scheduled for City Commissions action on the February 27t' agenda. Grace Commissioner Marco A. Salvino, Sr. From: Robert Baldwin, City Manager Re: Projects Numerous projects are currently underway. This is an update of several of these projects. Most of them are capital projects and infrastructure-related; however, a number of them are related to studies and service-oriented projects. 1. Budget Priorities. We are continuing to process and implement the City Commission's budgetary priorities for FY17/18. Among those items: a. Adding 3 new Firefighter/Paramedic positions to create a three-paramedic med unit at Station 17. This is now completed. An additional Firefighter/Paramedic position will be added in April. We met with BSO Fire/Rescue last week to negotiate completion of an executed fire/rescue service agreement. I hope to present an updated BSO Fire Rescue contract that reflects the staffing changes in the coming few weeks. b. Adding 2 new Deputy Positions. The 2 new positions authorized for October 1, 2018 are now filled. BSO is actively filling four vacancies as quickly as possible. The three additional Deputy positions that were approved for April are not included in the four active recruitments. c. Adding 1 Lifeguard. This position was added to provide lifeguard protection north of the pier. This position is filled. The tower is still being manufactured for delivery. d. Adding an Athletic Director. Parks and Recreation staff expects to compete the second round of interviews this week. e. Facilities Manager. Because of the City Commission's decision to move forward with a plan for city hall, we are evaluating the need for another Engineer. f. The final candidate interview for the Human Resources Director is scheduled for tomorrow and the City Manager plans to finish the selection this week. g. Adding 3 full-time Recreation Assistants from 3 part-time positions. These positions are filled. h. Opening parks on Mondays. This was implemented. i. Conducting a Citywide Classification and Pay Analysis. A kick off meeting was held January 12, 2018 with Evergreen Consulting. Staff is compiling the requisite information for Evergreen. The project completion date is slated for May 15, 2018. j. Conducting a Parks and Recreation Facilities Study. The bid documents are expected to be finalized and advertised during the week of February 17, 2018. k. Grant Writer—An RFP was issued for grant writers and three firms responded. I. Oasis 15 — SW 25 Terrace — Staff identified this location and it is in the design phase. 2. Bus Shelters. A kick off meeting with the contractor was held. Plans are now in for permitting. 3. Smith's Store. The store has been demolished. The appraisals have been completed for adjacent residential properties. A tentative agreement has been reached which is being reviewed by the City Attorney. It will then be brought to the City Commission for action. 4. Oasis 12 (NW 8t" Avenue). The nearly complete with the exception of decorative signs to be delivered. We are evaluating the cost of decorative mailboxes that were originally in the project. 5. Oasis 13 (NE 1st Street). The project is under way and the contractor is expected to be completed by the end of next week with the exception of the solar lights and decorative street signs. 6. Oasis 14. Staff has identified the location for Oasis 14 as SE 13 Terr.; SE 13 Street, and SE 14 Street, This project location is in-line with the City Commission's previous direction. This will be a CDBG funded project. It is now being designed. 7. 4-Way Stop Sign on Bryan Road. Broward County has informed us that the City could place a 4-way stop sign on Bryan Road, providing Bryan Road "became a City street." Presumably, the City would have to approach Broward County to transfer the County jurisdiction to the City, and the City would take the responsibility for improvements and incur liability for the roadway, similar to other City streets. The City will do an analysis of the advantages/disadvantages of taking over the jurisdiction. A meeting is being scheduled for next week including Broward County Traffic Engineering, City Manager, Public Services and the Vice Mayor. 8. Olsen Middle School Property. Broward School submitted three appraisals for the site and all were multi-million dollar appraisals. Following a December conference call between the City and Broward Schools it appears that they have reverted to their former position of two years ago. 9. Commission Offices. The Building Department has issued a Certificate of Completion. The contractor needs to address some items. Staff is seeking additional furniture vendor proposals and anticipates providing options tomorrow for the Commission's review presently. 10. SW 26t" Terrace Stormwater Project. Project is 100% complete. 11. SE Stormwater Project. Final bid documents are with City Attorney's office and require review by the project consultant. Bidding will be open for approximately 75 days. 12. Beach Revitalization. Construction documents are being prepared for the second beach bathroom. This should take approximately six months. We are waiting on contract from FPL for the underground wiring. A meeting is being held tomorrow. 13.Taylor Lane Roadway Improvement. This project is complete except for the emergency access apron on NW 10th. 14. Melaleuca Gardens Water Main. The bids were received and exceeded the engineer's estimate. The award of the contract and a request for additional funding will go to the City Commission at the February 26, 2018 Commission meeting. 15. Hurricane Action Plan. We will be preparing a Hurricane debriefing and action plan to evaluate our response to Hurricane Irma. The City will be using a contractor to conduct employee after action interviews. The consultant started the after-action review last week. The plan will incorporate improvements and recommendations concerning our hurricane preparedness and response pre-, during, and post hurricanes. The structure analysis City Hall has been completed, and it is being distributed to the City Commission for review (a staff analysis and executive summary will follow. The report indicates that City Hall is not structurally adequate to be used as an Emergency Operations Center. Many elements of the plan to be scheduled and implemented prior to next hurricane season. 16.Mold Report—A follow up mold report was completed in December 2017 at City Hall. Mold returned in one non occupied area and the initial remediation is complete. Further cleaning and testing will be on-going. 17.Solar Light Repairs — Recently, 87 Solar lights have been repaired, 14 batteries replaced and the Estates of Fort Lauderdale lights are repaired. We are adding additional solar lighting at City Hall and preparing recommendations for lighting at various locations at our parks and streets requested by Commission members. 18.FDOT funded Bus Shelters — FDOT is funding seven new bus shelters on Federal Highway. These are to supplement, not replace existing shelters. Public Services is reviewing shelter designs that meet the City's requirements for size, maintenance and consistency of design. We are awaiting a report to send to the City Commission. 19.Additional properties are being appraised for negotiation and purchase. 20. The 2018 Asphalt Microsurfacing Project will be distributed tonight to the City Commission for review and subsequent approval at the February 27 meeting. 21. The next Oasis Clean-up Day is scheduled for May 26, 2018, 22. The Dania READY Hurricane Preparedness Conference is scheduled for Saturday, June 2, 2018. 23. The Whisky Creek Dredging Project is in design. A Florida Inland Navigation District grant application is being prepared to offset the cost of the dredging. A resolution authorizing the grant will be before the City Commission in February 2018. 24. Water Use Permit - The Administration continues to seek a long-term solution to the City's water supply needs. 25. Entryway Sign - The bid documents have been prepared for the Abbate design. Staff and the Consultants have been meeting with permitting agencies to receive their initial comments. Subsequently, meetings with Redline and the Commission have indicated a desire to incorporate the City's new logo. Staff and the Consultants will be meeting with Redline in the upcoming weeks to coordinate design alternatives and an approval by the City Commission. Further action pending City Commission consensus on the final design. These are several of the projects currently underway.
