AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, PERTAINING TO PARKING OF VEHICLES;
AMENDING CHAPTER 25, ENTITLED "TRAFFIC", ARTICLE III,
ENTITLED "PARKING, STOPPING AND STANDING", DIVISION 1,
"GENERALLY", SECTION 25-51, ENTITLED "ANGLE PARKING,
BACKING PROHIBITED", DIVISION 2, ENTITLED "ENFORCEMENT",
SECTION 25-79, ENTITLED "FINES", TO UPDATE, CLARIFY, AND
REVISE SUCH SECTION; AND DIVISION 3, ENTITLED "PARKING
METERS", SECTION 25-86, ENTITLED "PAYING FOR PARKING BY USE
OF APPROPRIATE COINS OR CURRENCY, TIME RESTRICTIONS;
PARKING WITHIN METERED SPACE", OF THE CITY CODE OF
ORDINANCES, PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA:
Section 1. That Article III, entitled "Parking, Stopping and Standing" of Chapter 25,
entitled "Traffic", Division 1, entitled "Generally", and specifically Section 25-51, "Angle
Parking, Backing Prohibited" of the City Code of Ordinances, is amended to read as follows:
Sec. 25-51. , baeking Back-in parking prohibited.
In all marked parking spaces imafke,a for angle par-kin^, �" vehicles shall be parked with
the front end of the vehicle facing into the parking space, pr-ovide for- par-king in all public
parking areas within the city. The operators of vehicles are prohibited from backing any vehicle
into sueh angle parking spaces located in public parking areas within the city. No person shall
stand or park a vehicle other than at the angle to the curb when angle parking is indicated by
signs, pavement markings or both or into the ,.^., as otherwise indicated by stwh signs, of
pavement markings,or both.
Section 2. That Article III, entitled "Parking, Stopping and Standing" of Chapter 25,
entitled "Traffic", Division 2, entitled "Enforcement", and specifically Section 25-79, "Fines" of
the City Code of Ordinances, is amended to read as follows:
See. 25-79. Fines.
The following fines have payable to the cityare established for improper parking
within the city limits:
(a) Restricted parking : Any person parked or found in violations of sections 25-86(a), 25-
86(c), 25-87, 25-88, 25-45(i), 25-43, 25-57, 25-50, 25-123, 25-45(a)-(c), or 25-63
shall be liable for payment of a fine of thirty-five dollars ($35.00).
(b) Improper parking: Any person parked or found in violation of sections 25-51, 25-120,
25-45(g), 25-47, 25-52, 25-53 or 25-54 shall be liable for payment of a fine of thirty-
five dollars ($35.00).
(c) Prohibited parking : Any person parked or found in violation of sections 25-41, 25-49,
25-44, 25-45(d), 25-45(f), 25-45(h), 25-59, 25-48, 25-45(i) or 25-55 shall be liable for
payment of a fine of thirty-five dollars ($35.00).
(d) Hazardous parking/private lands parking : Any person parked or found in violation of
sections 17-14, 25-104, 25-107, 25-121, 25-122, 25-58, 25-64, 25-65, 25-66, 25-67, 25-
56, 25-60, 25-61, 25-45(a), (e) or 25-62 shall be liable for payment of a fine of thirty-
five dollars ($35.00).
(e) Disabled parking: All persons parked or found in violation of section 25-46 shall be
liable to pay for payment of a fine of two hundred fifty dollars ($250.00).
(f) {Surcharge for school crossing guard program.I In addition to the fines provided for in
this section, a five dollar ($5.00) surcharge to provide funds for the city's school
crossing guard program shall be added to each fine imposed for each parking violation,
as authorized by state law.
(g) General Penalty: In this Chapter, where no specific penalty is provided, and an act is
prohibited or declared to be unlawful or identified as an offense, or whenever in this
Chapter the doing of an act is required or the failure to do an act is declared to be
unlawful, the violator of any pplicable provision shall be liable for payment of a fine of
thirty-five dollars ($35.00).

Section 3. That Article III, entitled "Parking, Stopping and Standing" of Chapter 25,
entitled "Traffic", Division 3, entitled "Parking Meters", and specifically Section 25-86, "Paying
for Parking by use of appropriate coins or currency; time restrictions; parking within metered
space" of the City Code of Ordinances, is amended to read as follows:
Sec. 25-86. -Paying for parking by use of appropriate coins,OF currency or credit or debit
card; time restrictions; parking within metered space or metered lot.
(a) When a parking control device commonly known as a parking meter or multi-meter device
is erected adjacent tot of in front of or in the vicinity of a particular parking space or lot
within the city or within a city parking lot, no person shall stop, stand or park a vehicle in
that metered parking space or lot without paying the appropriate U.S. coin(s),of currency or
making_a payment by credit or debit card for the amount of parking time desired.
(b) Unless notice to the contrary is posted in the metered parking lot or on the parking meter,
meters within the city shall be enforced every day. The city manager may restrict the
maximum length of time that any individual vehicle may remain in a particular metered
space or parking lot, whether or not a coin, er currency or credit or debit card is used
for payment and notice of such restrictions shall be posted on the meter or on a parking
control device in the vicinity of the meters, to which such a restriction applies.
(c) It is prohibited to back a vehicle into any marked parking space in a metered space or
metered lot. Every vehicle shall be parked wholly within a marked parking space with the
front end of such vehicle immediately in front of or adjacent to the curb or parking wheel
stop for such space, as provided by the pavement markings.
Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.

Section 6. That this Ordinance shall take effect immediately upon its passage and
adoption.
