HomeMy WebLinkAboutR-2018-026 - Stirling Alya LLC Site Plan (SP-101-17) Variances (VA-04-18 VA-05-18 VA-06-18 VA-10-18) and Declaration of Restrictive Covenants RESOLUTION NO. 2018-026 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-101-17), VARIANCES (VA-04-18, VA-05-18, VA-06-18, VA-10-18), AND APPROVAL OF DECLARATION OF RESTRICTIVE COVENANTS, SUBMITTED BY STIRLING ALYA LLC FOR PROPERTY LOCATED AT 2851 STIRLING ROAD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A" ("PROPERTY"), A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements", Article 635, entitled "Site Plans", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, STIRLING ALYA LLC ("Applicant") is requesting Site Plan (SP-101-17) approval to permit the development of 197 mid-rise units at 2851 Stirling Road in the City of Dania Beach, Florida, (the "City"), as legally described in Exhibit"A"; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances", Section 625-40, entitled "Variance Review Criteria; City Action", states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a variance from the allowable building separation to allow 20 feet, 1 inch between buildings, where 215-120(C) of the LDC requires the distance between buildings to be no less than forty (40) feet(VA-04-18); and WHEREAS, the Applicant has requested a variance of the impervious surface requirement to allow 73% impervious surfaces, where Section 215-130(A) of the LDC provides that impervious surfaces shall not exceed sixty-three (63) percent for open space (VA-05-18); and WHEREAS, the Applicant has requested a front yard setback variance to allow a front yard setback of 13 foot and 2 inches (along Lakeshore Drive), where Section 205-10 of the LDC requires a minimum front yard setback of 25 feet(VA-06-18); and WHEREAS, the Applicant has requested a sign variance to allow two (2) monument signs with the following specifications: Sign 1: on Stirling Road with two (2) sign faces not to exceed a height of 8 feet and 7 inches, a maximum sign area of 63 square feet, and maximum letter height of 10 inches Sign 2: on Lakeshore Drive with two (2) sign faces not to exceed a height of 5 feet, a maximum sign area of 36 square feet, and a maximum letter height of 10 inches where Section 505-70(C)(7)of the LDC allows residential developments with at least fifty (50) dwelling units one (1) monument sign with two (2) sign faces or one (1) entrance feature sign for each street entrance into the development, each not to exceed a height of eight (8) feet, a maximum sign area of thirty-six (36) square feet, and a maximum letter height of eighteen (18) inches (VA-10-18); and WHEREAS, as part of the site plan approval, the Applicant request the City approve the Applicant's recording of the Declaration of Restrictive Covenants in the form attached hereto as Exhibit`B" ("Declaration"); and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 101-17), Variances (VA-04-18, VA-05-18, VA-06-18, VA-10-18), and Declaration will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan(SP-10 1-17), attached as Exhibit "C" which is made a part of and incorporated into this Resolution by reference is approved. 2 RESOLUTION 42018-026 Section 3. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-04-18, VA-05-18, VA-06-18, VA-10-18) are approved consistent with the Site Plan provided in Exhibit"C". Section 4. The Declaration attached in the form of Exhibit `B" is approved to be recorded by the Applicant. Section 5. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Sheets SP-I I and SP-12: Elevation of FPL Transformer Pads not indicated. Mechanical equipment shall be installed at or above Design Flood Elevation (Base Flood Elevation + 1 Foot) (Flood Review). 2. Previous comment not addressed. An arborist report was not included with the current submittal. A large number of specimen trees/palms are proposed for removal. Provide a report from a Certified Arborist, which confirms (or updates as needed) the tree species and size information provided on Sheet TD-2. The Arborist's report also needs to evaluate relocation viability of any specimen trees proposed to be removed. Should any specimen tree be listed as not a viable candidate for relocation, the arborist report must specifically list the justification of how this determination was made, accompanied by photo evidence (LANDSCAPE). 3. Per Sec. 275-190(N), provide a detail and/or clarification that all landscape areas within and adjacent to VUA will be at or below the final VUA grade (LANDSCAPE). 4. Per Sec. 275-190(0), indicate the location of all root barriers. Provide a root barrier detail (LANDSCAPE). 5. Additional Fire Department Access Information as follows: ALL STILL REQUIRED EX. E a. Fire Lane locations and striping detail (demonstrated)by access gates b. "NO PARKING" sign locations and sign details demonstrated by access gates c. Building Accessibility d. Fire Department Access Routes During Construction(FIRE). 6. A detail sheet accompanying the Civil Plans with the following details: ALL REQUIRED EX. C a. Fire Hydrant Detail b. Bollard/Impact Protection Detail for Hydrants, FDC's &DDCV's d. Post Indicating Valve Detail (where applicable) e. Underground Gate Valve Detail (where applicable) f. Backflow Preventor/Double Detector Check Valve (DDCV) Detail (where applicable) that identifies the DDCV as being listed for Fire Use 3 RESOLUTION#2018-026 g. Signage Detail for the Fire Department Connections (where applicable)(FIRE). 7. Minimum radio signal strength for Fire Department communications needed (FIRE). 8. RIGHT-OF-WAY: Provide recorded copy of ROW dedication prior to issuance of a building permit. (PLANNING). 9. The proximity to the airport will require FAA/BCAD review and approval. Per Ordinance No. 2014-071, must provide Recreation and Open Space impact fee of $1,364.00 per multi-family unit. Therefore, ($1,364 X 196 units = $267,344.00) $267,344.00 must be paid prior to issuance of the building permit(PLANNING). 11. Provide dumpster details to ensure compliance with Article 290 of the LDC. • Per Section 290-40 The enclosure shall be six (6) feet in height. Revise detail provided on Sheet ACC 1.1 accordingly. • Per Section 290-70(I) Dumpster enclosure located in residential zoning districts shall be located no further that 150' from any on-site dwelling unit. Identify distance on site plan drawing. • Per Section 290-70(J) enclosures located in residential zoning districts shall be setback at least 25' from any dwelling unit. Provide measurement from neighboring residential property (PLANNING). 12. Per Section 635-50(N) provide a 24" X 36" copy of photometric. Revise plan to make the measurements readable on the north property to confirm the requirements of Article 280 are met (PLANNING). 13. Sheet SP-1 revise Site Information table to identify "Low (5) Residential Land Use" as Past Land Use designation(PLANNING). 14. Sheet SP-1 Revise Regulatory Guidelines to identify "Allowed Max — 23.74 du/gross acres (201)" (PLANNING). 15. Sheet SP-1 drawing shows setback from Stirling Road as 89'4"; Regulatory Guidelines table identifies 93'. Revise accordingly (PLANNING). 16. Sheet SP-1 drawing shows setback from Lakeshore Drive at 13'2"; Regulatory Guidelines table identifies 15'. Revise accordingly. Sheet SP-1 drawing shows setback from rear as 40'/74'; Regulatory Guidelines table identifies 46'9"/73'9". Revise accordingly (PLANNING). 17. Sheet SP-1 drawing shows interior side setback as 15'/82'10"; Regulatory Guidelines table identifies 11'8"/90'. Revise Accordingly(PLANNING). 4 RESOLUTION#2018-026 18. Per Section 265-110(I)(1) all required off-street parking spaces shall be clearly delineated by a single 4" wide, white painted striping. Revise parking stall detail on Sheet C6 accordingly (PLANNING). 19. A condition of approval of the FLU Plan Amendment by Broward County requires payment of$82,000 for affordable housing (PLANNING). 20. Provide recorded copy of declaration of restrictive covenants regarding affordable housing payment(PLANNING). Section 6. That such application must be reviewed by Broward County Aviation Department. The point of contact is William Castillo, Airport Planner located at 220 S.W. 45 Street, Suite 101, Dania Beach, Florida, 33312, (954) 359-6100. Section 7. That pursuant to LDC Section 635-100 "Expiration of Site Plans" and Section 625-50 "Expiration of Variances," the Site Plan (SP-101-17) and Variances (VA-04-18, VA-05-18, VA-06-18) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 8. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 5 RESOLUTION#2018-026 Section 10. WITNESSETH: WHEREAS, Owner is the fee simple owner of land located in the City more particularly described in Exhibit "A" ("Property"); and WHEREAS, Owner made an application requesting that the land use plan designation on the Property be changed from 6.7 acres of Low (5) Residential and 1.6 acres of Commerce to Irregular(23.74) Residential to allow for an additional 164 dwelling units ("Application"); and WHEREAS, in connection with the Application, Owner has voluntarily agreed to place certain restrictions on the development of the Property as set forth below in favor of the County and the City. NOW, THEREFORE, in consideration of the foregoing premises and the promises and covenants herein contained, Owner hereby declares that the Property shall be subject to the covenants, restrictions, and regulations hereinafter set forth, all of which shall run with the land and which shall be binding upon all parties having any right, title or interest in the Property or any part thereof, their heirs, successors and assigns. 1. Recitations. The recitals set forth above are true and correct and are incorporated into this Covenant by this reference. 2. Covenants. Prior to the issuance of the first building permit for a dwelling unit on the Property, the Owner shall pay to the City Five Hundred Dollars ($500) per dwelling unit for 8 RESOLUTION#2018-026 the 164 additional dwelling units on the Property in the total amount of Eighty Two Thousand Dollars ($82,000), to be used by the City towards the City's affordable housing programs ("Affordable Housing Contribution"). 3. Release. Upon presentation to the County of evidence of payment of the Affordable Housing Contribution, at the request and expense of Owner, the County and City shall cause a release and termination of this Agreement in the form attached hereto as Exhibit B to be recorded in the Public Records of Broward County, Florida, evidencing such completed performance of this Covenant. The issuance of the release shall not require County or City Commission approval. 4. Amendments. Except as otherwise provided herein, this Covenant shall not be modified, amended or released as to any portion of the Property except by written instrument, executed by the then owner or owners(s) of the portion of the Property affected by such modification, amendment, or release and approved in writing by the County and City. The appropriate governmental authority of the County and City shall execute a written instrument effectuating and acknowledging such modification, amendment or release. Any amendment, modification or release of this Covenant shall be recorded in the Public Records of Broward County, Florida, at the then owner's sole expense. 5. Recordation and Effective Date. This Covenant shall not become effective and shall not be recorded in the Public Records of Broward County, Florida, until after approval by the County and City of the requested Application and the expiration of all appeal periods or, if an appeal is filed, the conclusion of such appeal in a manner that does not affect the County's or City's approval the Application. Once recorded, this Covenant shall run with the land for the sole benefit of the County and City and shall bind all successors-in-interest with respect to the Property. This Covenant shall not give rise to any other cause of action by any parties other than the County or City, and no parties other than the County or City shall be entitled to enforce this Covenant. Any failure by the County or City to enforce this Covenant shall not be deemed a waiver of the right to do so thereafter. 6. Severability. If any court of competent jurisdiction shall declare any section, paragraph or part of this Covenant invalid or unenforceable, then such judgment or decree shall have no effect on the enforcement or validity of any other section, paragraph or part hereof, and the same shall remain in full force and effect. The agreed upon venue shall be Broward County, Florida. 7. Captions, Headings and Titles. Articles and paragraph captions, headings and titles inserted throughout this Covenant are intended as a matter of convenience only and in no way shall such captions, headings or titles define, limit or in any way affect the subject matter or any of the terms and provisions thereunder or the terms and provisions of this Covenant. 8. Context. Whenever the context requires or admits, any pronoun used herein may be deemed to mean the corresponding masculine, feminine or neuter form thereof, and the singular form of any nouns or pronouns herein may be deemed to mean the corresponding plural form thereof and vice versa.
