HomeMy WebLinkAboutR-2018-033 - Modifying the contract amount with Miguel Lopez Jr., Inc. for the SW 26 Terrace Drainage Project RESOLUTION NO. 2018-033 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO MODIFY THE CONTRACT WITH MIGUEL LOPEZ JR. INC. FOR THE SW 26TH TERRACE DRAINAGE PROJECT CONTRACT; REDUCING THE CONTRACT AMOUNT FROM SEVEN HUNDRED ELEVEN THOUSAND EIGHTY TWO DOLLARS AND TWENTY FOUR CENTS ($711,082.24) TO SIX HUNDRED NINETY FOUR THOUSAND SIX HUNDRED TWENTY EIGHT DOLLARS AND SIXTY FOUR CENTS ($694,628.64) FOR A NET FINAL CHANGE ORDER REDUCTION IN THE AMOUNT OF SIXTEEN THOUSAND FOUR HUNDRED FIFTY THREE DOLLARS AND SIXTY CENTS ($16,453.60);PROVIDING FOR CONFLICTSFURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a construction bid was awarded October 10, 2016 and an Agreement was approved in an amount of Seven Hundred Eleven Thousand Eighty Two Dollars and Twenty Four Cents ($711,082.24) with Miguel Lopez Jr. Inc. for the Southwest 26 Terrace Drainage Project; and WHEREAS, On May 9, 2017, Resolution 2017-045 was approved for a change order in the amount of Twenty Eight Thousand Five Hundred Forty Six Dollars and Forty Cents ($28,546.40); and WHEREAS, allowances in the form of permit fees of Ten Thousand Dollars ($10,000.00) and a project contingency amount of Thirty Five Thousand Dollars ($35,000.00) for a total of Forty Five Thousand Dollars ($45,000.00) was included in the original contract cost in anticipation of any change orders that might be encountered during construction, and WHEREAS, Twenty Eight Thousand Five Hundred Forty Six Dollars and Forty Cents ($28,546.40) of the contingency and permit allowance was utilized to fund Change Order #1, leaving a remaining unspent balance of Sixteen Thousand Four Hundred Fifty Three Dollars and Sixty Cents ($16,453.60); and WHEREAS, the remaining project contingency and permit allowance of Sixteen Thousand Four Hundred Fifty Three Dollars and Sixty Cents ($16,453.60) will not be utilized and therefore results in a final reduction change order, modifying the contract amount to be paid to Miguel Lopez Jr. Inc. to Six Hundred Ninety Four Thousand Six Hundred Twenty Eight Dollars and Sixty Four Cents ($694,628.64); NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are true and correct and they are incorporated into this Resolution by this reference; Section 2. That the City Commission authorizes the City Manager to modify the contract amount to Six Hundred Ninety Four Thousand Six Hundred Twenty Eight Dollars and Sixty Four Cents ($694,628.64) with a final reduction change order in the amount of Sixteen Thousand Four Hundred Fifty Three Dollars and Sixty Cents ($16,453.60). Section 3. That all remaining ftmding for the SW 26th Terrace Drainage Project shall be closed and return to the Stormwater Fund. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to such documents as are deemed necessary and proper for the best interests of the City. Section 5. That all resolutions or parts of Resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on March 13, 2018.
