A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
APPROVE CHANGE ORDER NO. 2 IN THE AMOUNT OF SEVEN
THOUSAND NINE DOLLARS AND SIXTY CENTS ($7,009.60) WITH DP
DEVELOPMENT OF THE TREASURE COAST, INC. FOR THE OASIS XIII
NEIGHBORHOOD IMPROVEMENT PROJECT; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, advertisements for bids were placed in local newspapers in August, 2017
for the OASIS XIII Neighborhood Improvement Project, and a mandatory pre-bid meeting was
held on August 20, 2017; and
WHEREAS, the City of Dania Beach opened the sealed bids for the OASIS XIII
Neighborhood Improvement Project on September 15, 2017 at 10:30 a.m.; and
WHEREAS, there were four bids that were submitted; and
WHEREAS, the apparent lowest bidder, DP Development of the Treasure Coast, Inc.
had two minor defects in the bid consisting of a missing insurance certificate and a minor
addition error, neither of which appeared consequential or altered the bid order; and
WHEREAS, the Bid Review Committee recommended to award the contract to DP
Development of the Treasure Coast Inc.; and
WHEREAS, the City Commission awarded the bid in an amount of One Hundred Fifty
Three Thousand Five Hundred Eighty Dollars and Eighty Cents ($153,580.80) to the lowest
bidder DP Development with Resolution 2017-134 for the Project; and
WHEREAS, The City Manager approved Change Order No. 1 in the amount of Twenty
Four Thousand Four Hundred Ninety Dollars ($24,490.00)that addressed issues on Northeast 2"d
Avenue; and
WHEREAS, the Project is almost complete and a final project closeout change order
needs to be issued; and
WHEREAS, the final change order will close out the OASIS XIII Project resulting in
remaining funds of Four Thousand Four Hundred Nineteen Dollars and Sixty Cents ($4,419.60);
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA,AS FOLLOWS:
Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission approves Change Order No. 2 for DP
Development of the Treasure Coast, Inc. for pavers, headers and handicap ramps in the amount
of Seven Thousand Nine Dollars and Sixty Cents ($7,009.60), and authorizes the City Manager
to sign the change order.
Section 3. That the City Manager and City Attorney are authorized to make minor
revisions to such documents as are deemed necessary and proper for the best interests of the
City.
Section 4. That funding for DP Development of the Treasure Coast Change Order
No. 2 is available and will be appropriated from the Capital Projects OASIS XIII Account No.
301-39-34-541-63-10.
Section 5. That the OASIS XIII Project is closed and remaining funds in the amount
of Four Thousand Four Hundred Nineteen Dollars and Sixty Cents ($4,419.60) will be returned
to the General Fund.
Section 6. That all resolutions or part of Resolutions in conflict with any of the
provisions of this Resolution are repealed.
Section 7. That this Resolution shall become effective immediately upon its passage
and adoption.
