A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-123-17) AS
SUBMITTED BY BARI DRORE,FOR THE APPLICANT DRORE SPEC HOMES
LLC,FOR THE DEVELOPMENT OF THE PROPERTY LOCATED AT 3260 SW
44TH ST, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY
DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS
RESOLUTION;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code"
(the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635,
entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a
building permit; and
WHEREAS,Bari Drore,Drore Spec Homes LLC(the"Applicant"),is requesting Site Plan
approval to permit the construction of a proposed 15 Town Homes residential development(SP-123-
17) as referenced in Exhibit `B," for property located at 3260 SW 44t' Street in the City of Dania
Beach,Florida(the"City"),as legally described in Exhibit"A",both Exhibits are made apart of and
incorporated into this Resolution by this reference; and
WHEREAS,the City Commission conducted a duly noticed public hearing in accordance
with Article 610 of the LDC; and
WHEREAS,the City Commission finds that the approval ofthe proposed Site Plan(SP-123-
17) is consistent with the City's Land Development Code and Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being
true and correct,and they are made a part of and incorporated into this Resolution by this reference.
Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development
Review Procedures and Requirements,"Article 635"Site Plan,"the Site Plan(SP-123-17),attached
as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is
approved.
Section 3. The approvals granted by this Resolution are subject to the Applicant's
compliance with the following conditions:
1) Provide value of all specimen trees, including those proposed to remain, per Sec. 275-80
(Landscape).
2) Add a note on Sheet T-1 that per Sec. 825-140(C),a payment to the Tree Trust fund will be
made in the amount of$3,037, which is equal to the value of specimen trees proposed for
removal (Landscape).
3) The amount of canopy removed and amount of mitigation required listed on sheet T-1 is
incorrect.
a. The total canopy removed is listed as 4,944 SF. This does not total all tree canopies
being removed. Provide to total canopy proposed for removal.
b. Any tree that is considered to be dead,diseased,or danger of falling should be clearly
marked as such on the tree table.Note that mitigation for such trees is 1:1 per Sec. 825-
60.
C. The mitigation amount is listed as 4,944SF with 4,950SF of mitigation being
provided. The provided mitigation amount of 4,950SF is calculated correctly;however,
the amount of canopy being removed is not the total required mitigation. Per Sec. 825-
100, trees being removed on all new or amended developments shall be mitigated an
additional 50 percent(150% of canopy removed).
d. For tree species identified as category 1 invasive on the current version of the Florida
Exotic Pest Plan Council's Invasive Species List,the canopy shall be mitigated at a rate
of 25%,per Sec. 825-100.Note that the 150%canopy mitigation still applies for new and
amended developments(Example:Invasive Canopy SF x 25%x 150%=mitigation SF).
e. The mitigation should be clear on how it was calculated. List the canopy removed
and mitigation required for category 1 invasive trees,non-category 1 invasive trees,and
(if any) dead, diseased, or in danger of falling trees. You may provide an excel
spreadsheet via email to daniel.parobok@metriceng.com for review and comment to aid
in coordination(Landscape).
4) Sheet L-1 lists green buttonwood as a shade tree. Note that this species does not meet the
requirements of Shade/Canopy tree as defined in Sec.275-190.Provide an alternative species
to be counted toward the shade tree requirement (Landscape).
5) On Sheet L-1,one MG tree symbol appears to be on pavement,not in a planting/sodded area,
near the southeast area of the site. Please clarify(Landscape).
6) Fire Department Access Information as follows:
c. Fire Department turn around road needs to be a min of 20 ft wide and 50 ft in length.
STILL REQUIRED Fire Department turnaround 50 feet to start from the tip of the curb next
to Bldg 3 (Fire).
7) Proof of Water Supply& Fire Flow Demand as follows:
a. Building Construction Type and Square Footage(note on plans)STILL REQUIRED

b. Fire Flow Demand Calculations Signed and Sealed by Licensed Engineer STILL
REQUIRED
C. A completed Application for the Approval of the Fire Protection Water Supply
Design(See the last page of this document) STILL REQUIRED
d. Statement of verification from the design professional of record,on official company
letterhead, that the proposed water main sizing, fire hydrant spacing, and fire hydrant
locations, are in compliance with the Broward County Land Use Code and the Florida
Fire Prevention Code. (This document shall bear the seal and signature of the engineer).
STILL REQUIRED (Fire).
8) Your digital signature is non-compliant, please review Statutes and Rules on the FBPE
website (Engineering).
9) Provide geometric dimensions in your civil site plan drawings (Engineering).
10)Review grading scheme between rear of property and proposed swales— seems to be very
steep (Engineering).
11)Adjacent properties are much lower than proposed elevation. Provide retaining wall around
property to contain stormwater within proposed site (Engineering).
12)Off-site Development on SW 44th Street:
• SW 44th Street had been observed to be flood prone. There are two catch basins
without storm pipes fronting the property;developer to provide the missing pipe with
a 12-inch HDPE between the two drainage structures.
• Provide at least 6" deep Swale (V-shape) between proposed sidewalk and edge of
pavement.
• Roadway width of SW 44 Street is only 19 feet per survey,developer to add 1.5 feet
to the existing asphalt pavement within the frontage of the property (Engineering).
13)Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane
Coordinate(NAD 83).This should be addressed as part of the final submittal(Engineering).
14)The proximity to the airport will be required FAA/BCAD review and approval. Contact
William Castillo, Airport Planner with Broward County Aviation Department, located at
2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, (954) 359-6100. NEED
CONFIRMATION LETTER OF APPROVAL FROM FAA/BCAD (Planning).
15)WILDLIFE PROTECTION:Per Article 250,"the developer of any existing natural land area
in excess of one-half(1/2) acre in the city must provide wildlife study. PROPERTY IS
CURRENTLY VACANT WITH NO BUILDING STRUCTURE; PLEASE PROVIDE
WILDLIFE PROTECTION STUDY REFER TO ARTICLE 250 (Planning).
3 RESOLUTION#2018-062
Section 4. That such application must be reviewed by Broward County Aviation
Department. The point of contact is William Castillo,Airport Planner located at 220 S.W.45 Street,
Suite 101, Dania Beach, Florida, 33312, (954) 359-6100.
Section 5. Pursuant to LDC Section 635-100 "Expiration of Site Plans," the Site Plan
(SP-123-17) shall automatically expire and become null and void unless the Applicant files a
complete building permit application with construction drawings for the improvements shown on the
Site Plan, within eighteen(18)months from the date of this Resolution.
Section 6. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and
does not create any liability on the part of the municipality for issuance of the permit if the Applicant
fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal
agency, or undertakes actions that result in a violation of state or federal law.
Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
