Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals There were no presentations on this agenda. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments (taken up after Item 6) Dominique Becker, 5754 SW 24th Avenue, spoke of garbage cans and recycle bins continually being left out all week long, especially on 58th Manor. She noted she has emailed the Code Enforcement Department without receiving a response, and asked the Commission for help. Arthur Razor, 5751 SW 24th Avenue, also complained about trash cans being left out on 58th Manor and getting no response from Code Enforcement. Leroy Green, 326 SW 16th Street, commented he has been watching the Commission meetings and the Commission is doing a good job. He complained about a rat problem in his yard caused by people throwing bread in the street. Sherri Pitts, 42 NW 6 Avenue, Apt. 2, spoke of gentrification and de-incentivization of the African American community in Dania Beach, and said no one is helping the native community. Commissioner Grace noted Dania Beach Economic Development Corporation has built and continues to build many affordable single-family homes in the City for the African American community. She encouraged Ms. Pitts to reach out to her, the Commission, and Broward County Commissioner Ryan to find out what we have done and what we are planning to do. She added we have to get some type of leverage on absentee landlords and slumlords. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity. He noted Commissioner Salvino hosted a Get to Know BSO event last week, and the next one will be held on May 17t' at Vice-Mayor Harris' residence. He advised of the upcoming Law Enforcement Special Olympics Sports Run and Law Enforcement Memorials. Commissioner Grace noted she is seeing a difference in the NW section with all the work we are doing on the streets. Commissioner Salvino thanked BSO and the COP program for the driveway initiative at his house. Sean Brown, Battalion Chief, BSO Fire Rescue, reminded everyone about the Sound the Alarm initiative this Saturday and noted he had applications available. 7. (FIRST READING) Commissioner Salvino motioned to adopt the Consent Agenda; seconded by Commissioner Grace. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 RESOLUTION#2018-062 Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-123-17) AS SUBMITTED BY BARI DRORE, FOR THE APPLICANT DRORE SPEC HOMES LLC, FOR THE DEVELOPMENT OF THE PROPERTY LOCATED AT 3260 SW 44TH ST, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT"A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2018-062 and advised this was a quasi- judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the site plan request. Commissioner Grace asked about the garages and landscaping. Planning & Zoning Manager Lajoie responded the garages are 2-car, and the landscaping is adequate and does not require any variances. Mayor James opened the Public Hearing. Doug Dyszer, owner of 4516 and 4518 SW 33rd Avenue, expressed concern about the elevation of the property being higher, which might affect his property with flooding. Planning & Zoning Manager Lajoie responded developers are required to have the finished floor of the building to be one foot above FEMA. The lot will likely have to be raised; one of the engineer's comments is that the developer put up a retaining wall to contain the water on their site so they do not flood the neighboring property. John Maxham, 3261 SW 44 Street, commented he is concerned about the impacts on this area, especially the blocking of driveways and roads during construction. He will not put up with blocking his driveways at any time of the day. The demolition was not handled right and since the trees have been removed,people are using the property as a dumping yard. Commissioner Grace said she wants to make sure our Code Department is in alliance with what Mr. Maxham is asking for. She added this City is very concerned about our trees and is trying to make a positive,not negative, difference. Mayor James asked Assistant City Manager Donnelly to get with Code to follow up on this to make sure that things are being handled appropriately. Mr. Maxham questioned the entrance and exit to the property, and said it is directly across the street from him. He asked for assistance from the City, especially during the construction phase. Commissioner Salvino asked if we could send our commercial vehicle enforcement unit out to put pressure on them to follow the rules. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. Seeing as there was no one to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Salvino motioned to adopt Resolution #2018-062; seconded by Commissioner Grace. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte thanked Mayor James and CRA Director Williams for participating in the Senior's Spring Bonnet Luncheon at I.T. Parker. Commissioner Brandimarte spoke of Commissioner Salvino's Driveway Initiative event, and commended Captain Marks for stepping in when required in response to a resident who verbally attacked the Commission. Commissioner Brandimarte addressed the homeless situation in front of the closed Winn Dixie on Dania Beach Boulevard and her efforts to combat it. She noted when we had the problem at Smith's store, we took action; we need to do something about this and make it a priority with the owner of Winn Dixie to put up no loitering signage and a spotlight on the end of their building. She urged the Commission to join her in resolving this problem. Commissioner Brandimarte commented there is also a huge issue at the intersection of Federal Highway and Dania Beach Boulevard with homeless people soliciting hotel guests walking to dinner. She added there are homeless people living under the outside stairwell at City Hall. Mayor James questioned if Winn Dixie would want to sell and noted she supports efforts to make the owner police their area. 11.2 Commissioner Grace Commissioner Grace spoke of the Father/Daughter dance at the Gallery of Amazing Things. Commissioner Grace noted she has enjoyed going to The Fish Grill. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. Commissioner Grace also noted the 6th Annual Family and Fun Day will be held on May 5t' at CW Thomas Park. 11.3 Commissioner Salvino Commissioner Salvino had no comments. 11.4 Vice-Mayor Harris Vice-Mayor Harris asked if construction has stopped on the new marina behind the church. Planning and Zoning Manager Lajoie responded they are in the permit process; they may have started preliminary ground work, but nothing has started to come out of the ground yet. Vice-Mayor Harris asked about the demolition permits for the Tru Hotel. Planning and Zoning Manager Lajoie noted she would have Community Development Director LaFerrier contact him. Vice-Mayor Harris questioned the status of the parking lot at the Casino. Planning and Zoning Manager Lajoie responded they have a text amendment in process that will allow the use as a special event under the temporary use category. Vice-Mayor Harris commented he talked to Scott Bruner, Broward County Traffic Engineer, about potentially installing crosswalks in the mid-block on Federal Highway. Vice-Mayor Harris noted the Wyndham Garden Hotel will soon be hiring. Vice-Mayor Harris said a lot of local commissioners have the option if they are traveling on official city business to call in to the commission meeting or do a join me online. City Attorney Ansbro noted the Sunshine Law requires commissioners to be physically present if they can be. We have done it on rare occasions; it is really an exception. Vice-Mayor Harris reported code issues at 707 NW 10t' Avenue; Code Enforcement needs to take a look at this neighborhood. 11.5 Mayor James Mayor James spoke of the Father/Daughter Dance hosted by the Tamara James Foundation. Mayor James commented on the business across the street from City Hall continuing to block traffic; something needs to be done. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. City Attorney Ansbro said BSO is citing them. In the long term, they are relocating to Fort Lauderdale and this facility will be gone. He noted they are going to the Code Magistrate next week for other violations. They are accruing a fine of$250 per day for the work that has been going on, which will come back to the Magistrate to deal with. His recommendation will be to not mitigate it at all. Mayor James addressed the trees that are gone from NW 1st Street and requested we go back to the drawing board as she does not want the Spanish Stopper trees for NW 1" Avenue. She felt the trees are not appealing. Commissioner Grace agreed and said NW Byrd Point Civic Association and department heads should take a look at varieties of trees that we can use. Assistant City Manager Donnelly responded we will find alternative trees and get back to the Commission; we have to find a tree that grows slowly and will not grow into the power lines. 12. Appointments 12.1 Marine Advisory Board Commissioner Salvino confirmed that two members need to drop off the board in order to reduce the membership to 10 members. Commissioner Grace removed Ronald Brozic. Commissioner Brandimarte removed Arthur Perseo. Vice-Mayor Harris took over Joe White, one of Commissioner Salvino's appointees, to fill his vacancy. Commissioner Grace motioned to approve the appointments; seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager Assistant City Manager Donnelly noted the Public Services Department made an application to the Florida League of Cities for the Florida Municipal Achievement Award in the category of Environmental Stewardship. The project for submission for an award, which requires the Commission's endorsement, is the City's efforts in working with the Department of Agriculture to eradicate the conehead termite in Dania Beach. The Commission consensus was to move forward with the application. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. 13.2 City Attorney City Attorney Ansbro advised he met with BSO and Code Compliance about the Motel 6 problem and they decided to use the Code Magistrate rather than the Nuisance Abatement Board. Mayor James addressed the auditor contract. She was under the assumption we were going to get an opinion letter to ask to clarify the state law. The opinion letter was very biased and was not objective; it was very leading and swayed to a side to where it stated how far the contract was expired. The situation with the auditor has gotten out of control. The opinion letter is totally swaying to one side. She wants an unbiased letter asking the Attorney General what the interpretation of the law is because the majority voted to extend the contract. The letter did not properly state the feelings of what happened here. Commissioner Grace felt we need to revise the letter to state exactly what we said, send it to the Attorney General and wait for the opinion. Commissioner Salvino commented City Attorney Ansbro is our legal advisor and he advised us against this as he feels it is wrong; he does not know if it is biased or not, but he is sure the City Attorney is following the letter of the law. Until we get a letter back from the Attorney General that states we can do it, we have not lost anything because the contract can be renewed if we choose to renew it. He understands we do not need an auditor until around August; by that time we should have a letter back from the Attorney General. We should trust City Attorney Ansbro's judgement. Commissioner Brandimarte asked City Attorney Ansbro why he didn't send out the letter when they asked him to. City Attorney Ansbro explained the Commission voted on this on March 27; it came to light the next day that the contract expired March 28. After that, we found out HCT wanted more money, and it was brought back to the Commission on April 10. He had the letter drafted but did not send it pending the vote on funding on April 10, which was approved. He then resumed doing the letter, which has a lot of legal research in it. The letter was supposed to go out last Friday; however, Mayor James asked to see a copy before it was sent and was very concerned it did not reflect what the Commission wanted. Mr. Harvey asked if he could look at the letter and comment on it before it was sent. He told Mr. Harvey that Mr. Harvey was not going to write his letter, but he could look at it prior to it going out. Commissioner Brandimarte asked Mayor James what made her think that her interpretation is more professional than our City Attorney. She questioned why it was not followed through the way the Commission asked him to do. She said he obviously put in things that maybe the Mayor wanted slanted. Mayor James said she does not want anything to be slanted at all; it was slanted his way. The reason she asked to see a copy was because of the conversation on the dais where it seemed our attorney's stance on it is very against what three to two voted on. She wanted to ensure the letter Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. was not biased. She is not trying to interpret the law; that is why we are sending it to the Attorney General. We wanted an opinion from the Attorney General to make sure when we voted 3-2 that we were legally able to do so. Commissioner Brandimarte noted she thought that was what our vote was about at the last meeting when City Attorney Ansbro was asked to send it out. She said don't give it to each of us to read, and asked what the Commission has to do with it. Mayor James responded during the discussion, City Attorney Ansbro was very opinionated about this, so she asked to see a copy of the letter. She had nothing to do with the back and forth between him and the auditor; further, she had already asked to see the letter before the matter came back to the Commission. The letter is very biased and almost seems it is his opinion versus the vote; she just wants a clear interpretation of the law. She does not want a letter sent to the Attorney General that is slanted one way or the other; she wants straight facts. She wants what is the Attorney General's interpretation of the law; are we allowed to do this or not. Commissioner Brandimarte asked if Mayor James is planning to second guess the Commission's opinion every time it is made. It looks like it when she is thinking that a lawyer who works for all of us sent a slanted letter; that is the Mayor's opinion. Mayor James said it is a fact because she had a conversation with him and he said he did. Commissioner Brandimarte commented the letter spelled everything out to a T; she saw nothing wrong with it. Mayor James said if Commissioner Brandimarte was on the other side of the argument, she would see something wrong with it. Commissioner Brandimarte said the Mayor is supposed to be on the Commission's side. Mayor James noted we voted 3-2 so that means Commissioner Brandimarte is supposed to be on that side, too. Vice-Mayor Harris commented it is an interpretation of the law. He talked to two other city attorneys through the League of Cities and they said we as the elected officials and the governing board have the right to make an appointment and to extend the contract on a month to month basis or until we get the opinion from the Attorney General. City Attorney Ansbro clarified a renewal has been executed that continues for two years, however, if the Attorney General comes back with an opinion consistent with his opinion, it will automatically terminate. His letter and supportive documentation reflects his interpretation; he has to give the Attorney General the facts upon which he is doing this. He noted he gave the accountant the courtesy to look at it; the only objection was that he emphasized the contract had expired. He will edit it to point out the fact the contract had expired, but the Commission's desire is to renew it. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,April 24,2018—7:00 p.m. Mayor James noted the desire of the Commission when the motion was made was to extend the contract before it expired. City Attorney Ansbro explained that two weeks later the Commission found out they could not have done that because the auditor wanted more money and they had not approved that yet. Mayor James asked if we could retro it to reflect what we voted for. City Attorney Ansbro said when he spoke to the Mayor on Friday about this, he told her if she chose to bring it up to make it retroactive to March 27th, and she has the support of the Commission, it could be done. Commissioner Grace motioned to retroactive the contract to reflect what the Commission voted on, on March 27, 2018; seconded by Vice-Mayor Harris. The motion carried on the following 3-2 Roll Call vote: Commissioner Brandimarte No Vice-Mayor Harris Yes Commissioner Grace Yes Mayor James Yes Commissioner Salvino No City Attorney Ansbro clarified he would send the letter, virtually the same as what he has written, and he will take out the parts emphasizing the contract expired and it will reflect the majority vote to make it retroactive to March 27, 2018. One of our first concerns is in the area of South West 24th Avenue and 58th Manor. Unfortunately, many people on 58th Manor, for some reason, are inclined to leave their garbage bins out at the street all week long, rather than move them back to the side or back of their homes.
