A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
PURCHASE SERVICES FROM DECOTA CONSTRUCTION IN THE
AMOUNT OF TWENTY SIX THOUSAND NINE HUNDRED DOLLARS
($26,900.00) FOR THE DEMOLITION OF PROPERTY LOCATED AT 705 SW
12TH AVENUE WITHOUT COMPETITIVE BIDDING AND WITHOUT
ADVERTISEMENT FOR BIDS, FOR A PROJECT THAT WILL EXCEED
THE ANNUAL VENDOR THRESHOLD OF TWENTY FIVE THOUSAND
DOLLARS ($25,000.00) FOR A SINGLE VENDOR IN A FISCAL YEAR;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids if he is authorized to do so in
advance by a resolution adopted by the City Commission; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations", subsection
(a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor for
each fiscal year; and
WHEREAS, the City desires to be prepared to demolish two structures located on a
property it expects to acquire by purchase, which property is located at 705 SW 12t`Avenue; and
WHEREAS, the Public Services Department has obtained three written quotes and
determined that such demolition services can be obtained at the least cost to the City, without
competitive bidding and without advertisements for bids from DECOTA Construction, a proposal
for which is attached as Exhibit "A" in the amount of Twenty Six Thousand Nine Hundred
Dollars ($26,900.00); and
WHEREAS, the City has already approved contracts with DECOTA Construction during
FY 2018 in the amount of Forty Seven Thousand Dollars ($47,000.00) for other services
unrelated to this project and therefore, the Public Services Department is seeking approval to
exceed the Twenty Five Thousand Dollars ($25,000.00) annual vendor threshold for a single
vendor; and
WHEREAS, the Public Services Director is seeking additional contingency funds of Five
Thousand Dollars ($5,000.00) above the contract cost for permits and any unforeseen costs which
may arise during the demolition process, bringing the total not to exceed for the project to Thirty
One Thousand Nine Hundred Dollars($31,900.00);
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they
are made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission authorizes the City Manager to purchase
services from DECOTA Construction for the demolition of structures located at 705 SW 12t`
Avenue, after acquisition of the property pursuant to a purchase by the City; a copy of the
proposal is attached as Exhibit "A", and made a part of and is incorporated into this Resolution
by this reference.
Section 3. That funding for these services shall be appropriated from the Commission
Contingency Account No. 001-18-00-519-99-10 which has a current available balance of Eighty
Five Thousand Eight Hundred Ninety Four Dollars ($85,894.00) to the Capital Projects 705 SW
12t' Avenue Demolition Project Professional Services Account No. 301-18-10-519-31-10 in an
amount not to exceed Thirty One Thousand Nine Hundred Dollars ($31,900.00), leaving a
remaining balance of Fifty Three Thousand Nine Hundred Ninety Four Dollars ($53,994.00) in
the Commission Contingency Account.
Section 4. That the City Manager and City Attorney are authorized to make minor
revisions to the necessary documents as are deemed necessary and proper and in the best interest
of the City.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Any service not otherwise included in this agreement will require and executed change order.
Additional Terms:
A. Unless otherwise provided, this agreement shall be governed by the law of principal place of business
of the Architect;

Any addition, alterations or deviations from the scope of work specified above involving
extra cost will be executed only upon written orders with payment upfront, and will
become an extra change over and above the estimate. All agreements are contingent
upon strikes, accidents, or delays beyond our control.
Terms of Payment:
25% deposit prior to job start, 25% when the 1st week of demolition on Site, 25% when i
the house above ground structure demolition complete, Final Payment once job done.
ACCEPTANCE OF PROPOSAL:The prices,specifications and conditions are satisfactory and are
hereby accepted. You are authorized to do the work specified. Payment will be made as specified.
Proposal is subject to change if not accepted within 60 days.
