Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Thomas Schneider Absent: Commissioner: Chickie Brandimarte Commissioner Grace motioned to excuse the absence of Commissioner Brandimarte; seconded by Commissioner Salvino. The motion carried unanimously. 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals Mayor James recognized the Dania Soldiers basketball team. 3.1 Legislative Wrap Up - Representative Joseph Geller(taken up after Item 5) Representative Geller gave an overview of this year's legislative session, and noted the legislature has been assaulting home rule. He described the details of the gun bill and the Governor's line item for school safety. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Patricia Tyra, 2912 SW 54th Street, noted this week is National Nurses Week. She spoke of the Dania Beach signage on the grounds of the BSO station at 30th, and asked if it could be moved to the median of the street to highlight the entrance to Dania Beach. She added she is disappointed with the new City seal. Carol Hemmis, 214 SW 61h Street, complained of problems with the roundabouts on SW 4th Street in Dania Beach Heights; stop signs have been replaced by yield signs on the side streets, and she would rather have speed bumps or the stop signs back. Shaun DeRosa, 408 SE 5th Street, spoke about his concerns with Airbnbs, no access to I-95 express lanes for Dania Beach residents, and flooding at the Walmart Plaza. Vice-Mayor Harris noted corrections to fix the flooding were made but it is hard to measure because we have not had any rain. He added I-95 express lanes are governed by FDOT and we do not have any jurisdiction over it; he will invite Mr. DeRosa to the next MPO meeting to speak to them. Mayor James noted she will call Mr. DeRosa about possible remedies. We have been addressing concerns with Airbnbs, and it is a priority to her. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, rerted on recent criminal activity and noted the next Get to Know BSO event will be on May 17 at Vice-Mayor Harris' house. Deputy Chief Gregory Holness, BSO Fire Rescue, gave an update on the Sound the Alarm initiative by the Red Cross. 7. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.5; seconded by Vice-Mayor Harris. The motion carried unanimously. 7.5 RESOLUTION#2018-065 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO PURCHASE SERVICES FROM DECOTA CONSTRUCTION IN THE AMOUNT OF TWENTY SIX THOUSAND NINE HUNDRED DOLLARS ($26,900.00) FOR THE DEMOLITION OF PROPERTY LOCATED AT 705 SW 12TH AVENUE WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, FOR A PROJECT THAT WILL EXCEED THE ANNUAL VENDOR THRESHOLD OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00) FOR A SINGLE VENDOR IN A FISCAL YEAR; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution 92018-065. Commissioner Salvino asked why we did not go out to bid. City Manager Baldwin noted we are trying to get this done quickly. Brad Kaine, Director of Public services, explained this was done because of the length of time to go out to bid and we want to get it done immediately. He noted we used this firm for Smith's. Commissioner Grace motioned to adopt Resolution #2018-065; seconded by Commissioner Salvino. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2018-008 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 8, ENTITLED "SEAL" OF PART I, "THE MUNICIPALITY OF THE CITY OF DANIA BEACH", ARTICLE 1, ENTITLED "GENERAL PROVISIONS", OF THE CITY CHARTER TO DESIGNATE THE NEW OFFICIAL SEAL OF THE CITY, AS AUTHORIZED BY FLORIDA STATUTES, SECTION 165.043, ENTITLED "OFFICIAL COUNTY OR MUNICIPAL SEAL"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Commissioner Grace motioned to adopt Ordinance #2018-008, on second reading; seconded by Commissioner Salvino. The motion carried on the following 4-0 Roll Call vote: Commissioner Grace Yes Vice-Mayor Harris Yes Commissioner Salvino Yes Mayor James Yes City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.2 ORDINANCE#2018-009 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE REQUEST MADE BY VANESSA WILLIAMS, PASTOR/PRESIDENT FOR THE PROPERTY OWNER THE BIBLICAL HOUSE OF GOD NONE OTHER CHURCH, INC., TO REZONE PROPERTY GENERALLY LOCATED AT 819 SW 12TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM NEIGHBORHOOD RESIDENTIAL (NBHD-RES) DISTRICT TO GENERAL INDUSTRIAL DISTRICT (C-1), (RZ-16-18) SUBJECT TO CERTAIN RESTRICTIONS, PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2018-009. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the rezoning request. Mayor James noted she is concerned with parking issues because they are trying to reconstruct this to make it larger. Planning & Zoning Manager Lajoie said they are planning to start over with a new structure, which will require a site plan review. They have not submitted a site plan at this time. Commissioner Grace asked if notices were sent out to residents and how many parking spaces they currently have on the property. Planning & Zoning Manager Lajoie confirmed notices were sent and they have seven parking spaces, which are in front of the structure. Commissioner Grace said she knows this is going to pose a problem with some of the residents in the area. She is not comfortable changing the zoning in this residential area. Pastor Vanessa Williams, applicant, noted they reached out to many of the residents and are not trying to be problematic, but are trying to make a difference in the community. They will continue to do the work they do, but their hands are tied because City code does not allow them to reconstruct or do a facelift. This will not negatively affect any of the surrounding properties. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Her church has been there over 40 years; they want to improve the church and avoid code violations. Commissioner Salvino asked if they were increasing the size of the church. Pastor Williams said yes, up to 4,000 square feet. It was formerly a rooming house. Commissioner Salvino felt the problem is the size of the new church, along with the parking issues, and suggested she present a site plan. Pastor Williams commented she had the site plan and a rendering, but cannot retrieve it from her IPad. She noted the current seating is 25-30 seats; they are upgrading to possibly 86 seats. The rendering indicates 20 parking spaces. Vice-Mayor Harris said he has no problem with the church, but we do need to see the site plan. Mayor James opened the Public Hearing. Pastor Trenell Bryant, fellow pastor with Pastor Williams, spoke in support of the rezoning. Tommie Robinson, 1625 NW 18th Avenue, Fort Lauderdale, spoke on behalf of her church in support of the rezoning. Starr Petty, 7907 SW 3rd Street,North Lauderdale, addressed concerns other churches in the area are having. Kevin Powell, 7907 SW 3rd Street, Margate, spoke in support of the church. Jeffry Deas, 2955 NW 33rd Way, Fort Lauderdale, spoke in favor of the zoning request. Marie Aviles, 813 SW 12th Avenue, lives adjacent to the property, and spoke in opposition to the request. Cecille Collins, 722 SW 7 Terrace, expressed concerns about changing the zoning and the impacts it would have. Dominque Aviles Huckabee, Pembroke Pines, said her mother is Marie Aviles, and expressed concerns about the church's service to the community. Bettie Ellis, 143 NW 71h Avenue, spoke in support of the rezoning. Juliana Williams, 735 SW 12th Avenue, spoke in support of the request. Michael Johnson, 813 NW 3rd Street, noted there would not be enough room to park, and spoke in opposition to the request. He felt they should put a portable structure in there. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Salvino said because they are not ready and there are only four Commissioners present, it could hurt them if the vote was split or lost, and they would not be able to come back. He suggested they would be better off if they waited until the fifth Commissioner is here and came back to present their plan in full with the site plan. Commissioner Grace agreed; we should not be voting on this. If the site plan is presented to us, we as elected officials have to make sure we do what is necessary for the residents of Dania Beach. She suggested we table the item until the applicant brings back a site plan in two weeks. Planning & Zoning Manager Lajoie said the applicant likely has a drawing and she explained the site plan process, which would be about three months from a public hearing. She noted they could show the Commission what they are planning,to give them a point of reference. Mayor James noted she wants to know the impact on taxes in the neighborhood if the zoning is changed and to see a rendering of what is proposed. Her concern is the safety of the residents and people occupying the space; she wants to see how the parking spaces would fit there. She confirmed they are proposing to make it a 2-story church and questioned if it would interfere with residents' privacy. The community needs to come to a compromise so they get what they want. Commissioner Grace motioned to continue Ordinance #2018-009, on first reading, until the May 22, 2018 City Commission meeting at 7:00 p.m. so the fifth Commissioner can be present and the applicant can submit a drawing; seconded by Vice-Mayor Harris. (Continued from April 10,2018) 9.4 RESOLUTION#2018-057 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE "OAKS PLACE PLAT" (PL-13-18) SUBMITTED BY BASELINE ENGINEERING AND SURVEYING, ON BEHALF OF BCD DANIA OAKS, LLC, FOR PROPERTY LOCATED AT 5461 TO 5525 SW 40TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from April 10,2018) Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. City Attorney Ansbro read the title of Resolution #2018-058 and Resolution #2018-057, and noted the applicant is requesting the items be continued until the May 22, 2018 meeting. Alicia Lewis, Greenspoon Marder, noted they are requesting a continuance in order to meet with a few surrounding residents who asked to review the tree survey and visit the site following their last community meeting. They want to make sure they have done everything they could do to bring forward a project the neighbors are proud of. Commissioner Salvino gave a brief history of the project and noted the developer has eliminated all of the variances. This allows him to do the project and there is really nothing the Commission can vote no on. He asked City Attorney Ansbro to explain why this project cannot be turned down by the Commission even though a lot of residents are not happy with it. City Attorney Ansbro noted the case has not come before the Commission yet, but if it is demonstrated that all site plan and plat requirements have been met, it would be difficult for the Commission to deny either. Mayor James questioned if we could be sued for a dollar amount if the requests were denied. City Attorney Ansbro responded they would probably sue to obtain approval for the permit, not money, but it would still cost us money to defend it. Commissioner Salvino said the best we can offer for those residents who are against it is for the developer to continue to work with them to make modifications to the entranceway. He questioned why we cannot vote on this tonight since the fact is we have to vote for it. City Attorney Ansbro noted many people from the neighborhood believe this will be continued tonight and would be deprived of the ability to speak. Attorney Lewis responded to Mayor James regarding why they need another continuance. Mayor James stated she understands some of the comments that have been made, but she will not make the same mistake she did with the Calm project and believe that she will go to jail if she votes no. Mayor James opened the Public Hearing. Dennis McGowan, 5551 SW 40 Avenue, said the neighborhood was not notified about the change; they never received letters and the signs on the property still have April 10 as the date. We should be more informed about these changes. Mayor James asked who is responsible for information on the public hearing signs. City Attorney Ansbro noted typically the sign does not get changed after the notice of the time of the official hearing is advertised in the newspapers and mailed. People at the official hearing Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. would know it was continued. He noted the applicant's attorney indicated they will mail notices of this continuance to the residents. Susan Savor, 5551 SW 40 Avenue, commented it seems like the Commission has to vote for this; she wishes that where she lives, they could have a single family home instead of a double looking at them. She also addressed the loss of trees. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Salvino motioned to continue Resolution #2018-058 and Resolution #2018- 057 until the May 22, 2018 City Commission meeting at 7:00 p.m. and to request the applicant mail notices; seconded by Vice-Mayor Harris. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Street Renaming Policy - City Manager Baldwin Assistant City Manager Donnelly reviewed the information in the agenda packet, and noted only registered voters in the City would be able to sign a street renaming petition. Upon approval, the policy will be put on the website. Mayor James asked if this still includes getting a notary for every signature. Assistant City Manager Donnelly said that was taken out and replaced with the registered voter language. Mayor James asked about renters and property owners. Assistant City Manager Donnelly noted you have to be a registered voter of Dania Beach living on the particular street. Ultimately, the process is set up to have it go through the Planning & Zoning Board to the Commission. The applicants have to show they have public support; there is not an automatic cutoff of percentages. It would come back to the Commission as to whether they have met the burden of ownership or community support. He reiterated this would be a public process where a person would bring public support for the petition to the P&Z Board and then the Commission. Mayor James asked who would be in charge of funding needed to change the street name. She does not want what happened to the residents in Hollywood to happen here. Assistant City Manager Donnelly responded we created a higher burden for the street renaming than the co-designation because it does have an adverse effect on the residents. We wanted to make it a harder process so that unless residents were really into it, that would not happen to them. There would be an application fee and costs for the advertising, but the effects of the renaming would be borne by the residents. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Commissioner Salvino felt street renaming is complicated and it should have support of the residents of the City who are registered voters; it is their right to want to change the name or not to want to do it. Assistant City Manager Donnelly explained the renaming is a two-part petition; one is letters of support, the other is residents on the street who are registered voters have to sign it. Ultimately, petitions will be signed, turned in, and reviewed for validity, which would provide information about who lives on the street. Additionally, there would be letters from community groups in support and it would go through a hearing similar to a variance. Certain requirements in the policy could be waived by the Commission, and the renaming is ultimately the Commission's decision. He said staff tried to make the process as user friendly as possible, and noted possible additional costs to the applicant, including advertising and mailing of notice. Commissioner Grace asked that the policy be brought back in writing so the Commission can take a look at everything that Assistant City Manager Donnelly said. Commissioner Salvino asked if there are other cities with policies to look at. Commissioner Grace asked that it be narrowed down to the logistics of what they are going to be taking action on. She felt a registered voter from anywhere in Dania Beach should be able to request a street be renamed. Assistant City Manager Donnelly noted we will make that change and he will provide more background information on street naming policies. 10.2 Discussion of Financial Advisory Services Contract- Mayor James Mayor James noted the contract will expire in a few months and she does not want what happened with the auditor to happen again; she believes it is the same type of situation. Commissioner Grace asked City Manager Baldwin to bring it back to the Commission to look at with sufficient time before it expires. Vice-Mayor Harris questioned what they do and what kind of advice they are giving. Adam Segal, Assistant Finance Director, responded they provide us with financial scenarios when we need them, such as with the GO refinancing; they have saved us about a million dollars. Their purpose is to advise us on financing and debt. Vice-Mayor Harris asked who in the City they meet with, and said he wants to meet with them. 11. Commission Comments 11.1 Commissioner Brandimarte Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Commissioner Brandimarte was not present. 11.2 Commissioner Grace Commissioner Grace discussed the electric bill she obtained from the Chamber of Commerce, and asked if we could do a wash with it for them because Parks & Recreation is also in the building. She felt we should not charge the Chamber for an electric bill. City Manager Baldwin said the Commission could waive the charge for the electric bill and the City will pay it. Mayor James questioned why the amounts of the bills are so high, and said something does not seem right. Commissioner Salvino motioned that the Chamber of Commerce not pay the bill for $2,250.18 because it is so old and that the City pick up the cost; seconded by Commissioner Grace. The motion carried unanimously. Commissioner Grace motioned that the electric bill be part of our charitable contribution to the Chamber of Commerce; seconded by Commissioner Salvino. Commissioner Salvino questioned how the electric bill could be so high; something is wrong. If we regulate the air conditioners with timers, our additional contribution should be no more than $200 per month. City Manager Baldwin noted we will evaluate the bill. The motion carried unanimously. 11.3 Commissioner Salvino Commissioner Salvino commented with all the revenue we are bringing in, he thinks we should look at possibly lowering our taxes a little bit this year. 11.4 Vice-Mayor Harris Vice-Mayor Harris said the owner of The Gallery of Amazing Things called him about someone dumping garbage from a 4-plex in the Gallery's back yard. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,May 8,2018—7:00 p.m. Vice-Mayor Harris addressed speeding at night on Federal Highway, especially southbound from Old Griffin Road, and asked if something could be done. Also, the speeding during the daytime northbound from Stirling Road to Dania Beach Boulevard is sometimes insane. Captain Marks responded they will take care of it. Vice-Mayor Harris noted our project-ready list will be presented to the MPO on May 16. 11.5 Mayor James Mayor James said the NW section also has a problem with bulk trash setting out for long periods; she wants to make sure we are paying attention to that. Mayor James asked if the Commission looked at the options sent to them for trees on NW 1st Street. The consensus of the Commission was the silver buttonwood tree. Commissioner Salvino noted the bulk trash problem is all over the City. With the change in pickup, we allowed residents time to adjust and they are still putting it out after a year. We should have a policy in place to give them a warning the first time, then a citation and fine the second time. City Manager Baldwin responded people know the pickup dates, but we will see what we can do. Mayor James noted she mentioned at the CRA meeting that she wants the City Attorney, CRA Director, and the City Manager, as well, to look into a workforce housing resolution. She wants to ensure that development coming in the future includes some type of workforce housing so that our residents are protected and not pushed out because they cannot afford to live here. We should look at what other cities have done. Mayor James said the speed humps on 8t" Avenue, the Oasis, are not effective in reducing the speed. She wants a speed hump that will cause damage to a vehicle going over it too fast. People are also going down the street the wrong way and there is no signage indicating speed hump ahead. The Commission agreed that the City Manager look into making the humps more abrupt. Mayor James thanked the sponsors of the Family Fun Day.
