HomeMy WebLinkAboutR-2018-058 The City Approving The Site Plan (SP-15-18) Submitted By BCD Dania Oaks, LLC, For Property At 5461 To 5525 SW 40th Avenue RESOLUTION NO. 2018-058 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-15-18) SUBMITTED BY BCD DANIA OAKS, LLC, FOR PROPERTY LOCATED AT 5461 TO 5525 SW 40TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the "Land Development Code," Part 6, entitled "Development Review Procedures And Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code"), the property owner BCD Dania Oaks, LLC (the "Applicant"), has applied to the City of Dania Beach (the "City"), for Site Plan approval to permit the development of fifty-seven (57) townhomes and a clubhouse as referenced in Exhibit "B", for property located at 5461 to 5525 SW 40'' Avenue in the City as legally described in Exhibit"A"; and WHEREAS, the City Code Article 635, entitled "Site Plans", provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 15-18) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-15-18), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference is approved subject to the following conditions: 1. ROW/SW 40 Avenue: • Show sight distance analysis using FDOT index No.546. • Provide documentation from FDOT, City of Dania Beach, City of Hollywood and/or Broward County for driveway(s) connections to SW 40th Ave. • Provide vehicle swept path analysis (Auto Turn or Vehicle Tracking) based on freight container design vehicle anticipated for this development especially at proposed ingress/egress locations. 2. Provide the following civil engineering drawings, signed and sealed by a Florida registered professional Civil Engineer: • Paving, Grading and Drainage Plan(s), including the sizes and dimensions of all storm-water infrastructures. Please be advised that all storm drains shall be constructed with RCP piping in the City ROW. Provide Drainage Structures Tables. • Be advised that the applicant shall not be authorized to connect the on-site drainage system to those within the public ROW of FDOT, BCHCED, and/or the City. Provide authorization as appropriate from FDOT, BCHCED, and/or the City for the existing and proposed connections between the on-site drainage system and public ROW. • Be advised that the Applicant shall not be authorized to connect the on-site drainage system to those within the public ROW of DOT, BCHCED, and the City. Provide authorization as appropriate from FDOT, BCHCED, and/or the City for the existing and proposed connections between the on-site drainage system and the public ROW. • Water and Sewer —Utilities- Plan(s), including any existing water main, force mains, gravity, mains, etc. (Show all material & pipe sizes on the plan). Please be advised that all water-main shall be constructed with DIP piping in the City ROW (Engineering). 3. Provide regulatory agencies' approval documentation (as applicable) as part of the final submittal (Broward County Surface Water License, Broward County Health Department Permit, etc.) for permitting (Engineering). 4. Provide Address Detail (Fire). 5. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page (Fire). 6. Per Resolution No. 2015-071 $1,825 per townhouse dwelling (57 X 1,825 = $104,025) must be paid for Recreation and Open Space Impact Fee at time of building permit issuance (Planning). 7. Must provide a recorded copy of the plat prior to issuance of a building permit(Planning). 8. This Site Plan shall be limited to a maximum use of thirty-two (32) Residential Flex Units out of the total thirty-five (35) Residential Flex Units previously allocated by the City for development. The remaining three (3) Residential Flex Units previously allocated shall be deemed unused by the Applicant and shall automatically revert and transfer back into the City's Residential Flex Unit allocation bank(Planning). 2 RESOLUTION#2018-058 9. Revise Sheet A0.5 to show proposed fence/wall along SW 40 Avenue to provide 8 — 16' of planting area from the east property line prior to issuance of a building permit. Dimensions of fence setback not provided (Planning). 10. Preserve and relocate an additional 6 trees (#170, 267, 341, 342, 465, & 586) on site. Revise plans accordingly prior to issuance of a building permit(Planning). 11. Must provide payment into the Tree Trust Fund for the value of the trees removed, as agreed upon by the City's Arborist prior to issuance of a building permit. Section 3. That pursuant to LDC Section 635-100 "Expiration of Site Plans", the Site Plan (SP-15-18) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED July 24, 2018.
