Home My WebLink AboutR-2018-101 Authorizing City To Approve & Ratify A Change Order In The Amount Of $8,200.00 Paid To DECOTA Construction For Removal Of Asbestos At 705 SW 12th Ave Utilizing Funds From CC Contingency Ac RESOLUTION NO. 2018-101 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO APPROVE AND RATIFY A CHANGE ORDER IN THE AMOUNT OF EIGHT THOUSAND TWO HUNDRED DOLLARS ($8,200.00) TO BE PAID TO DECOTA CONSTRUCTION FOR THE REMOVAL OF ASBESTOS FOR PROPERTY LOCATED AT 705 SW 12TH AVENUE UTILIZING FUNDS FROM THE CITY COMMISSION CONTINGENCY ACCOUNT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor for each fiscal year; and WHEREAS,the City acquired the property located at 705 SW 121h Avenue; and WHEREAS, the City Commission adopted Resolution R-2018-065 at the May 8, 2018 meeting, which granted approval for DECOTA Construction ("DECOTA") to demolish the structure at the location; and WHEREAS, the funding was approved in an amount not to exceed Thirty One Thousand Nine Hundred Dollars ($31,900.00) which included Five Thousand Dollars ($5,000.00) of contingency for unforeseen costs: and WHEREAS, DECOTA discovered the presence of asbestos during inspection and submitted a proposal to the City for asbestos removal in the amount of Eight Thousand Two Hundred Dollars ($8,200.00),which proposal is attached as Exhibit"A" ; and WHEREAS, the Public Services Director is seeking approval of an additional Three Thousand Two Hundred Dollars ($3,200.00) from the City Commission Contingency Account for a DECOTA Change Order to remove the asbestos at the property located at 705 SW 12t`Avenue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the City Manager to approve use of additional City Commission Contingency Funds in an amount not to exceed Three Thousand Two Hundred Dollars ($3,200.00) to fund the DECOTA Change Order for the removal of asbestos from property located at 705 SW 12ffi Avenue; a copy of the proposal is attached as Exhibit"A", and made a part of and is incorporated into this Resolution by this reference. Section 3. That funding for these services shall be appropriated from the Commission Contingency Account No. 001-18-00-519-99-10 which has a current available balance of Twenty Two Thousand Six Hundred Ninety Nine Dollars ($22,699.00) and transferred to the Capital Projects 705 SW 12d` Avenue Demolition Project Professional Services Account No. 301-18-10- 519-31-10 in an amount not to exceed Three Thousand Two Hundred Dollars ($3,200.00), leaving a remaining balance of Nineteen Thousand Four Hundred Ninety Nine Dollars ($19,499.00) in the Commission Contingency Account. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to the necessary documents as are deemed necessary and proper and in the best interest of the City. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on July 24, 2018.
