HomeMy WebLinkAboutR-2018-107 Authorizing City For Establishing A Revised And Updated Fire Safety Inspection Fee Schedule RESOLUTION NO. 2018-107 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, ESTABLISHING A REVISED AND UPDATED FIRE SAFETY INSPECTION FEE SCHEDULE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, is authorized by state law to enact user fees commensurate with the cost to the City of providing services, in such amounts as are necessary for the conduct of municipal government and affairs; and WHEREAS, the City of Dania Beach Code of Ordinances, pursuant to Section 11-46.1, "Fire Prevention" of Chapter 11, "Fire Protection and Prevention", provides for the establishment of fire safety inspection and plan review fees; and WHEREAS, the cost of plan review, administration and inspection services should be borne by the users benefiting from the services; and WHEREAS, the City wishes to revise and update its fire safety inspection fee schedule to partially offset the cost of fire safety plan review and inspections services; and WHEREAS, fees contained in this Resolution have been developed to properly reflect the costs of providing plan review, permitting, fire safety inspection service, and advisory services provided to citizens and contractors; and WHEREAS, the Director of Community Development and Broward Sheriff Fire Marshal's Office believes that it is in the best interest of the citizens and residents of the City of Dania Beach to approve the recommended fee schedule; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That a revised and updated fire safety inspection and plan review fee schedule is adopted to provide as follows: FIRE SAFETY INSPECTION AND PLAN REVIEW FEE SCHEDULE The following fees are established for the permits, certificate of use inspections, certificate of occupancy inspections, annual fire safety inspections, re-inspections and tests performed under the provisions of Chapter 11 of the City Code of Ordinances which Chapter is entitled "Fire Protection and Prevention", Article III, entitled "Fire Prevention", Section 11-46.1 entitled "Establishment of Fees",. Plans Examination Fees: 1. Plans Examination Fee Schedule (includes development review, all new construction, additions, alterations, remodeling, renovations, retrofits, fire sprinkler systems, fire alarm systems, other fire protection systems and similar type work which requires permits). a. Plan Review Fees for Site and Plat Development i. Fees for Site and Plat Development Review Services shall be as follows: 1. Final Plat Review ... 560.00 2. Variance Approval Requests ... 150.00 3. Site Development Plan Review ... 1,120.00 (Includes two (2) review cycles as defined by the City of Dania Beach Community Development Department) 4. Annual Inspections An annual fire safety inspection fee is levied and imposed against all buildings and structures within the city to provide funding for the cost of providing such fire safety inspection services, which annual fee shall be payable at the time of registering with the City of Dania Beach as a business and each subsequent year (annually) in order to obtain a Business Tax Receipt. Fees shall be in accordance with the following schedule: a. Commercial, industrial, business, storage, assembly, warehouses, mercantile and all others not listed above or below i. Minimum fee (up to 2,500 sq. ft.) . . . 200.00 ii. 2,501 sq. ft. to 5,000 sq. ft. . . . 300.00 iii. Hazardous Materials: 5. Hazardous materials: a. Sparkler sales: Sale of sparklers requires submittal of inventory and site plan, including inspection . . . 300.00 b. Fireworks: Public display. Public display of fireworks must be under the direction of a person certified by the department as a fireworks "shooter." Each display, including inspection . . . 300.00 6 RESOLUTION#2018-107 i. Shooter's certification requires in-person application to establish competency in handling fireworks and determining compliance with applicable state regulations.
