Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation by Gretchen Cassini, Assistant County Administrator, on the Broward County Commission's proposed penny sales tax for transportation Ms. Cassini gave a presentation linked on the County's website at www.broward.org/pennyfortransportation. She noted they are looking to the cities to be partners in the education campaign. Commissioner Salvino suggested the County be invited to give a presentation in the atrium for the residents of Dania Beach. Vice-Mayor Harris encouraged everyone to go to the website and look at the projects list. Mayor James questioned the amount of funding that would come to the City. Ms. Cassini stated an amount could not be given; the amount allocated depends on projects submitted. 3.2 Update on the proposed beach project headed by the Army Corps of Engineers and on Segment III - Broward County and the Army Corps of Engineers This item was rescheduled to the August 28, 2018 meeting. 3.3 Presentation by Florida Textile Recycling Programs Mark Douglas, Chairman of Florida Textile Recycling Programs, gave a presentation and described their programs in Davie, Hollywood, and other Florida jurisdictions. Mayor Salvino felt that if we decide to implement this program, revenues the City takes in should go to our charity fund. Mayor James commented she likes the concept, but the bin design is plain. Vice-Mayor Harris questioned how many bins would be needed in Dania Beach. Mr. Douglas responded 25-30, though the number of actual locations would be less since two or more bins may be situated at the same location in order to properly service the particular area. 3.4 2018 Comprehensive Emergency Management Plan (CEMP) - Battalion Chief Sean Brown, BSO Fire Marshall's Office Battalion Chief Sean Brown provided an overview of this year's plan. Commissioner Grace asked if Morrison Hotel would be our EOC. City Manager Baldwin responded we need a written agreement with the hotel, but the initial EOC will be City Hall. 3.5 Special Event request from St. Ruth Missionary Baptist Church, 145 NW 5th Avenue, for their 11 Oth Anniversary Parade to be held on August 11, 2018 from 9:00 a.m. to 12:00 p.m. Commissioner Grace motioned to approve the Special Event request for St. Ruth Missionary Baptist Church 110th Anniversary Parade; seconded by Commissioner Salvino. The motion carried unanimously. 3.6 Special Event request from Broward County Environmental Planning and Community Resilience Division for a Beach Cleanup on Saturday, September 15, 2018, from 9:00 a.m. — 12:00 p.m., at 300 North Beach Road Commissioner Grace motioned to approve the Special Event request for the Broward County Environmental Planning and Community Resilience Division Beach Cleanup; seconded by Commissioner Salvino. The motion carried unanimously. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,July 24,2018—7:00 p.m. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Diana Kullander, 680 SE 13th Street,requested the City build bicycle lanes. Robert Shapiro, 2860 W State Road 84, complimented the CRA for the community charrette held last night. Shawn DeRosa, 408 SE 5th Street, spoke of illegal signs on our main corridors and asked for a bigger effort against serial violators. He also spoke about Airbnbs and regulating the minimum age of renters, and requiring a secondary property owner/manager. Commissioner Brandimarte addressed Mr. DeRosa regarding his limitations in dealing with City business. City Attorney Ansbro noted Dania Beach has one of the best written Airbnb ordinances in the County. There is an ongoing effort by the Legislature to take away all city and county authority over any of these vacation rentals. Gloria Fernandez, 3831 SW 56th Street, asked if there are any steps being taken about traffic on NW 40th Avenue. Vice-Mayor Harris said it is on the MPO project ready list. James Howard, 145 NW 5th Avenue, Pastor of St. Ruth Missionary Baptist Church, spoke of the upcoming anniversary celebration and invited everyone to participate. David Simonetta, 4641 SW 42 Avenue, thanked the Commission for cigarette butt receptacles and signs at the beach. He asked about the status of the straw ordinance and pilings installed at the beach during Phase I renovations that are exposed due to erosion. The Commission expressed a desire to look into an ordinance banning plastic straws on the water and waterways and east of US-1 and Intracoastal restaurants (anything on the water). Vice Mayor Harris gave an update on sand restoration on the beach. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke of recent criminal activity and efforts to control speeding in the City. Sean Brown, Battalion Chief, BSO Fire Rescue, reminded everyone that school will begin soon and to be mindful of school zones. T. PARKER FOR DAMAGE AS A RESULT OF HURRICANE IRMA,WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS, FOR A PROJECT THAT WILL EXCEED THE ANNUAL VENDOR THRESHOLD OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00) FOR A SINGLE VENDOR IN A FISCAL YEAR; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.7, #7.8, and #7.11; seconded by Commissioner Salvino. The motion carried unanimously. 7.7 RESOLUTION#2018-103 Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,July 24,2018—7:00 p.m. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF FUNDS BY THE COMMUNITY DEVELOPMENT DEPARTMENT FOR A MOBILE PAY PLATFORM AND PARKING CITATION MANAGEMENT APPLICATION FROM PASSPORT PARKING, INC., THAT EXCEEDS AN ANNUAL VENDOR TOTAL AMOUNT OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-103. Mayor James asked for clarification of this item, in particular, whether or not it is a brand new application. Marc LaFerrier, Director of Community Development, explained this is the same application that was launched several years ago. He noted the service is paid on an annual basis, and the fee is based on how many times the service is used. The service will exceed the $25,000 annual threshold, which necessitates Commission approval. Commissioner Grace motioned to adopt Resolution #2018-103; seconded by Commissioner Salvino. The motion carried unanimously. 7.8 RESOLUTION 42018-104 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A ONE (1) YEAR RENEWAL OF THE EXISTING AGREEMENT WITH STAFFING CONNECTIONS, INC., TO PROVIDE SCHOOL CROSSING GUARD STAFFING SERVICES, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED NINETEEN THOUSAND TWO HUNDRED FIFTY EIGHT DOLLARS AND FORTY CENTS ($119,258.40); PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2018-104. Mayor James questioned the action taken by the Commission on this contract last year. Vice-Mayor Harris noted the Commission had reduced the two-year renewal to one year. Commissioner Grace motioned to adopt Resolution #2018-104; seconded by Commissioner Salvino. The motion carried unanimously. 7.11 ORDINANCE 42018-016 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 13, ENTITLED "HEALTH AND SANITATION" OF THE CITY CODE OF ORDINANCES, BY CREATING ARTICLE VIII TO BE ENTITLED, "TEXTILE RECYCLING" AND SECTION 13-135, TO BE ENTITLED "TEXTILE RECYCLING, TEXTILE RECYCLING COLLECTION BINS"; PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) The Commission consensus was for an exclusive contract and to piggyback with Davie. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans Mayor James advanced item 9.8 and 9.9. 9.8 RESOLUTION#2018-058 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-15-18) SUBMITTED BY BCD DANIA OAKS, LLC, FOR PROPERTY LOCATED AT 5461 TO 5525 SW 40TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from April 10,2018,May 8,2018 and May 22,2018) City Attorney Ansbro read the title of Resolution #2018-058 and Resolution #2018-057, and advised these items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. Mayor James and Vice-Mayor Harris noted they had been contacted by residents and the developer. Corinne Lajoie, Planning & Zoning Manager, gave an overview and explained modifications made by the applicant to the site plan and plat requests. Glen Smith, representing the applicant, introduced his witness, Dennis Mele. Dennis Mele, Greenspoon Marder, representing the applicant, gave a PowerPoint presentation, which is attached to and incorporated in these minutes. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,July 24,2018—7:00 p.m. Mayor James opened the Public Hearings. Attorney Smith said he would like to file with the Clerk a notebook of documents for the record. Gloria Fernandez, 3831 SW 58th Street, spoke of the makeup of the neighborhood and asked that projects coming onto SW 40th Avenue be compatible with their neighborhood. She presented a PowerPoint presentation, which is attached to and incorporated into these minutes. Monica Sorg, 3920 SW 56th Court, spoke about traffic and the neighborhood, and the detrimental effect of this project. Dennis Moroney, 3951 SW 56th Court, spoke against the project and urged the Commission to disapprove it so that the developer will change the units to make them look more like single- family. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Commissioner Salvino mentioned he understood neighborhoods are affected by change in development. City Attorney Ansbro noted the applicant has shown that all criteria of the site plan and plat have been met. He addressed the courts and competent substantial evidence, and potential costs to defend a legal case if the requests were denied. Mayor James said she understands the battle between the residents and the developer. She wishes there could be community buy-in; however, the battle was lost when the rezoning was approved. Commissioner Grace motioned to adopt Resolution #2018-058; seconded by Commissioner Brandimarte. Commissioner Salvino motioned to continue Ordinance #2018-012, on second reading, until the August 28, 2018 City Commission meeting at 7:00 p.m.; seconded by Commissioner Grace. Planning & Zoning Manager Lajoie responded it was related to drainage and is a longstanding problem. Marienelly Freias, BRR Architecture, Merriam, Kanas, architect for the store, not the developer, commented she is not familiar with the drainage of the site. Marc LaFerrier, Director of Community Development, explained the development does not meet the current code regarding outfall; however, the site has improved, even with heavy rains. Discussion and Possible Action Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,July 24,2018—7:00 p.m. 10.1 Attorney General Opinion on Auditor- Commissioner Grace Commissioner Grace thanked City Attorney Ansbro and asked staff to get an RFP out for an auditor. Nicki Satterfield, Director of Finance, noted an audit committee would need to be established; if she can get approval of the two resolutions from March, she could get the RFP out sooner. She explained the audit committee's process. Commissioner Grace said we should get this done. Discussion ensued regarding the Audit Committee consisting of the City Manager, Finance Director, Assistant Finance Director, and Frank DiPaulo from Lighthouse Point. Director Satterfield reminded the Commission that if the City Manager is on the committee, any objections or appeals cannot go to him. Mayor James questioned the City Manager or Assistant City Manager being a part of the committee during the hiring process. Director Satterfield noted the committee does not have to be four people; it can be three. City Attorney Ansbro provided clarification by reading and explaining the statute pertaining to selecting an audit firm. Commissioner Grace requested Director of Finance Satterfield expedite the RFP and bring it back with the top three firms; the audit committee would consist of three people. Director of Finance Satterfield clarified the audit committee would consist of herself, Assistant Finance Director Adam Segal, and Frank DiPaulo. Commissioner Grace motioned to approve bidding for auditing services and an audit committee; seconded by Commissioner Salvino. The motion carried unanimously. 11.
