HomeMy WebLinkAboutR-2018-114 City Approving Site Plan (SP-028-18) & Variances (VA-60-18), VA-61-18) Submitted By 811 LLC, A FL Limited Liability Company For 3899 Ravenswood Rd Identified Under PropertyID 5042 29 09 035 RESOLUTION NO. 2018-114 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-028-18) AND VARIANCES (VA-60-18, VA-61-18) SUBMITTED BY 811 LLC, A FLORIDA LIMITED LIABILITY COMPANY FOR 3899 RAVENSWOOD ROAD IDENTIFIED UNDER PROPERTY IDENTIFICATION NUMBER 5042 29 09 0350 AND LOCATED IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements", Article 635, entitled "Site Plans", states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, 811 LLC ("Applicant") is requesting Site Plan (SP-028-18) approval to permit the development of a 9,940 square foot warehouse building and covered area located at 3899 Ravenswood Road (the "Property") as legally described in Exhibit"A"; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances", Section 625-40, entitled "Variance Review Criteria; City Action", states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance to permit one (1) category one tree in terminal landscape peninsulas (VA-60-18), where the LDC requires a minimum of two (2) trees pursuant to Section 275-100; WHEREAS, the Applicant has requested a Variance (VA-60-18) to permit a TERMINAL LANDSCAPE PENINSULA with palm trees , due to the location of overhead utilities and easements, where the LDC requires a minimum of two (2) category one trees pursuant to Section 275-100; WHEREAS, the Applicant has requested a Variance (VA-61-18) to permit thirteen (13) shade/canopy trees, where the LDC requires fifty-one (51) trees pursuant to Section 275- 190. WHEREAS, the Applicant has requested a Variance (VA-61-18) to permit thirty-two (32) intermediate trees, where the LDC requires thirty-eight (38) trees pursuant to Section 275- 190. WHEREAS, the Applicant has requested a Variance (VA-61-18) to permit fourteen (14) small trees, where the LDC allows a maximum of twelve (12)trees pursuant to Section 275-190. WHEREAS, the Applicant has requested a Variance (VA-61-18) to permit fifteen (15) palm trees, where the LDC requires twenty-five (25)trees pursuant to Section 275-190. WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 028-18) and Variances (VA-60-18, VA-61-18) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan(SP-028-18), attached as Exhibit`B" which is made a part of and incorporated into this Resolution by reference is approved. Section 3. That pursuant to Chapter 28, "Land Development Code", Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-60-18, VA-61-18) are approved consistent with the Site Plan provided in Exhibit`B". Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Minimum Radio Signal Strength for Fire Department Communications — See details on the next page (Fire). 2 RESOLUTION#2018-114 2. Thank you for providing an updated tree survey table on sheet TS-1. Please update the invasive status and canopy mitigation requirement for the Norfolk Pine (tree #12) which is not listed as a Category I or II invasive per FLEPPS, and replace the existing TS-1 table with the table from the arborist report which includes specimen tree appraisal values (Landscaping). 3. In the Tree Survey table, show the replacement canopy required in square feet (2475.41 s.f) as well as the number of replacement trees. Be advised that tree trust fund canopy mitigation may need to be recalculated using Category I tree canopy (300 sq. ft.) due to available inventory (Landscaping). 4. South perimeter tree requirements need to be evaluated using 275-90 only if the internal site usage (equipment storage) is considered VUA, and per 275-120 for perimeter buffer requirements associated with commercial industrial properties not adjacent to residential. Please re-evaluate your proposed buffering and update the data table and calculations accordingly as needed (Landscaping). 5. Update the data table per 275-90 to show that the shade tree percentage is a "minimum" requirement, while the remaining small tree and palm requirements are maximum percentages. Uses these calculations in your final variance request(s) (Landscaping). 6. Obtain/provide a variance for each of the deficiencies identified in the landscape code table on Sheet LP-I. It is understood variances are being requested for terminal island dimensions/plantings and smaller perimeter and VUA buffer plantings due to OHW's. Please provide a status update regarding these variance requests (Landscaping). 7. The developer/property owner shall prove a recorded easement for a public sidewalk, the cost of construction and maintenance of which shall be shouldered by the property owner in perpetuity prior to issuance of a building permit, per City's Code of Ordinances (Engineering). 8. Identify Property/ROW lines and dimensions on the East side of the Project/Property along Anglers Avenue Ravenswood Road (Engineering). 9. Show Base Building Line -BBL- Right of Way—ROW and CENTER- lines and Property Lines (PL) on civil/Site plan(s) (Engineering). 10. Show sight-visibility triangle at all proposed driveways and/or ingress-egress, including on landscaping plan. Eight feet(8')might be blocking sight-visibility(Engineering). 11. Identify pavement and width of driveways on Central and West of Paved Outdoors store areas (Engineering). 12. Identify Driveway from/to Anglers Avenue-Ravenswood Road(Engineering). 3 RESOLUTION#2018-114 13. Show Base Building Line — BBL- Right of Way —ROW- lines and Property (PL) and Center(CL) Lines (PL) on civil/Site plan(s) (Engineering). 14. Provide copies of approved permits from FDOT, City of Dania Beach, Broward County and others for driveway(s) connections (If applicable) (Engineering). 15. Show sight distance analysis using FDOT index No.546 at all proposed driveways not just on SW 39th Ave (Engineering). 16. Verify construction of Sidewalk on driveways (Ingress/Egress) and approval by public Works—City Engineer(Engineering). 17. Any road cuts for utilities, curb cuts and/or others with the City ROW shall be restored to full lane width for 50' minimum length centered on the proposed cut(Engineering). 18. Provide Maintenance of Traffic (MOT) Plan by a licensed Professional Engineer in the State of Florida(If applicable) (Engineering). 19. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved (Engineering). 20. Provide survey with existing elevation(s), particularly at the point of connection with SW 38th & 39th Streets - SW 22nd Terrace and Anglers Avenue - Ravenswood Road. (Engineering) 21. Show on survey ROW existing/proposed dedication(s) (Engineering). 22. Paving, Grading and Drainage Plan(s), including the sizes and dimensions of all storm- water infrastructures. Please be advised that all storm drains shall be constructed with RCP piping in the City ROW. Provide Drainage Structures Tables (Engineering). 23. Provide drainage calculations and geotechnical information supporting the proposed drainage design(Engineering). 24. Provide a copy of pre and post development storm-water management and drainage calculations. The City specifically needs the following information: 10-year, 25-year, and 100-year24-hour and 72-hour flood stage elevations (Engineering). 25. Provide an on-site drainage system — plan- along with storm-water management calculations (signed and sealed by a registered professional engineer). The calculations shall show how the minimum road crown and finished floor elevations are met, and how the 25-year, 3 day storm event is maintained onsite with zero discharge to the ROW and adjacent properties. The site must store at least the 25-year, 3 day event onsite with NO EXECPTIONS (Engineering). 4 RESOLUTION#2018-114 26. Proposed grading and drainage plan shall be based on the storm-water management calculations. Identify minimum elevations from drainage calculations (Engineering). 27. Storm-water quality design shall be provided in the amount of 2.5 inches times the percent impervious or the first 1 inch of rainfall over the entire site whichever is greater (Engineering). 28. Be advised that the applicant shall not be authorized to connect the on-site drainage system to those within the public ROW of FDOT, BCHCED, and/or the City. Provide authorization as appropriate from FDOT, BCHCED, and/or the City for the existing and proposed connections between the on-site drainage system and public ROW (Engineering). 29. Provide location of building roof drains, and their proposed connection(s) to the on-site drainage system (If Applicable) (Engineering). 30. Drainage shall adequate to protect rooms in new structures designed for occupancy from the 100-Year flood based on FEMA. Show and identify in drainage calculations the elevation(Engineering). 31. Water and Sewer —Utilities- Plan, including any existing water main, force mains, gravity, mains, etc. (Show all material & pipe sizes on the plan). Please be advised that all water-main shall be constructed with DIP piping in the City ROW(Engineering). 32. Provide a proposed water and sewer — utilities — plan, indicating all water and sewer appurtenances including but not limited to point of connection to the existing system, cleanout, water meter, check valve, etc. (Engineering). 33. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm-water service lines (Engineering). 34. In compliance with Article 805. CONCURRENCY OF DETERMINATIONS of the City Code of Ordinances, applicants shall provide projected water demand, sewage and solid waste generation amounts in tabular format—utilities —plan. Please provide calculations to support tabular projected generation amounts (Engineering). 35. Meet with Public Services, separately, to discuss water and sewer connections. Request meeting through the City Engineer(Engineer). 36. Backflow preventers will not encroach on sidewalks (If applicable) (Engineering). 37. Show also all existing and proposed utilities on the landscaping plans for potential Conflicts (Engineering). 38. Provide water details 228 & 231 (Engineering). 5 RESOLUTION#2018-114 39. Provide a Pavement, Marking and Signage Plan with details (Engineering). 40. Add signage to the road marking plan (Engineering). 41. In Signage and marking plan, include the radii and all landscaping and pavement areas (Engineering). 42. Erosion and Sediment Control Plan shall be reviewed for the drainage impacts to adjacent properties, surrounding ROW, storm-water facilities, and neighboring water bodies (Engineering). 43. Provide silt fence applications, bales backed by fence, protection around inlets or similar structures, barrier for fill slope, barrier for paved and unpaved ditches details (As applicable) (Engineering). 44. Use recommended spacing for Type I and Type II Hay bale barriers, and type III silt fences, from chart FDOT state drainage manual (Engineering). 45. Provide detail of erosion protection to inlet/catch basin structures (Engineering). 46. Provide support data that this site meets the fire hydrant locations and distribution as per the National Fire Preventions Association(NFPA) Codes and Standards. Clearly show all existing and proposed fire hydrants and 500-foot radius of coverage area. In addition, please note that a fire hydrant shall be installed within 100 feet of the Fire Department Connection(Engineering). 47. Provide ADA parking, access / driveway, and sidewalks /ramps in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of"Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and in accordance with Americans with Disability Act (ADA). Be advised that ADA van accessibility for structured parking garages (including automated parking) shall be provided as appropriate and consider the taller specialized ADA vehicles (Engineering). 48. Provide dedicated fire service connection (not combined with domestic water service connection, per the National Fire Preventions Association (NFPA) guidelines, for the proposed development. Provide Fire Department conceptual approval (Engineering). 49. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 50. Provide regulatory agencies' approval documentation ( as applicable) as part of the final submittal ( Broward County Surface Water License, Broward County Health Department Permit, etc.) (Engineering). 6 RESOLUTION#2018-114 51. Contractor shall provide, before issuance of C.O., to the Engineer and City of Dania Beach "As-Builts" of the project giving horizontal and vertical dimensions of connections signed and sealed by a registered surveyor(Engineering). 52. The proximity to the airport will be required BCAD review and approval. Per 0-2017-027, commercial properties under construction are required to provide security to fencing with screening showing project rendering when adjacent to ROW. Provide screen detail with next submittal (Planning). 54. Identify dimension of Ravenswood Road right of way on survey. Section 5. That such application must be reviewed by Broward County Aviation Department. That pursuant to LDC Section 635-100 "Expiration of Site Plans" and Section 625-50 "Expiration of Variances," the Site Plan (SP-028-18) and Variances (VA-60-18, VA-61-18) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18)months from the date of this Resolution. Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 9.
