Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Update on the proposed beach project headed by the Army Corps of Engineers and on Segment III - Broward County and the Army Corps of Engineers Nicole Sharp, Broward County,briefly addressed the proposed beach project. Lacey Pfaff, Project Manager for the Army Corps of Engineers, gave a project overview on Broward County Shore Protection, Segment III, which is attached to and incorporated into these minutes. 4. Proclamations 4.1 National Voter Registration Day- Vice-Mayor Harris Vice-Mayor Harris read the proclamation for National Voter Registration Day and noted October 9ch is the deadline for registering to vote in the November election. 5. Citizen Comments Patricia Chukerman, 545 SE 4 Court, spoke about vacation rentals and the City ordinance regulating them, and requested a workshop be set up with the City of Fort Lauderdale. Mayor James asked the City Manager to get information from Fort Lauderdale. Vice-Mayor Harris spoke of the discussion at the Florida League of Cities, and agreed a workshop is needed. Commissioner Brandimarte provided details of the presentation made at the League conference. David Simonetta, 4641 SW 42 Avenue, thanked the Commission for adding the plastic straw ordinance to the agenda. He suggested removing large pieces of plastic from the beach before the beach cleaning equipment is used. Catherine Uden, 1120 Lyontree Street, Hollywood, thanked the Commission for the plastic straw ordinance, and spoke of the polluting effects of plastics. Patricia Faver, 200 SE 51h Avenue, commented her building stopped recycling and questioned whether the City would consider a recycling center for all of the condominiums. She cautioned about partnering with the Army Corps of Engineers. Chelsea Krebs, 1548 SE 12th Court, Fort Lauderdale, spoke in support of the ban on plastic straws. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity, and noted October 31St is the National Night Out event in conjunction with Parks &Recreation. Sean Brown, Battalion Chief, BSO Fire Rescue, was available to answer questions. 7. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.9; seconded by Commissioner Salvino. The motion carried unanimously. 7.9 ORDINANCE#2018-017 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 17, ENTITLED, "OFFENSES - MISCELLANEOUS" OF THE CITY CODE OF ORDINANCES TO CREATE ARTICLE XIII, "PROHIBITION OF DISTRIBUTION OF PLASTIC STRAWS"; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2018-017, and noted the Commission needs to give a date when they would like this to become effective. Mayor James questioned stores east of Federal Highway, such as Publix and Walmart, being included. Commissioner Salvino said he thought previous discussion was that the prohibition was for only waterway restaurants. City Attorney Ansbro noted the ordinance could be amended for second reading for the prohibition to be only adjacent to waterways. The Commission consensus was to prohibit plastic straws only at restaurants adjacent to water, with January 1, 2019 as the deadline to comply. Commissioner Grace motioned to adopt Ordinance #2018-017, as amended, on first reading; seconded by Vice-Mayor Harris. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Commissioner Grace motioned to continue Ordinance #2018-012, on second reading, until the September 11, 2018 City Commission meeting at 7:00 p.m.; seconded by Commissioner Salvino. The motion carried unanimously. 9.2 ORDINANCE#2018-015 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS EXCEEDING ONE MILLION DOLLARS ($1,000,000.00)FOR A C-51 RESERVOIR CAPACITY ALLOCATION AGREEMENT FOR SERVICES TO BE PROVIDED BY PALM BEACH AGGREGATES,LLC;PROVIDING FOR SEVERABILITY;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) City Attorney Ansbro read the title of Ordinance 42018-015 and explained it is required per the Charter as the City's portion of the share costing will be $4.2 million. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2018-015, on second reading; seconded by Commissioner Salvino. The motion carried unanimously. 9.3 ORDINANCE 42018-016 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 13, ENTITLED "HEALTH AND SANITATION" OF THE CITY CODE OF ORDINANCES, BY CREATING ARTICLE VIII TO BE ENTITLED, "TEXTILE RECYCLING" AND SECTION 13-135, TO BE ENTITLED "TEXTILE RECYCLING, TEXTILE RECYCLING COLLECTION BINS"; PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (SECOND READING) Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,August 28,2018—7:00 p.m. City Attorney Ansbro read the title of Ordinance #2018-016, and noted a provision regarding other bins having to be removed from the City was removed from the ordinance because there are no other bins or competitors to the new company. Commissioner Brandimarte requested the owner of the company to consider hiring Dania Beach residents. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2018-016, on second reading; seconded by Commissioner Salvino. The motion carried unanimously. 9.4 ORDINANCE#2018-018 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND CHAPTER 28, OF THE "LAND DEVELOPMENT CODE," OF THE CITY'S CODE OF ORDINANCES BY AMENDING ARTICLE 115 "INDUSTRIAL DISTRICTS: PERMITTED, PROHIBITED, SPECIAL EXCEPTION, USES AND CONDITIONS OF USE" TO ADDRESS CONDITIONS OF USE FOR PARKING FACILITIES; AMENDING ARTICLE 635 "SITE PLAN" TO ADDRESS SITE PLAN MODIFICATION REGULATIONS; AMENDING ARTICLE 675 "TEMPORARY USE AND SPECIAL EVENT PERMIT" TO CREATE A WAIVER PROCESS FOR THE NUMBER OF SPECIAL EVENTS PER YEAR; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS;PROVIDING FOR INCLUSION IN THE CODE;FURTHER PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2018-114, and advised this item was a quasi- judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the site plan and variance requests. Frank Perez,Architect for the development, showed renderings of the development. Mayor James opened the Public Hearing. The motion carried unanimously. 9.5 ORDINANCE#2018-019 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 8, ENTITLED "BUILDINGS," ARTICLE I "IN GENERAL," SECTION 8-7 "FENCING REQUIREMENTS FOR COMMERCIAL PROPERTIES UNDER CONSTRUCTION"; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance 42018-019. Corinne Lajoie, Planning& Zoning Manager, gave a presentation on the code amendment. Mayor James questioned signage used for sales and the use of the City logo. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Salvino motioned to adopt Ordinance #2018-019, on first reading; seconded by Vice-Mayor Harris. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Beach fishing ban or regulated hours- City Attorney Ansbro City Attorney Ansbro noted there was a suggestion for a "no fishing" ban for the beach on the north of the pier, as there was a recent occurrence involving a fisherman carrying a gun while fishing, which is permitted by state law. He explained that the current City Code prohibits all fishing from the beach and fishing from the surf, however, the same section provides that such Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,August 28,2018—7:00 p.m. activities are only prohibited between the hours of 9:00 a.m. and 6:00 p.m. The section needs to be revised to remove this conflict, and he requested direction from the Commission. He recommended surf fishing be eliminated between the hours of 9:00 a.m. and 6:00 p.m. Discussion ensued. Commissioner Salvino motioned to approve amending the Code to keep the current prohibition of surf fishing between the hours of 9:00 a.m. and 6:00 p.m.; seconded by Vice- Mayor Harris. The motion carried on a 3-2 voice vote, with Commissioners Brandimarte and Grace voting no. 10.2 The Dania Beach Mental Health and Substance Abuse Task Force - Mayor James Mayor James read from the email included in the agenda packet, and addressed the need for a task force. The Commission agreed to move forward with the task force. 10.3 Set meeting date to discuss City Manager selection- Mayor James The Commission agreed to schedule a special meeting on Friday, September 7, 2018 at 2:00 p.m. 10.4 Set Budget Workshop date - Mayor James The Commission agreed to schedule a budget workshop on Friday, September 7, 2018 at 3:00 p.m. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte thanked Hakeem Ismail for the repairs made to I.T. Parker. 11.2 Commissioner Grace Commissioner Grace welcomed Eric Brown,the new Parks & Recreation Director. Commissioner Grace asked the Finance Director to work on a 4%raise for the CRA Director. Commissioner Grace asked about the auditor bid. Nicki Satterfield, Director of Finance, gave an update on the status of the bid. Vice-Mayor Harris questioned why, when on July 24, Commissioner Grace asked that the auditor RFP be done as soon as possible, it is still not done. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,August 28,2018—7:00 p.m. Director of Finance Satterfield responded there was a delay due to waiting for the Attorney General's opinion and explained the process necessary with the Audit Committee. 11.3 Commissioner Salvino Commissioner Salvino spoke of the Florida League of Cities conference and welcomed Eric Brown. 11.4 Vice-Mayor Harris Vice-Mayor Harris welcomed Eric Brown and spoke of the League of Cities conference held last week. Vice-Mayor Harris questioned the status of the Class and Compensation study. City Manager Baldwin responded we are awaiting results from the outside company, which will be brought to the Commission. 11.5 Mayor James Mayor James asked about the repaving of the beach parking lot. Brad Kaine, Director of Public Services, said it would cost well in excess of$100,000 and would take 3-4 months to bid,unless bidding was waived. The Commission consensus was to move forward without bidding,through quotes or piggyback. Mayor James spoke of an ex-offenders program she discussed with County Administrator Bertha Henry. Mayor James said she has an issue about some of the morale in our departments; it is unacceptable that some of our department heads are bullying or threating our employees, or using the Commissioners' names to do so. Commissioner Grace asked if there is a mechanism through the City Manager to deal with this issue. Commissioner Brandimarte said the union is the way, and we should not distinguish between regular employees and department heads. 12. Appointments 12.1 Police &Fire Pension Board Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,August 28,2018—7:00 p.m. There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin welcomed Eric Brown as the new Director of Parks & Recreation, and thanked Hakeem Ismail for his tenure as Acting Director. 13.2 City Attorney City Attorney Ansbro noted Josh Gaboton would like to renew his contract for the same amount as last year, and he will bring a renewal to the next meeting. Commissioner Brandimarte questioned Ron Book's contract. City Attorney Ansbro advised that our City seal and logo cannot be used without Commission permission.
