Book, PA, - Consulting (Lobbyist) Svcs To Issues Of Concern To City Including Matters Associated W/County & Ft.Laud/Hlwd Airport ($55,000.00) RESOLUTION NO. 2018-138 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN ENGAGEMENT LETTER WITH RON L. BOOK, P.A., FOR CONSULTING (LOBBYIST) SERVICES RELATED TO ISSUES OF CONCERN TO THE CITY OF DANIA BEACH INCLUDING MATTERS ASSOCIATED WITH BROWARD COUNTY AND WITH THE FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT, AS WELL AS GENERAL LEGISLATION AND RELATED ISSUES AT THE STATE LEVEL IN AN AMOUNT NOT TO EXCEED FIFTY FIVE THOUSAND DOLLARS ($55,000.00) FOR FISCAL YEAR 2018-2019; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", subsection (a), sets the monetary threshold or limitation at $25,000.00 for a vendor each fiscal year; and WHEREAS, the City has retained Ronald L. Book, P.A. (the "Consultant") through an Engagement Letter for the past several years, to provide services in connection with the Fort Lauderdale-Hollywood International Airport as well as county and state related issues of concern to the City of Dania Beach; and WHEREAS, the current agreement expires on September 30, 2018; and WHEREAS, the City desires to continue to obtain the services of the Consultant, to provide services in connection with issues of concern to the City pertaining to matters associated with Broward County and the Airport, as well as general legislation and related issues at the state level; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the above "Whereas" clauses are approved, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the proper City officials to execute an engagement letter with Ron L. Book, P.A., which will provide the City with consulting (lobbyist) services beginning October 1, 2018 for a one year term at a cost Fifty Thousand Dollars ($50,000.00), payable monthly, in payments of Four Thousand One Hundred Sixty Six Dollars and Sixty Six Cents ($4,166.66) and which shall further provide for expenses in a not to exceed amount of Five Thousand Dollars ($5,000.00) for the term. A copy of the Engagement Letter is attached as Exhibit "A", and it is made a part of and is incorporated into this Resolution by this reference. Section 3. That funding is planned and appropriated in the Fiscal Year 2018-2019 Commission budget Professional Services Account#001-11-01-511-31-10. Section 4. The City Manager and City Attorney are authorized to make minor revisions to such engagement letter as are deemed necessary and proper in the best interests of the City. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in full force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on September 25, 2018. It Is understood that my firm and I will again provide support on all governmental affairs matters,however with an emphasis on airport issues and any general city appropriations issues. It would be our firm's responsibility to handle all traditional lobbying activities.This will include but not be limited to, working with local staff, Legislative Staff, and Executive Branch Staff as well as elected officials. We'will, of all times, aggressively represent the City and its interests. You agree to fully educate us on matters of interest and priority to the City.We agree to meet periodically,as requested. In exchange for this representation,you agree to compensate our firm with a retainer of$50,000 a year payable in monthly payments of$4,166.66 a month,except the final month will be invoiced at$4,166.72. This agreement will be effective October 1,2018 and will extend for twelve (12)months, anticipating a renewal prior to the expiration of this agreement of September 30,2029 for an additional twelve-month period, unless a written notice of discontinuation is received not less than 30 days prior to the end of the agreement:Expenses will be similarly prorated at a cap of$5,000 a year.It is also understood that this agreement is cancellable by either party with 30 days written notice.
