DANIA BEACH CITY COMMISSION
TUESDAY, SEPTEMBER 25, 2018 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor James called the meeting to order at 7:00 p.m.
Present:

2. Moment of Silence and Pledge of Allegiance
Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
Commissioner Brandimarte spoke of attending the Global Year of Sisterhood: The Heart of it
All event last Saturday in Hollywood, where Commissioner Grace was honored for distinguished
public service. She read Commissioner Grace's biography from the invitation to the event.
3. Presentations and Special Event Approvals
Item 3.2 was taken up at this time pending Ron Book's arrival.
3.1 Upcoming Legislative Session Report by Ron Book
Ron Book, Lobbyist, commented we were successful in getting some money in the budget last
year, but the Governor vetoed it. He spoke of this year's election campaigns and constitutional
amendments, and emphasized the importance of voting. He provided an overview of the
upcoming legislative session, and the potential for preemption of local rule and an assault on
local governments. Lastly, he briefly addressed Hollywood-Ft. Lauderdale airport and beach
restoration issues.
3.2 Presentation by the Marine Advisory Board - Clive Taylor, Chair
Clive Taylor and Chris Barile, Chair and Co-chair of the Marine Advisory Board, gave a
PowerPoint presentation,which is attached to and incorporated into these minutes.
Commissioner Brandimarte noted Mr. Taylor deserves more time than that allotted, and he
should have a special forum for this presentation.
Commissioner Grace noted next year's budget has been set and she questioned where funding
would come from for marine patrols stationed in Dania Beach.
3.3 Special Event request from the City of Dania Beach Community Redevelopment
Agency for Dania After Dark Events to be held in Downtown Dania Beach, on SW
1 st Avenue between Dania Beach Boulevard and SW 1 st Street, on October 13,
November 10, and December 8, 2018 and on January 12, February 9, March 9, April
13, May 11, June 8, July 13, August 10, and September 14, 2019 from 5:00 p.m. to
10:00 p.m. The applicant is also requesting road closures on SW 1st Avenue, and
BSO Police and Fire Services.
Commissioner Grace motioned to approve the Special Event request for the Dania After
Dark events; seconded by Commissioner Salvino. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Carol Hemmis, 214 SW 6th Street, invited the Commission to attend the American Legion's
Veterans Day event on November 12th, and asked about obtaining information on the
constitutional amendments.
Rich Aube, 675 SE 2 Avenue, thanked the Commission for passing the plastic straw ordinance,
and invited the Commission to the Lions Club gala this weekend.
Lisa Bowe, 4717 SW 35 Avenue, spoke about a Building inspector who failed to properly
document and sign off on her building permit, leading to issues with closing out and completing
an addition to her home.
Craig Valentine, Gangrel's Wrestling, 1982 Tigertail Boulevard, thanked Commissioner Salvino
for being a time-keeper last weekend and invited the Commission to their Halloween party on
October 31St. He distributed shirts to the Commissioners for the breast cancer benefit on October
7th
Suzy Otto, 2140 SW 52"d Street, spoke about the management and upkeep of the pier, and
questioned who is responsible to maintain it. She is concerned for the safety of the residents.

Dania Beach City Commission
Tuesday, September 25,2018—7:00 p.m.
Robert Mikes, 601 NW 71h Street, spoke of the leasing of City parks and protecting them through
the City Charter, the pier, City waterways, and container storage.
Lauren Odman, 2149 Anchor Road, spoke of the Silver Tour, which is designed to educate
senior citizens on medical marijuana, in light of the first medical marijuana dispensary opening
in the City.
Amy Campbell-Oats, 277 SW 7th Street, proposed Dania Beach create a Green Team or
environmental club, and described events and activities that could be undertaken.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City, and
added the COP unit has been busy assisting with crime prevention. He noted tomorrow is Take
Your Child to School Day at Collins Elementary School, and October 31 St is the Annual Fall
Festival and National Night Out Against Crime at CW Thomas Park.
Sean Brown, Battalion Chief, BSO Fire Rescue,was available to answer questions.

Corinne Lajoie, Planning& Zoning Manager, was available to answer questions.
Mayor James asked if we have anything in our regulations that allow container storage.
Planning & Zoning Manager Lajoie responded there are regulations allowing them, but with a lot
of restrictions.

City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in
those who would speak. He asked the Commission to disclose any communication they had on
these matters.
9.5 RESOLUTION 42018-145
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE VARIANCE REQUEST (VA-59-18) SUBMITTED BY POP FLORIDA PROPERTIES, LLC (dba
POPEYE'S) FOR PROPERTY LOCATED AT 506 SOUTH FEDERAL WAY, IN THE CITY OF DANIA
BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO
THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
City Attorney Ansbro read the title of Resolution#2018-145.
Corinne Lajoie, Planning & Zoning Manager, gave an overview of the variance request for
Popeye's.
Commissioner Salvino questioned why we would grant a variance when development of the
property has been delayed and setting there for over a year.
A representative of the sign company agreed and said it has been difficult to work through the
bureaucratic ownership process. The owners are in Dallas and have numerous properties along
the beaches in Florida; he felt they are overwhelmed with too many projects going on at the same
time. He noted they are now committed and wanted to make sure this hearing was held so they
can move ahead with ordering the signs.
Commissioner Salvino felt they are not committed to the building, and suggested they come back
in a month and ask for this variance.
The sign company representative said this is a minimal variance and they satisfied all of the
findings of fact that are required.
Commissioner Salvino noted he has no problem with approving the variance; the issue is that if
we allow them to have what they want, they are still going to be stagnant. Perhaps if we held
them up,the building would get done.
Mayor James felt it is an eyesore and we need to express how concerning this is, but if we delay
them,the project will be further delayed.
Commissioner Grace questioned whether we could approve this with the stipulation that they
work on the building as soon as possible, and send them a letter stating they need to expedite the
proj ect.

Dania Beach City Commission
Tuesday, September 25,2018—7:00 p.m.
Marc LaFerrier, Director of Community Development, noted the permits have been issued so
they could proceed with construction. The sign would be a part of the final approval for this
project.
City Attorney Ansbro said nothing prohibits Community Development Director LaFerrier from
writing to them that the Commission is dissatisfied with the speed on this project and is not
willing to approve anything further if substantial progress is not made.
Commissioner Salvino suggested a letter be sent and this item be brought back in two or four
weeks to see if they can get the job going on a continuous basis.
Community Development Director LaFerrier noted he would contact the property owner and the
builder and have them give us a schedule for completion of the construction.
City Attorney Ansbro advised if this item is continued, it would send a message to them that the
Commission is dissatisfied.
Vice-Mayor Harris said this could be brought back October 91h and asked if we could put some
pressure on the building owners for a status report or completion date in the meantime.
Mayor James questioned the usefulness of a report on the completion date.
Commissioner Brandimarte suggested we approve the signage contingent on us seeing progress
on the building.
Commissioner Salvino noted the owners need to be told that if we do not see any progress on the
building come October 9th, we will not approve the variance.

Corinne Lajoie, Planning & Zoning Manager, described the plat note amendment.
Commissioner Grace questioned which floor the day care is on.
Planning&Zoning Manager Lajoie responded it is on the ground floor.
Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, she closed the Public Hearing.
Commissioner Salvino motioned to adopt Resolution #2018-146; seconded by
Commissioner Grace. The motion carried unanimously.

11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte asked the Commission to delay the October meeting with
Superintendent Runcie about the Olsen Middle School property until after the election since the
issue is becoming too political.
Commissioner Brandimarte spoke of requests from the Creative Arts Council Advisory Board
regarding wraps on signal boxes. She heard two out of the five Commissioners were picked to
have their faces put on boxes, and does not see why any one of their faces should appear on a
box without all of their faces appearing. The CACAB does not have the final say; this is
taxpayers' money.
Rickelle Williams, CRA Executive Director, noted the decision on what is put on the signal box
is the Commission's, and explained the intent behind the CACAB's selection.
Commissioner Salvino noted he would be opposed to putting anyone's face on the signal boxes.
Commissioner Brandimarte suggested letting the children design the box wraps.
11.2 Commissioner Grace
Commissioner Grace agreed with Commissioner Brandimarte regarding delaying Olsen Middle
School discussion.

Commissioner Grace noted her idea for the box wrap at Attucks would be the eagle, and asked
that the CACAB be advised of this.
Mayor James commented she listened to the discussion at the CACAB meeting and there was
disrespect shown to the board and to the Commission. They were speaking about her and
Commissioner Grace's faces being put on the box wraps, and she would never vote against such
a request. She is not going to tell a board what they should or should not draw.
Commissioner Grace spoke of A Taste of Dania Beach held at the Morrison Hotel.
Commissioner Grace thanked the Commission for attending the Sisterhood Luncheon in her
honor.
11.3 Commissioner Salvino
Commissioner Salvino commented on the event where Commissioner Grace was honored and he
congratulated her.
Commissioner Salvino spoke of the projects and developments around the City, and noted the
Commission is very busy attending groundbreakings and ribbon cuttings.
11.4 Vice-Mayor Harris
Vice-Mayor Harris congratulated Commissioner Grace on being honored at the event last
Saturday.
Vice-Mayor Harris noted numerous events, meetings and activities the Commission is involved
in.
11.5 Mayor James
Mayor James noted the Commissioners have been invited to Baer's Furniture for a breast cancer
event, which is at 9:30 a.m. on October lst prior to the CRA Workshop at 10:30 a.m.
Mayor James asked about the status of the Class and Pay Study.
Assistant City Manager Donnelly responded there was a delay as the consultant needed
additional information from staff; we should have something back from them this week. He
noted meetings would be set up with the individual Commissioners to discuss the results.
Commissioner Grace asked about the auditor RFP.
Assistant City Manager Donnelly noted comments on the RFP are all back now and the City
Attorney's office is finalizing the document; the RFP will go out to bid this week.

The Commission appointed Dean Harley to fill an unexpired term ending March 2019.

Assistant City Manager Donnelly spoke of the upcoming community meetings that will be held
for the Parks & Recreation Master Plan, and noted the next Oasis cleanup is scheduled for

they so desire, and he will assist in making arrangements if needed.

INTRODUCTION
This report is being submitted as provided by City of Dania Beach Code of Ordinance #16-91. Section (8) of "Rules and
Procedures" which reads as follows:
"A written report shall be submitted to the City Commission not less than once each three (3) month period setting for the
matters considered by the Board along with Board's recommendations to the City Commission. A copy of the minutes of each
shall be submitted to the City Manager."
The Board may consider any related marine matters but is specifically directed to consider items listed in Ordinance #16-91
under "Duties and Responsibilities" and is directed to consider and make a recommendation of the following subjects:
1. Conditions of waterways and needed corrections, including a study of the most feasible and economical method of
maintaining the depths of waterways within the City.
2. Waterway safety and traffic control on waterways.
3. Activities of waterways patrol.
4. Operation of privately owned marinas.
5. Operation of small boat docking areas.
6. Hurricane procedures.
7. Instructional Schools.
8. Relations with the Coast Guard.

Related Issues & Matters
The Marine Advisory Board has for years continuously considered marine quality
issues and the city's ability to manage them. Among these are navigation and safety,
derelict vessels, operation of the City of Dania Beach Marina, etc.
REVISION TO EXISTING SPEED ZONE
Revision of the speed restrictions along Dania Cut Off Canal, from the launching ramp (i.e. IT Parker)
of Harbour Town on the east to west of NE 5t" Court.
The speed revision should be from the existing "slow speed minimum wake" to "idle speed no wake".
MARINE PATROL DEPUTIES & BOAT
For the safety of the Dania Beach boating community, we need our own patrol boat and 2 deputies.
We are currently "borrowing" from the County as needed, but if they are told to go elsewhere for an
event or other situation, we then do not have them in Dania Beach.

Hallandale, Hollywood, Ft. Lauderdale and Lighthouse Point ALL have their Police
Departments ih Marine Units.
Pompano a Deerfield Beach contract to BrowardSheriff's Department AND HAVE
arSheriff's Marine units as part of their program.
Dania Beach contracts to BrowardSheriff's for police work in theircity and has NO marine
units on a dailypatrol on its waterways.
Dania Beach has an ocean pier, 2.7 miles of ocean beachfront, 4 water parks, 17 miles of
navagatible canals, 21 marina's and a multitude of waterfront homes and a newluxury
marina coming soon.

The Need for Additional Boat Ramps
Since the end of the recession, the boating business in South Florida has been booming. The
marine maintenance and repair business can not get enough help. On any given day you can see
signs stating "HELP WANTED MARINE TECHS" on company vehicles.
In Broward County, during the summer and on weekends, boat ramps have been full. At
Harbour Town for, 11 weeks, weekends starting at 9:3oam Saturday, signs go up saying
"CLOSED - Parking Lot Full".
The County Broward Boaters Improvement Program (BBIP) annual revenue estimates for the
next 4 years are $435,000, increasing 3-5% each year.
This Board has discussed this matter for a number of years. The location of the property is just
west of the US 1 bridge and on the north side of the Dania Cut-Off Canal under the existing FPL
high lines. This would make an ideal small boat ramp and picnic area similar to Broward
County's Boater's Park to the west that is seldom used. The site also has a city street that could
provide access to the property.
A site review was conducted by city staff and this Board and all agreed that it was a project that
should be pursued and could be an ideal B.B.I.P. project.

Thank you for the information I will pass ore the
survey and letter from 71m Ryan to FIND staff regarding dredging under (fie bridge and modifying the fender
system to we if this is something we can do. Obviously we will have to modify our permits to include this work
and would also need to add to the bid. I am not sure this is, feasible given the Wnefraryie and the fact the bid is
already out but I would still like tc see if it is something we can do in the near future.
As for the Beaters Park parcel, I think this is a great project and glad to we the County is looking to provide it to
the City. Is it currently owned by the County? I reviewed this, parcel last Veit for a private entity to convert it to
