A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, GRANTING A TEN (10) FOOT EASEMENT TO
FLORIDA POWER & LIGHT COMPANY ("FPL"), IN CONNECTION WITH
THE BEACH REVITALIZATION PROJECT, WHICH EASEMENT IS
LOCATED ADJACENT TO THE BEACH PARKING AREA LOCATED AT
300 N. BEACH ROAD; PROVIDING FOR CONFLICTS, FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, due to the proposed underground work for the FPL power line, it is
necessary to grant a ten (10) foot easement to FPL in order for the City to proceed with the City
of Dania Beach Revitalization Project("Project"); and
WHEREAS, the easement is a non-exclusive easement for the construction, operation
and maintenance of overhead and underground electric utility facilities (including but not limited
to, wires, poles, guys, cables, conduits and appurtenant equipment) to be installed from time to
time, with the right of FPL to reconstruct, improve, add to, enlarge, change the voltage as well as
the size of, and remove such facilities or any of them within the easement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "Whereas" clauses are made a part of and incorporated
into this Resolution by this reference.
Section 2. That the City Commission approves and grants the ten (10) foot
easement to Florida Power & Light Company located at the beach parking area (a copy of the
easement is attached to this Resolution and incorporated by this reference).
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

to the Easement Area at all times;the right to clear the land and keep it cleared of all trees, undergrowth and other obstructions
within the Easement Area; the right to trim and cut and keep trimmed and cut all dead, weak, leaning or dangerous trees or
limbs outside of the Easement Area, which might interfere with or fall upon the lines or systems of communications or power
transmission or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights
hereinabove granted on the Easement Area heretofore described, over, along, under and across the roads, streets or highways
adjoining or through said Easement Area.
