Home My WebLink AboutR-2018-160 City Amending R2018-140; Authorizing Public Services To Utilize Pricing From Cobb County, GA Under the US Communities National Cooperative Program w/ Garland/DBS Inc ($92,650.00) RESOLUTION NO. 2018-160 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING RESOLUTION 2018-140; AUTHORIZING THE PUBLIC SERVICES DEPARTMENT TO UTILIZE PRICING FROM COBB COUNTY, GEORGIA UNDER THE U.S. COMMUNITIES NATIONAL COOPERATIVE PROGRAM WITH GARLAND/DBS INC. INVITATION TO BID ("ITB") NO. 14-5903 FOR ROOFING SUPPLIES AND SERVICES, WATERPROOFING AND RELATED PRODUCTS AND SERVICES FOR REPAIR OF THE OCEAN RESCUE BUILDING LOCATED ON NORTH ROAD, DANIA BEACH, IN AN AMOUNT NOT TO EXCEED NINETY TWO THOUSAND SIX HUNDRED FIFTY DOLLARS ($92,650.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor each fiscal year; and WHEREAS, the Public Services Department requested City Commission approval on September 25, 2018 to enter into an agreement with Garland/DBS Inc. utilizing pricing from Cobb County, Georgia ITB 14-5903 effective through December 31, 2019, for roof repairs of the Ocean Rescue Building in an amount not to exceed Seventy Five Thousand Dollars ($75,000.00); and WHEREAS, the City Commission approved Resolution 2018-140 authorizing a not to exceed amount of Seventy Five Thousand Dollars ($75,000.00); and WHEREAS, labor market conditions have changed due to Hurricane Michael, which has caused an increase in cost, and an updated proposal reflecting that increase is attached as Exhibit "A", resulting in the need for additional funding in the amount of Seventeen Thousand Six Hundred Fifty Dollars ($17,650.00); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission amend Resolution 2018-140 for the purchase of roofing supplies and services from Garland/DBS, Inc. utilizing the Cobb County Contract ITB No. 14-5903, under the U.S. Communities National Cooperative Program, in an amount not to exceed Ninety Two Thousand Six Hundred Fifty Dollars ($92,650.00). Section 3. That the City Manager and City Attorney are authorized to enter into an agreement and make minor revisions to such documents as are deemed necessary and proper for the best interests of the City, provided however, that the City Attorney will be afforded time to review the ITB which is extensive, before an agreement can be executed. Section 4. That additional funding is available in the amount of Seventeen Thousand Six Hundred Fifty Dollars ($17,650.00) and shall be appropriated from the Beach Revitalization Project Phase 2 which has a current available balance of Five Hundred Sixty Four Thousand Nine Hundred Thirty Two Dollars ($564,932.00) leaving a remaining balance of Five Hundred Forty Seven Thousand Two Hundred Eighty Two Dollars ($547,282.00). Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall become effective upon its passage and adoption. PASSED and ADOPTED on November 13, 2018.
