RESOLUTION NO. 2018-164 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING AND RATIFYING A CONTRACT UTILZING PRICING UNDER THE UNDER BROWARD COUNTY BOARD OF COMMISSIONERS SOLICITATION T1368213B1 AND FURTHER AUTHORIZING THE EXPENDITURE OF FUNDS BY THE PUBLIC SERVICES DEPARTMENT FOR EMERGENCY REPAIRS OF THE NORTHWEST 1st STREET BRIDGE OVER THE C-10 CANAL BY BLUEWATER BUILDERS, INC. FOR FISCAL YEAR 2018-2019, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED SEVENTY ONE THOUSAND EIGHT HUNDRED FORTY ONE DOLLARS AND EIGHTEEN CENTS ($271,841.18); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor each fiscal year; and WHEREAS, on October 1, 2018, an incident occurred at the bridge in which a boat passed under the bridge and a concrete portion of a concrete slab fell from the bridge and into the boat; and WHEREAS, the Northwest 1st Street Bridge was constructed in 1958 and the bridge is City-owned and maintained; and WHEREAS, the Federal Highway Administration ("FHWA") holds the Florida Department of Transportation ("FDOT") administratively responsible to ensure that all qualified bridges in the State are inspected in accordance with statutes and federal codes; and WHEREAS, the Public Services Department requested that FDOT perform a special bridge inspection following the reported incident; and WHEREAS, the City received the report on October 16, 2018 from FDOT indicating a degradation of the superstructure (deck) and gave the deck a grade of"Serious" as opposed to a previous inspection report dated January 12, 2017, which graded that portion of the structure as "Satisfactory"; and WHEREAS, the Northwest 1st Bridge is in need of emergency repairs to restore its structural integrity as well as implement work necessary to correct major safety defects; and WHEREAS, Broward County Highway and Maintenance Division has granted permission to the City to "piggy-back" off of their contract with Bluewater Builders, Inc.; and WHEREAS, Bluewater Builders, Inc., will work under the direct guidance of an independent bridge engineering company, BMA Consulting Engineering, Inc., as represented by Jesus A. Mustafa, P.E., P. Eng., located in Pembroke Pines, Florida; and WHEREAS, Bluewater Builders, Inc., has proposed an amount not to exceed Thirty Four Thousand Seven Hundred Fifty Dollars ($34,750.00) for professional engineering services under their proposal which is below the $35,000.00 threshold under Florida Statute Section 297.055 (Consultant's Competitive Negotiation Act, the "CCNA"); and WHEREAS, Bluewater Builders, Inc., will perform emergency repairs to the structural bridge for a total amount not to exceed Two Hundred Seventy One Thousand Eight Hundred Forty One Dollars ($271,841.00); and WHEREAS, the Public Services Department is seeking approval to exceed the $25,000.00 threshold for any necessary future repairs for the remainder of Fiscal Year 2018-2019 provided funding is available and appropriated in the current budget year; and WHEREAS, since the work is, in effect, a "design-build" project, the Mayor of the City declared a public emergency to ensure the repairs are expedited and negotiations with the best qualified firm available have been conducted (see Florida Statutes Section 284.055(9)(c)(6); and Section 255.0525(3) and(5)); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes and ratifies the purchase of emergency construction services from Bluewater Builders, Inc., in an amount not to exceed Two Hundred Seventy One Thousand Eight Hundred Forty One Dollars and Eighteen Cents ($271,841.18). 2 RESOLUTION#2018-164 Section 3. That funding for these repairs shall be appropriated and funded by a transfer from various Enterprise Funds (Water, Sewer, Storm) and General Funds (Streets and Reserves)to the Capital Projects Fund, as follows: General Fund Streets 001-39-06-539-46-60 $115,000.00 General Fund Reserves 001-00-00-389-90-01 $145,484.00 Water Fund Distribution—401-33-02-533-46-70 $ 1,990.00 Sewer Fund Distribution—402-35-02-535-56-70 $ 4,477.00 Stormwater Fund Repair&Maintenance $ 4,890.00 403-3 8-01-53 8-46-60 Section 4. The work to be performed for the City consists of performing emergency bridge repairs to the Northwest 1" Street bridge, located in Dania Beach. The proposal, including the 1 scope of work and drawings submitted by the Contractor is attached as Exhibit `B" and incorporated by this reference. 3. City agrees to pay the Contractor a not to exceed amount of Two Hundred Seventy One Thousand Eight Hundred Forty One Dollars and Eighteen Cents ($271, 841.18), which will be invoiced to the City monthly. This Agreement is subject to the City's "Prevailing Wage Ordinance", a copy of which is attached and incorporated by this reference, identified as Exhibit"A". 4. That in all other respects, the terms of the Broward County ITB and which document apply to this Agreement. 5. City or Contractor may request changes that increase, decrease or otherwise modify the Work, as described in this Agreement. These changes may affect the compensation, and, if so, they must be described in a written Amendment to this Agreement, executed by the authorized agents of both of the parties, prior to any deviation from the terms of this Agreement. Every construction contract in excess of fifty thousand dollars ($50,000.00) to which Dania Beach is a party shall include a provision that the rate of wages and fringe benefits, or cash eauivalent.for all laborers,mechanics and apprentices and similar jobs (i.e., non-office), listed by the Department of Labor, Employment Standards Administration, Wage and Hour Division and employed by any contractor or subcontractor on the work covered by the contract shall not be less than the prevailing rate of wages and fringe benefit payments or cash equivalent for similar skills or classifications of work as established by the General Wage Determinations Issued Under the Davis-Bacon and Related Acts U.S. Department of Labor, Employment Standards Administration. Wage and Hour Division, for Broward County, Florida. (b) Implementation of the Department of Labor General Wage Determinations. The prevailinq wa a rate and fringe benefit payments to be used in the implementation of this section shall be those last published by the U.S. Department of Labor as noticed in the Federal Register and reported in the General Wage Determinations Issued Under the Davis-Bacon and Related Acts prior to the date of issuance of specifications by Dania Beach in connection with its invitation for bids. (c) Notice Requirement. The provisions of this section shall not apply to any existing contract or construction project in which a notice for bids or request for proposals has been advertised in the public media prior to the effective date of this section or to any developer agreement whereby Dania Beach is requiring the construction of certain improvements including, but not limited to, road construction, as condition of the issuance of a development permit or to any construction project performed by Dania Beach utilizing its own employees. Section 2. If any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 3. All ordinances or parts of ordinances or resolutions or parts of resolutions in conflict with the provisions of this ordinance are hereby repealed. Section 4. Is this Action Goal Related Previous Action Taken None Summary Explanation/Background THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION. The Office of Economic and Small Business Development (OESBD) established a 30% County Business Enterprise (CBE)participation goal for this contract. Bluewater Builders, Inc. committed to 30% CBE participation, which the OESBD reviewed and approved (Exhibit 2). The purpose of this contract is to provide an open-end contract for the performance of miscellaneous bridge and bridge- related construction, repair and maintenance activities. The allowances incorporated in this contract, in the estimated annual amount of$330,000, include: $75,000 for miscellaneous parts and materials; $100,000 for unforeseen conditions; $150,000 for specialized construction activities not already priced; and $5,000 for non-County agency permits and inspection fees. Expenditures under these allowances must be approved by the contract administrator and will be reimbursed at the contractor's actual incurred cost,without mark-up. In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code Section 19.211, these services are subject to the Workforce Investment Program.
