HomeMy WebLinkAboutR-2018-166 City Authorizing To Execute A Financial Statement Audit Engagement Letter With HCT Certified Public Accountants & Consultants, LLC, For Professional Auditing Services, Under RFP No. 18-017 RESOLUTION NO. 2018-166 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A FINANCIAL STATEMENT AUDIT ENGAGEMENT LETTER WITH HCT CERTIFIED PUBLIC ACCOUNTANTS AND CONSULTANTS, LLC, FOR PROFESSIONAL AUDITING SERVICES, UNDER REQUEST FOR PROPOSAL NO. 18-017; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is required to conduct an annual financial statement audit by use of a qualified public accounting firm under rules of the State Auditor General and in accordance with Florida Statutes, Section 218.39 (b); and WHEREAS, a letter dated July 12, 2018, received from the Florida Attorney General's Office, confirmed the City's need to publicly solicit proposals for financial statement audit services under Florida Statutes 218.391, after the last auditor engagement ended; and WHEREAS, on July 24, 2018, the City Commission established an audit committee for the purposes of developing a request for proposals ("RFP"), establishing evaluation criteria, evaluating proposals received, and as required by state law, ranking and recommending in order of preference no fewer than three firms deemed to be the most qualified, pursuant to Florida Statutes Section 218.391(3)(e); and WHEREAS, the City publicly solicited for responses to the RFP for qualified accounting firms to provide annual financial auditing services for the City of Dania Beach; and WHEREAS, on October 26, 2018, at 10:30 a.m. the City held its RFP response opening and received a total of eight(8)proposals; and WHEREAS, on November 2, 2018 at 11:00 a.m. the audit committee met and evaluated the proposals received and has recommended and ranked, in order of preference, the top three (3) ranked firms, in accordance with the Florida Statutes, Section 218.391 (3) (e) and the guidelines of the State Auditor General as follows: • Rank No. 1: (highest) Mauldin&Jenkins, LLC • Rank No. 2: Keefe McCullough, LLP • Rank No. 3: Marcum, LLP WHEREAS, in accordance with Florida Statutes Section 218.391(4)(b), since compensation is one of the factors established in the RFP and used in the evaluation of proposals, "the governing body shall select the highest-ranked qualified firm or must document in its public records the reason for not selecting the highest-ranked qualified firm"; and WHEREAS, the Florida Auditor General Audit Selection Guidelines state that if an entity chooses to select a firm other than the Audit Committee's highest recommended firm "it would be reasonable to assume that justification is necessary and should be documented for the selection of any firm over a higher ranked firm"; and WHEREAS,the audit engagement will provide for an initial three (3) year contract with the option of two (2) one year renewals subject to approval by the City Commission; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are acknowledged as factual and correct and they are made part of and incorporated into this Resolution by this reference. Section 2. That the City Commission of the City of Dania Beach authorizes the proper City officials to execute an audit services engagement letter agreement with HCT Certified Public Accountants And Consultants, LLC, as the provider of City annual financial auditing services for a period of three (3) years (for the years ending September 30, 2018, 2019 and 2020) as outlined in the RFP document, with a possibility of two (2) one (1) year renewals at the City's option. Section 3. That the City Commission further authorizes the proper City officials to take all steps necessary to execute an engagement letter for financial auditing services with the firm. Section 4. That all Resolutions or parts of resolutions in conflict with any portion of the provisions in this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and become effective immediately upon its passage and adoption. PASSED AND ADOPTED on Novembra 13, 2018.
