MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, JANUARY 22, 2019 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:00 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event Request from the Community Redevelopment Agency for the "Dania Beach 2019 Arts and Seafood Celebration", to be held on March 30-31, 2019, at Frost Park from 11:00 a.m. - 8:00 p.m. on Saturday and from 11:00 a.m. - 6:00 p.m. on Sunday. The applicant is requesting BSO Police and Fire Services, and road closure for Fronton Boulevard from N.E. 2nd Street to N.E. 1 st Street. Assistant City Manager Donnelly noted the police and fire services requested are covered under our contracts with BSO, as we are allowed a certain number of events per year. Commissioner James motioned to approve the Special Event request for the 2019 Arts and Seafood Celebration, including BSO services and road closure; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.2 Special Event request from Dania Beach Lions Club for their Moonlight Classic Car Show to be held at Frost Park on February 23, 2019 from 6:00 p.m. - 10:00 p.m. The applicant is requesting Special Event fee waiver of$150.00, Port-o-toilets for Frost Park, and BSO Police Escort and Security Details for the event. Commissioner Harris motioned to approve the Special Event request for the Lions Club Moonlight Classic Car Show, including fee waiver, port-o-toilets and BSO services; seconded by Commissioner James. The motion carried unanimously. 3.3 Special Event request by the South Florida Regional Transportation Authority (Tri- Rail) to have their annual "Rail Fun Day" to be held at 500 Gulf Stream Way on January 26, 2019 from 11:00 a.m. - 3:00 p.m. Commissioner James motioned to approve the Special Event request for the annual Rail Fun Day; seconded by Commissioner Harris. The motion carried unanimously. 4. Proclamations 4.1 Deputy Louis Bautista- Captain Daniel Marks, BSO District Chief Mayor Lewellen presented a proclamation from the City of Dania Beach to Deputy Louis Bautista on the occasion of his retirement after 39 years of service to the Dania Beach community. Commissioner James noted Mr. Bautista's service was honorable and thanked him for service. 5. Citizen Comments Craig Valentine, 1982 Tigertail Boulevard, thanked the Commission for their donation to the wrestling school at the last meeting. He provided Parks and Recreation Director Brown 30 tickets for an upcoming wrestling show. Millie Krei, 212 SE 8th Street, spoke about safety concerns associated with AirBnBs in her neighborhood. Simone Chait, 228 SE 8th Street, spoke about AirBnBs that are not in compliance and the lack of checks and balances and information. Vice Mayor Odman suggested Ms. Chait e-mail her concerns to the Commission and staff. Joe Petruzzelli, 216 SE 8th Street, spoke about AirBnBs and noted they have gotten out of hand. He added residents need help. Jonese Hargadon, 226 SE 8th Street, commented short-term rentals change the character of neighborhoods and the problem needs to be addressed aggressively. Commissioner James addressed how the City Commission and City staff are aware of the AirBnB issues and are actively pursuing the issues. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Marc LaFerrier, Director of Community Development, noted local laws cannot preempt the state law; however, we have very strong regulations in Dania Beach. He addressed ongoing efforts being undertaken by Code Compliance. Mayor Lewellen confirmed residents can call Code Compliance for complaints. Commissioner Harris suggested residents form a homeowners association in the neighborhood to prohibit Airbnb rentals through association documentation. City Attorney Ansbro stated single family homes are not qualified under State law to form a homeowners association; however, residents communicating with staff will assist in bringing enforcement and compliance. Vice Mayor Harris spoke of the law not keeping up with technology and legal staff looking into what is in involved in putting together a HOA. Commissioner Brandimarte asked Community Development Director LaFerrier about the number of permits the City has issued for AirBnBs and suggested bringing in the person who spoke at the League of Cities to explain the AirBnB process to residents. Simone Chait, 228 SE 8t' Street, mentioned Los Angeles California establishing a law to prohibit AirBnB rentals. Bobbie H. Grace, 110 NW 8t'Avenue, thanked everyone for being a part of the MLK events this past weekend. She reminded the Commission to honor their commitments, and asked the Commission to budget an additional $5,000.00 each for the Seniors Program and Gracefully Aging. Assistant City Manager Donnelly explained both programs were running short on funds last year and the Commission voted to put $5,000.00 in both accounts. After the budget year ends, the monies not spent are returned back to the General Fund. The new budget for both programs is now$25,000.00 and any additional funding would come from Commissioner Contingency. Commissioner James said we should replace the money returned to the City and not rollback remaining funds in the future. Commissioner Brandimarte noted the groups never see the actual money; it is kept in the City. Vice-Chairman Odman motioned to return the money to Gracefully Aging and the Seniors Program; seconded by Commissioner James. The motion carried unanimously. Antonio Arcieri, 2601 S.W 58t' Manor, noted State law requires form HR 7028 is to be filed to rent a room and the City requires a Business Tax Receipt for the owner of property renting long- term. Jose Armand, 50 SE 3rd Avenue, spoke about the subtitles on the streaming of the meetings. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Maria DeVito, 1951 Atlantic Shores Boulevard, #19, Hallandale Beach, asked if the Dania Beach Grill is going to be paved over to become a parking lot or developed as condominiums. John Sanders, 214 NE 5`" Avenue, spoke of the significance of the Dania Beach Grill and hopes the Commission does the right thing with it. Mitchel Mestel, 2641 Taft Street, Hollywood, spoke of the charm of the Dania Beach Grill and the importance of keeping it that way. Mayor Lewellen advanced Item 10.1 at this time. 10.1 Dania Beach Grill -Assistant City Manager Donnelly Assistant City Manager Donnelly noted the proposal was never to demolish the grill. The Commission is being asked to issue an RFP for a tenant and keep the current tenant on a month- to-month lease basis. No one is looking to do away with the type of establishment that it is. Vice-Mayor Odman asked if the tenant was in an agreement with a month-to-month lease. Tom Barth, 650 North Beach Road, Dania Beach Grill tenant, spoke about going month to month. Vice-Mayor Odman asked if we have the discretion with the RFP to say we do not want a fancy place there; we do want to keep a beach grill. Assistant City Manager Donnelly responded we would say what we would want. Mayor Lewellen confirmed the current tenants can respond to the RFP. Commissioner Brandimarte said she favored month-to-month and issuing an RFP. She noted the road would be raised under Phase 2 of the revitalization. Whoever bids, the Commission will discuss and vote on it. Mr. Barth noted he has been there five years and tries to get everyone involved. He understands the changes that want to be made, but we need a team effort. He cannot afford what the City is talking about. Commissioner Harris asked Mr. Barth how we can assist him with getting the equipment he needs. The City owns the property and we can possibly help; we are here to help him. Mayor Lewellen commented tonight's meeting was to not to get in negotiations, but to pick from the three options provided to the Commission. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Assistant City Manager Donnelly responded that the Commission has the option to specify suggestions of assistance. Patricia Faver, 200 SE 5th Avenue #608, commented she would like to see the grill stay exactly the way it is. It has created a neighborhood feel that brings magic to the people who go there. Neris Franco, 13643 SW 92nd Court, Miami, spoke in support of the Dania Beach Grill. Jeff Broder, 2621 McKinley Street, Hollywood, spoke in support of keeping the Dania Beach Grill's character and encouraged the Commission to move forward with Option 3. Lee Ferreri, 3120 W Hallandale Beach Boulevard, Hallandale Beach, spoke about the character of the grill and the importance of keeping it the way it is. Clayton Goldstein, 1035 NW 73rd Terrace, Margate, commented on the significance and balance of the Dania Beach Grill. Commissioner James commented she likes the month-to-month basis because we are not sure where we are headed. We do not need another Quarter Deck. She asked what the City is responsible for concerning the property. City Attorney Ansbro responded the roof and walls are the responsibility of the City. He noted there are several code violations. Commissioner James said we should work with them; she is for keeping everyone safe, but we need to take into account the age of the building. We should go out to RFP to see what other things are out there. She is also interested in the tenant terms. Commissioner Brandimarte noted there are a lot of things the tenant is responsible for; she wants to see an effort made to bring things the tenant is responsible for up-to-date. If Mr. Barth wants her support, he needs to show he wants to cooperate to take care of the violations and taxes. Vice-Mayor Odman motioned to move forward with Option 3, issue a RFP for the restaurant and keep the current tenant on a month to month basis until a new tenant is in place; seconded by Commissioner Brandimarte. Mayor Lewellen agreed there needs to be specifics in the REP that makes this a beach bar, a location where you can come off the beach in a bathing suit and order food and drinks. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on trending criminal activity in the City. He noted BSO has threat assessments available for businesses or individuals. Commissioner Brandimarte questioned complaints received regarding vacation rentals. Commissioner James thanked BSO for their services during recent City events. Sean Brown, Battalion Chief, BSO Fire Rescue, introduced himself to Mayor Lewellen and Vice-Mayor Odman, and spoke of Memorial Regional and Hollywood getting a joint grant for Stop the Bleeding kits. Vice Mayor Lewellen questioned if training would be provided to learn how to use them. 7. Minutes of Regular Meeting Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. 7.4 RESOLUTION#2019-011 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE RELEASE OF CODE ENFORCEMENT LIENS, CITY LIENS AND OTHER ENCUMBRANCES FOR ELEVEN (11) PARCELS OF LAND CONVEYED OR APPROVED FOR CONVEYANCE BY THE CITY TO THE DANIA BEACH COMMUNITY REDEVELOPMENT AGENCY ("CRA") FOR THE PURPOSE OF AFFORDABLE HOUSING DEVELOPMENT; AUTHORIZING THE PROPER CITY OFFICIALS TO PREPARE AND RECORD RELEASES AND RELATED DOCUMENTS FOR EACH PARCEL FOR THIS PURPOSE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-011. Commissioner James noted we had discussion; she is unsure why every single lot has a lien or code enforcement violations. Marc LaFerrier, Director of Community Development, explained an outside attorney did the initial lien search. The internal City search was not completed until the properties were conveyed to the CRA and brought before the Planning and Zoning Board for variance requests. Commissioner James asked if there is someone from Community Development who is going to keep better track of City property. Community Development Director LaFerrier explained that the City does have an internal process to check properties for liens before an application comes before the City Commission or Planning and Zoning Board. Commissioner James asked if we have to make an approval for the $754.00 payment or if it could be waived. Assistant City Manager Donnelly responded provision is made in the Resolution. Commissioner James motioned to adopt Resolution #2019-011; seconded by Commissioner Harris. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2019-001 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND CHAPTER 28, OF THE "LAND DEVELOPMENT CODE," OF THE CITY'S CODE OF ORDINANCES BY AMENDING ARTICLE 110 "USE REGULATIONS FOR COMMERCIAL AND MIXED-USE DISTRICTS," Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. AMENDING ARTICLE 265 "OFF-STREET PARKING REQUIREMENTS," AMENDING ARTICLE 303 "DISTRICT DEVELOPMENT STANDARDS,"AND AMENDING ARTICLE 635 "SITE PLANS;"PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING FOR INCLUSION IN THE CODE; FURTHER PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2019-001. Corinne Lajoie, Planning& Zoning Manager, gave an overview of the text amendments. Commissioner James asked what is currently allotted for parking in retail pharmacy. Planning & Zoning Manager Lajoie said the current code is one space per 300 square feet of floor area. Commissioner James asked if item #5 would address other streets such as Dania Beach Boulevard and Stirling Road. Planning& Zoning Manager Lajoie responded no because the districts are zoned differently. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice Mayor Odman motioned to adopt Ordinance#2019-001, on first reading; seconded by Commissioner James. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2019-002, and advised the item was a quasi- judicial hearing and swore-in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Planning& Zoning Manager, gave a presentation on the rezoning request. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Commissioner James questioned the building allowance height going up two stories. Planning & Zoning Manager Lajoie responded the structure could possibly go up to three stories but not exceed three. Commissioner James noted her concern of changing the character of the neighborhood. People do not turn out for these meetings and may not be aware of the change. Planning & Zoning Manager Lajoie said this is the second meeting on this item and we have not heard from anyone other than the applicant. Commissioner Harris noted he was at the Planning & Zoning Board meeting in November and no one objected. Commissioner Harris motioned to adopt Ordinance #2019-002, on first reading; seconded by Vice-Mayor Odman. Discussion and Possible Action 10.1 Dania Beach Grill - Assistant City Manager Donnelly This item was taken up immediately after Item 5, Citizen Comments. 10.2 RESOLUTION NO. 2019-012 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,ADOPTING A YOUTH INTERNSHIP PROGRAM FOR HIGH SCHOOL AND COLLEGE STUDENTS; PROVIDING FOR CONFLICTS;FURTHER PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2019-012. Commissioner James noted we have a lot of colleges in our area; we could get a lot of help from interns from there and from the high schools. Mayor Lewellen noted we need to be sure to identify which departments want an intern. Commissioner James said we should leave that up to the departments. Assistant City Manager Donnelly said HR has finalized their volunteer policy; it is going through our labor attorney. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Commissioner James also wants to determine if the Commission would get an intern, since they are not a department and whether the Commission would author a letter of recommendation. Assistant City Manager Donnelly said we would have a draft volunteer policy at the next Commission meeting. Commissioner James motioned to adopt Resolution #2019-012; seconded by Commissioner Harris. The motion carried unanimously. 10.3 Deferred utility payments for furloughed Federal employees - Vice-Mayor Odman Vice-Mayor Odman said last week she attended Bass Pro Shops feeding families of federal employees in their parking lot. Since we do not know how long the government shutdown will continue, it seems we should consider a 30-60 day deferment of City utility payments. Nicki Satterfield, Director of Finance, explained we have a long-term provision in our Code; however she feels we could implement a temporary deferment for Federal workers, understanding the risk posed by rental properties. Vice-Mayor Odman said we could do 30 days after the shutdown ends and then put them on payment so they are not stuck with one large bill. Director of Finance Satterfield said we could do an agreement for payment, and suggested no longer than 3 to 6 months. Vice-Mayor Odman said we are talking about a very small number of families in the City. Mayor Lewellen suggested however many months they are out, they would have the same amount of months to pay back what is owed. Commissioner James took exception; she would not go for how many months they are out of work because financial situations differ for each family. She questioned if the process would be the same for those who are renting. Director of Finance Satterfield responded the process is the same, but there is a risk to the City that the tenant might leave. Commissioner James motioned to approve deferment of utility payments for furloughed Federal workers; seconded by Commissioner Harris. The motion carried unanimously. 11. Commission Comments 11.1 Commissioner Brandimarte Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Commissioner Brandimarte thanked Commissioner Grace for the MLK event and Gangrel's for giving out tee shirts. 11.2 Commissioner Harris Commissioner Harris referred to the discussion and motion made at the last meeting regarding issuing a RFP for legal services. He did not understand the motion was to approve a RFP and thought it was a motion to delay any action until after a City Manager was selected, which is why he voted yes. He realized he voted incorrectly after he reviewed the minutes and audio recording of the meeting, and wishes to change his vote on that motion. A brief discussion ensued. City Attorney Ansbro clarified the motion was to prepare a RFP, and Commissioner James amended it to put the RFP in draft form. He believes Commissioner Harris' concern is that not even that be done until after the new City Manager is here. Commissioner James restated her intended motion. Commissioner Harris responded it was clear that we had a lot of discussion, but it was unclear on how we voted. Commissioner Harris motioned to reconsider the legal services item from the last meeting; seconded by Commissioner Brandimarte. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Odman Yes Commissioner Harris Yes Mayor Lewellen Yes Commissioner James Yes Commissioner Harris motioned to not do an RFP and to not do any additional thing in Legal Services until we have a new City Manager; seconded by Commissioner Brandimarte. Commissioner James questioned whether we are going to hold all RFPs until we get a new City Manager. Mayor Lewellen said this had more to do with people who the Commission directly hires and less to do with other RFPs that are going on within the City. Vice-Mayor Odman noted it is Commissioner Harris' right if he wants to be clear on what he wants to do. The motion carried on the following 3-2 Roll Call vote: Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. Commissioner Brandimarte Yes Vice-Mayor Odman No Commissioner Harris Yes Mayor Lewellen Yes Commissioner James No 11.3 Commissioner James Commissioner James spoke of the MLK festivities and thanked everyone. 11.4 Vice-Mayor Odman Vice-Mayor Odman had no comments. 11.5 Mayor Lewellen Mayor Lewellen asked if Vice-Mayor Odman and Commissioner James' trip to Washington, D.C. was cancelled. Commissioner James explained parts of the conference were cancelled because of the government shutdown, so it was decided to cancel the trip. We are trying to get our money back. Vice-Mayor Odman said many of her conferences in Washington, D.C. were cancelled. Mayor Lewellen noted her concern is the spending overall; she thinks we need to look at travel as if it is our own money. To include that trip to Washington, we are up to spending $12,000.00, and this is January. She suggests we be conscious of the amount of money we are spending. Commissioner James said she was elected and serves this City. We have a different Commission and economy. She would not request something if she did not think it did not have value. She will continue to do travel requests when she thinks it is for something valuable. Commissioner Harris explained how he had to stay at the host hotel for past travel, even though he had the opportunity to stay in a less expensive hotel. Commissioner Brandimarte said Mayor Lewellen is out of her realm of authority. She would never tell a Commissioner they cannot travel. Vice-Mayor Odman appreciates the Mayor's concern; however, we have a Commission that sees great value traveling and bringing back information to the City. She does not take the training lightly. We will continue to travel. Mayor Lewellen said she thinks many conferences are beneficial. She just wants everyone to be aware of how much we spend. 12. Appointments Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday,January 22,2019—7:00 p.m. 12.1 Airport Advisory Board—no appointments 12.2 Green Advisory Board Commissioner James appointed: Alexis Guillen 12.3 Marine Advisory Board—no appointments Commissioner James noted Kayla Gardner would need to be replaced on the Education Advisory Board as she is a City employee. 12.4 Parks, Recreation and Community Affairs Advisory Board Commissioner Brandimarte appointed: Jimmie Peterman Commissioner Harris appointed: Dr. Tamara Fishman 12.5 Planning& Zoning Board The Commission appointed David Nuby, Jr. as an Alternate member. Commissioner Brandimarte motioned to approve the appointments; seconded by Vice- Mayor Odman. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager Assistant City Manager Donnelly spoke of the MPO meeting last week concerning the transportation surtax. More discussions on the 10% municipal share will be held and there will be something brought to the Commission on it. He will discuss the process with Commissioner Harris. Assistant City Manager Donnelly reported we have received our Notice to Proceed for the LAP Grant and we will bring a resolution to the Commission to approve bidding of project. Assistant City Manager Donnelly noted the beach sand project is going forward, starting early next month. Assistant City Manager Donnelly said he spoke with Rana Brown, who works for our legislative consultant, regarding putting in an application to offset costs for the NW/SW lst Avenue waterline. He will include that in our legislative package, as well as language concerning Air BnBs.
