A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
PROCEED WITH ADVERTISEMENT FOR BIDS FOR CONSTRUCTION OF
THE TRANSPORTATION IMPROVEMENTS CONTEMPLATED IN THE
LOCAL AGENCY PROGRAM ("LAP") AGREEMENT BETWEEN THE CITY
OF DANIA BEACH AND THE FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT") FOR THE PROJECT NAMED "DANIA
BEACH CITYWIDE IMPROVEMENTS OF VARIOUS LOCATIONS";
PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 2-16 of the City Code of Ordinances provides that the CRA
and all City Departments, Divisions, and staff, prior to placing an item on a City Commission
agenda for formal City Commission approval for competitive bidding or for waiver of bidding,
shall obtain in advance City Commission conceptual approval by Resolution of any proposed
capital project or capital purchase appropriated in the City Budget approved by the City
Commission when bidding would otherwise be required, and the Resolution shall also identify
all sources of planned funding, including appropriations of available cash balances, loans and
grants; and
WHEREAS, the Public Services Department is requesting authorization to bid the Florida
Department of Transportation ("FDOT") Local Agency Program ("LAP") Agreement to
implement the "Dania Beach Improvement of Various Locations"Project; and
WHEREAS, the City Commission approved via Resolution 2016-064 FDOT funding by
an award letter in the initial amount of Four Hundred Eighty Thousand Six Hundred Seventy-Six
Dollars ($480,676.00); the scope of services was subsequently reduced, resulting in a revised
estimated construction cost of Four Hundred Thirteen Thousand Two Hundred Fifty Five Dollars
($413,255.00), which reduced the corresponding grant amount to Three Hundred Forty Four
Thousand Three Hundred Seventy-Nine Dollars ($344,379.00); and
WHEREAS, the City Commission approved the reduced amount and enter into an
agreement for the reduced grant amount via Resolution 2018-168 on December 11, 2018 and
entered into a formal agreement between the City of Dania Beach and FDOT; and
WHEREAS, the City is responsible for the cost of the design, which was previously
funded, and construction engineering inspection (CEI) services, which are estimated to cost One
Hundred Three Thousand Three Hundred Thirteen Dollars ($103,313.00); and
WHEREAS, the City will be responsible for all non-reimbursable costs and reimbursable
costs beyond the program award of Three Hundred Forty-Four Thousand Three Hundred
Seventy-Nine Dollars ($344,379.00), which results in an estimated construction cost share of
Sixty-Eight Thousand Eight Hundred Seventy-Six Dollars ($68,876.00); and
WHEREAS, the City Commission has previously approved contingency funding in the
amount of Forty-One Thousand Three Hundred Twenty-Five Dollars ($41,325.00); and
WHEREAS, City funds were approved for FDOT and the LAP Agreement in the amount
of Two Hundred Thirteen Thousand Five Hundred Fourteen Dollars ($213,514.00) from the
Grant Fund; and
WHEREAS, the subject LAP Agreement has been executed by the City Manager and by
FDOT, effective January 22, 1019; and
WHEREAS,FDOT has issued the City a Notice to Proceed dated January 22, 2019; and
WHEREAS, the subject LAP agreement will expire on December 31, 2020, and all work
must be completed prior to that date; any costs incurred after the contract expiration date are not
eligible for reimbursement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission authorizes the City to proceed with bidding to
implement the "Dania Beach Improvement of Various Locations" Project.
Section 3. That funding was approved and is available and appropriated for this
project in the Grants Fund TAP Grant Project Account#103-39-59-541-63-10.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall become effective upon its passage and adoption.
