MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, FEBRUARY 12, 2019 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:00 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation by Principal Valerie Harris, Olsen Middle School, on the Magnet Program with South Broward High Principal Harris thanked the Commission for the $2,000 charitable donation and gave an overview of Olsen's Magnet Program, which is in collaboration with South Broward High School. 3.2 Update on Broward Reads by Dr. Tia Major, Dania Beach Community Liaison, Founder& CEO of Broward Literacy Inc., Dr. Major provided an update on the Broward Reads Literacy Coalition Program. 3.3 Special Event Request from the Marine Industries Association of South Florida for their "42nd Annual Broward County Waterway Cleanup" to be held on March 2, 2019, from 9:00 a.m. - 1:00 p.m. This event will be held in various locations around Dania Beach such as Dania Beach Pier/Marina, Secret Woods Nature Center, Harbour Towne Marina and Dr. Von D. Mizell-Eula Johnson State Park. The applicant is also requesting the following: a Special Event fee waiver of $150.00, waiver of parking fees for volunteers, and for the City to provide dumpsters for all cleanup sites. Commissioner James motioned to approve the Special Event request for the 42°d Annual Broward County Waterway Cleanup; seconded by Commissioner Harris. The motion carried unanimously. 3.4 Special Event request by Dolphins Cycling Challenge, Inc. for the annual Miami Dolphins Charity Bike Ride Cancer Challenge to be held April 6, 2019, beginning and ending at the Hard Rock Stadium, 347 Don Shula Drive, Miami Gardens, Florida from 8:15 a.m. - 12:00 p.m. Commissioner James motioned to approve the Special Event request for the annual Miami Dolphins Charity Bike Ride Cancer Challenge; seconded by Commissioner Harris. The motion carried unanimously. 3.5 Special Event request from The Field Irish Pub and Eatery, 3281 Griffin Road, for their annual St. Patrick's Day Celebration to be held on March 17, 2019 from 11:00 a.m. - 11:00 p.m. The applicant is also requesting a road closure on Griffin Road, fence,temporary signage, and BSO Detail. Commissioner James motioned to approve the Special Event request for the St. Patrick's Day Celebration; seconded by Commissioner Harris. The motion carried unanimously. 4. Proclamations 4.1 Eating Disorders Awareness Week - Sharon Glynn, Director of Operations, The Alliance for Eating Disorders Awareness Mayor Lewellen read the Eating Disorders Awareness Week Proclamation and presented it to Dr. Elizabeth Gleyzer from The Alliance for Eating Disorders Awareness. 4.2 Black History Month- Commissioner James Commissioner James read the Black History Month Proclamation. 5. Citizen Comments Elena Nikolasukina, 301 N Bryan Road, distributed information to the Commission and spoke about her gymnastic program and classes, which also includes dancing lessons. Lori Baer, Executive Director of Port Everglades Association, thanked the City for its past participation in the Economic Engine Performance Report event and invited the Commission to this year's event on April 26t1i. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Emmanuel George, 17 NE 2"d Avenue, Apt. 106, spoke about his recent movie premier work on the Black Broward Film Project and thanked the Commission and community for their past support. 6. Public Safelyports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity, and noted the BSO Shred-a-thon/Operation Medicine Cabinet is scheduled for April 27ffi at Bass Pro Shops. Deputy Chief Gregory Holness, BSO Fire Rescue, emphasized precautions that should be taken to avoid the flu virus, and spoke of the recent report out on EMS calls. 7. Commissioner Harris motioned to adopt the Consent Agenda; seconded by Vice-Mayor Odman. The motion carried unanimously. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2019-015 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING A BID AWARD TO BE GRANTED TO JEFF ELLIS & ASSOCIATES, INC., A TEXAS CORPORATION D/B/A JEFF ELLIS MANAGEMENT,LLC,A FOREIGN CORPORATION AUTHORIZED TO DO BUSINESS IN FLORIDA, FOR LIFEGUARD, OPERATION AND MAINTENANCE SERVICES FOR THE C.W. THOMAS PARK POOL AND THE P.J. City Attorney Ansbro read the title of Resolution#2019-015. Commissioner James motioned to adopt Resolution #2019-015; seconded by Vice-Mayor Odman. The motion carried unanimously. 9. Public Hearings and Site Plans 9.1 RESOLUTION#2019-016 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-80-18) SUBMITTED BY DANIA LIVE 1748, LLC FOR PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF STIRLING ROAD BETWEEN BRYAN ROAD AND INTERSTATE 95 WITHIN THE CITY OF DANIA BEACH, FLORIDA, ASLEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. City Attorney Ansbro read the title of Resolution#2019-016, and advised this is a quasi-judicial hearing and swore in those who would speak. He asked the Commission to disclose any communication they had on this matter. Corinne Lajoie, Planning & Zoning Manager, gave an overview of the site plan request for the Dania Pointe development. Commissioner James asked that the applicant only be allowed to use the City logo, not the City seal, as the slides incorrectly noted. Denis Mele, Greenspoon Marder, on behalf of the applicant, was available to answer questions. Mayor Lewellen opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice Mayor Odman motioned to adopt Resolution #2019-016; seconded by Commissioner Brandimarte. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Odman Yes Commissioner Harris Abstained Mayor Lewellen Yes Commissioner James Yes 10. Discussion and Possible Action 10.1 Update on Vacation Rental matters - Commissioner Harris Commissioner Harris spoke of a meeting held January 23, 2019 and discussed restrictions proposed to be adopted in an ordinance. Mayor Lewellen asked about notice being given. Commissioner Harris stated that at the meeting, notice was not mentioned, but in fact a BTR would be required; proper notice procedures would be discussed at the next meeting. Commissioner James asked about a workshop so all of the Commission could be involved. She would really like to workshop this item in order to get input from the public. Commissioner Harris suggested writing the updates to the ordinance and then holding a workshop afterward. City Attorney Ansbro noted we could be pre-empted by the State; we have to be very careful of what we try to amend. We have an ordinance we would like to preserve, so perhaps just public comments could be taken; this may not warrant a workshop. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Commissioner Harris spoke of the comments at their meeting from the residents; you have to be careful as some of these places have not done anything illegal. He noted people are being listened to, but we are pre-empted by State law. Commissioner Brandimarte said advertising a workshop and holding one must be done. She asked for a copy of the current ordinance on vacation rentals. Commissioner Harris said there about 75 other rental sites besides Airbnbs. There is a fee involved in listing your property. Vice-Mayor Odman commented we are all getting a lot of calls and the Commissioners are all on the right track. She thinks a workshop is the best idea and it should be advertised. A lot of people do not know about pre-emption, which we can help bridge the knowledge gap. We should and can do a workshop. Mayor Lewellen said she is not opposed to doing a workshop. We will need to have the land use attorney there because there will be legal questions; we will have to determine their availability. She suggested a workshop be done after 5:00 p.m., perhaps at 6:00 p.m., so residents are able to attend. City Attorney Ansbro said he will work with Commissioner Harris to organize a workshop. 10.2 City's social media presence -Vice Mayor Odman Vice-Mayor Odman presented a short PowerPoint of two cities' social campaigns, which is attached to and incorporated into these minutes. She felt we should bring someone on to take our social media to the next level, and questioned putting out an REP. Commissioner James said she thinks we do not have just one person running our social media and she would like to go out for RFP. Vice-Mayor Odman noted the questions that are being asked. Mayor Lewellen thinks we need a centralized location for information. Assistant City Manager Donnelly said we are probably not as vigorous as we should be. As long as he has been in Dania Beach, it has been difficult to get advisory board members. An enhanced social media presence could help with this, as well as with garnering information on Airbnbs. The CRA has its own consultant for social media. We would benefit by putting out an RFP; he is supportive of the Vice-Mayor's suggestion and advised it would likely be a 45-day process. Vice-Mayor Odman motioned to issue an RFP for the City's social media, to come back in 45 days; seconded by Commissioner James. The motion carried unanimously. 10.3 Solar powered trash compactors - Mayor Lewellen Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Mayor Lewellen described the solar powered trash compactors and suggested we try out one at the beach, and possibly budget for them next year. City Manager Donnelly noted there is one in front of First Watch. Commissioner James suggested underground trash compactors that are not visible. Mayor Lewellen said there are different versions of them and if one is a better design, that is okay, but we need to start looking into it. Commissioner James suggested researching different options of trash compactors before making a purchase. Assistant City Manager Donnelly spoke of a pilot program with a few different varieties to see how they could work and which is best. Commissioner Brandimarte asked about the textile recycling bins approved by the Commission. Commissioner James responded we are still working on the designs due to our rebranding. Assistant City Manager Donnelly noted we are waiting on a design and location package. Commissioner Brandimarte motioned to do a solar trash compactor at the beach; seconded by Vice Mayor Odman. The motion carried unanimously. 10.4 Super Bowl LIV—Miami -Mayor Lewellen Mayor Lewellen spoke of forming a committee of a variety of the people in the City to put together a program for the upcoming Super Bowl, so that we can get a sense of how much it is going to cost us and where we are going to get the money from. Commissioner James said we need to start with an enhancement to our holiday lighting and we need some type of app for a directory to put us on the next level; there are a lot of people that would partner with us and sponsor us. Mayor Lewellen noted she is not sure what the best way is to pursue this, whether a workshop or a committee; she has been talking to different people about ways we could incorporate things. Robert Shapiro, Master Development, noted he spoke with Mayor Lewellen, and several restaurants will be open at Dania Pointe then. His suggestion is to create a committee of public and private parties; private funding contributions would happen if we do it right. Mayor Lewellen felt we should assign somebody, like the CRA, to start putting people together and then come back to us about a committee that might be able to do this. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Mr. Shapiro suggested we get the hotel association and restaurants involved, and forcing it into Dania Beach.- Assistant City Manager Donnelly suggested rather than deciding right now, give staff a week to sit down and brainstorm. Mayor Lewellen said we need to move as quickly as possible. Vice-Mayor Odman noted she loves this idea, but before we get all the departments involved, we need to break it down just a little more; that way we are setting up our committee for success. We need a prioritized list. Commissioner Brandimarte said she looks to Mr. Shapiro for getting the hotels on board because they will donate. Assistant City Manager Donnelly noted there are official Super Bowl sponsored categories/ events and we should get with the super bowl committee to get Dania Beach on the event list. Mr. Shapiro said a small public/private committee should be set up. Mayor Lewellen commented this definitely needs to be done. Mr. Shapiro hopes the outside of the hotel at Dania Pointe is done at the time, that way we will have a plaza. He added City Hall, the casino or beach may be a venue. Commissioner James said we need to make the decision as the City Commission; we are going to decide it together. We need it structured up here; we definitely need input. Commissioner Brandimarte said we understand that, but Mr. Shapiro's expertise is unbelievable. Mayor Lewellen said best way to start is with what Assistant City Manager Donnelly suggested; do offline brainstorming, behind the scenes, in the next week. The Commission consensus was to pursue Assistant City Manager Donnelly's idea. 10.5 Draft policy for volunteers and interns—Assistant City Manager Donnelly Assistant City Manager Donnelly reviewed the draft policy included in the agenda packet. It is a framework and once we have it, we can place the forms on our website. If departments wanted an intern or volunteer, they would work with Human Resources. Direct management would be done on the department level. Commissioner James noted she asked Human Resources Director Morrell to separate the forms; one for volunteer and one for intern, and make sure with the internship there is a provision for a letter of recommendation. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Assistant City Manager Donnelly noted the forms were not included in the agenda packet, but were prepared as Commissioner James requested. 10.6 2019 Legislative Agenda—Assistant City Manager Donnelly Assistant City Manager Donnelly reviewed the information included in the agenda packet; there is one water project for NW/SW 1St Avenue that is included. He will send the agenda to our lobbyist, Ron Book, and prepare a copy for the Commission. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte spoke of her Seniors Valentine lunch, and thanked staff and BSO for helping make it a success. Commissioner Brandimarte noted we need Code Enforcement on the east side during the weekend; people are parked on the swales and sidewalks. Commissioner Brandimarte spoke of bees making nests in the doors to recycle bins. 11.2 Commissioner Harris Commissioner Harris said he met with Commissioner Nan Rich, who is spearheading the 2020 Census; it will be totally done online. She is heading up a task force. He felt we need to set up terminals in the senior center to get people registered. Commissioner Harris asked about the Dania Beach Grill. Assistant City Manager Donnelly responded City Attorney Ansbro is working on a draft lease. He has also spoken with Lori Barth, and staff will walk through the establishment to review and address repair work on February 13th. We are preparing a revised lease and proposal for repairs. Commissioner Harris spoke about the Olsen Middle School annex. Assistant City Manager Donnelly noted he was contacted by Board Member Murray; a meeting is scheduled for March 1st, and the Mayor is going. Commissioner James asked if she could also attend. Assistant City Manager Donnelly said yes, as long as it is properly noticed. Commissioner Brandimarte expressed dissatisfaction with the School Board. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Assistant City Manager Donnelly indicated the meeting is to see what is on their minds and bring it back to the Commission. 11.3 Commissioner James Commissioner James mentioned she wants to be sure we address the side of the parking garage for the Super Bowl; we need some sort of art. We should fill the space with art, and put it in our next budget. Mayor Lewellen suggested projecting the game on the wall of the garage. The Commission consensus was for Commissioner James to look into art for the side of the garage. Commissioner James said she would like different options for colors for City Hall; she wants colors that blend in and go with the garage and library. Mayor Lewellen said we should look into it because the darker and brighter the colors, the more you have to repaint it. The Commission consensus was to add more color options. Commissioner James asked about the FPL lines on the beach. Brad Kaine, Director of Public Services, said it would take approximately 60 days to complete the undergrounding; this would not affect parking on the beach. Commissioner James noted regarding the beach restoration, she was told once you get a seawall, you are no longer eligible to re-nourish the beach. Commissioner James asked about the bus shelters recently installed. Assistant City Manager Donnelly responded the stops are for the Community Bus; one on the south and one on the north side of Dania Beach Boulevard at City Hall. Commissioner James questioned advertising on them. Assistant City Manager Donnelly responded we need to loop bus schedule information on them. 11.4 Vice-Mayor Odman Vice-Mayor Odman noted the last couple of nights she has been in City Hall; someone from the CACAB asked if we could do something nicer on the interior of City Hall. She questioned making it nicer for a small amount of work. 11.5 Mayor Lewellen Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,February 12,2019—7:00 p.m. Mayor Lewellen noted we are coming up on the Marjory Stoneman Douglas High School anniversary; we will be observing a moment of silence at noon and lowering flags to half-staff. We are asking staff to wear white and send photos to Public Information Officer Bordy for social media to show solidarity with Parkland survivors and victims. Mayor Lewellen said she has joined the Broward County Mayor's Council, which meets quarterly, to advocate for different projects within our own City and within the County. She will take suggestions for issues and projects. Mayor Lewellen noted she visited the Dania Beach Housing Authority this week to get an update on the Saratoga Apartments. Commissioner James said there are several residents asking for applications on our website. Mayor Lewellen responded they do have an application and we could likely get it on our website. The first building will be done in September 2019. Mayor Lewellen noted she received compliments on the CPR class held at Frost Park; residents would like to see more programs like that. 12.
