HomeMy WebLinkAbout2019-03-26 Regular City Commission Meeting Minutes MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, MARCH 26, 2019 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Lewellen called the meeting to order at 7:02 p.m. Present: Mayor: Lori Lewellen Vice-Mayor: Lauren Odman Commissioners: Chickie Brandimarte Bill Harris Tamara James City Manager: Ana M. Garcia, ICMA-CM City Attorney: Thomas Ansbro City Clerk: Thomas Schneider 2. Moment of Silence and Pledge of Allegiance Mayor Lewellen called for a moment of silence after the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Parks and Recreation Department Most Valuable Employee (MVE) Presentations Eric Brown, Director of Parks and Recreation noted this is the second quarter of the MVE Program and recognized nominees Kayla Gardner and Timothy Gaither. He presented the Most Valuable Employee (MVE) award for the second quarter to Andrea Curran. 4. Proclamations 4.1 National Library Week - Linda Wilson, Friends of the Dania Beach Library Mayor Lewellen read the National Library Week Proclamation and presented it to Chris Marhenke, Library Manager, and members of the Friends of the Dania Beach Library. Linda Wilson, President of the Friends of the Library, distributed programming information to the Commission and thanked them for their continued support. 4.2 Child Abuse Prevention and Volunteer Appreciation Month — Adena Wilson, Guardian ad Litem Program- 17th Judicial Circuit Mayor Lewellen read the Child Abuse Prevention and Volunteer Appreciation Month Proclamation and presented it to Adena Wilson, Guardian ad Litem Program. Ms. Wilson thanked the Commission and asked people to get involved to help a child. 5. Citizen Comments Craig Valentine, Gangrel's Wrestling Asylum, 1982 Tigertail Boulevard, noted they are planning their second season events at Dania Beach Casino, in particular, the Breast Cancer Awareness event. Another benefit they are having is on July 27th at the Hard Rock Hotel and Casino. Commissioner Brandimarte spoke of a meeting she has scheduled for tomorrow regarding the Breast Cancer Awareness event. Patricia Tyra, 2912 SW 54th Street, urged the City to not remove the historical photographs from City Hall. Rae Sandler, 1433 NW 8 Street, felt our historical photos should remain accessible to the public at City Hall or be divided between the library here and the one out west. Vice-Mayor Odman noted the photos would be relocated from the NW Conference Room to an appropriate place to display them; within City Hall, we will have digitalized images of the photographs. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on follow-up of traffic complaints and gave statistics on calls made to the 100 block of SW 5 h Court. He also addressed recent homeless outreach activity and the upcoming Arts & Seafood Celebration. Sean Brown, Battalion Chief, BSO Fire Rescue, introduced himself to City Manager Garcia. Commissioner Brandimarte questioned inspections for fire extinguishers in Airbnbs. Chief Brown responded they do not have the right to enter the premises according to state law; their hands are tied. Assistant Chief Gregory Holness, BSO Fire Rescue, commented Dania Beach is not the only city having a problem with Airbnbs; these are residential homes and fall under Federal fair housing law. He addressed calls made to traffic accidents on the I-95 corridor on Griffin and Stirling Roads on and off ramps. Consent Agenda 7.1 Minutes: Approve Minutes of March 12, 2019 City Commission Meeting 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION#2019-030 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A MAINTENANCE MEMORANDUM OF AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION TO PERFORM NECESSARY MAINTENANCE TO THE RIGHT OF WAY OF STATE ROAD 848 (STIRLING ROAD)FROM MILE POST 6.259 TO MILE POST 6403 LOCATED WITHIN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Commissioner James motioned to adopt the Consent Agenda; seconded by Vice-Mayor Odman. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans There were no public hearings on this agenda. 10. Discussion and Possible Action 10.1 RFP for City Attorney - Vice-Mayor Odman Vice-Mayor Odman said we have not had an RFP put out since the current city attorney came on, and it seemed to be time to do so in accordance with best practices. She asked City Manager Garcia if it is in line with best practices to continue to review and make sure we have the best fit for the City. City Manager Garcia responded the three employees who report directly to the City Commission are the City Attorney, CRA Executive Director and the City Manager; all three are at-will employees. It is key that the Commission has the relationship they are looking for with all three. She would always recommend that the Commission does what they feel is in the best interest of the City. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,March 26,2019—7:00 p.m. Vice-Mayor Odman asked if there is something unusual in putting out this RFP and if this is something other cities do. We need to ensure we are most effectively using the taxpayers' money. City Manager Garcia responded the Commission can make the decisions based on what they want to do. Nothing prohibits them from making an assessment,putting out an RFP, and seeking guidance from fellow commissioners from other cities; whether they do so or not is in compliance with their role as elected officials. Commissioner James spoke in support of putting out an RFP to see what we have out there to make sure we are using our tax monies the best that we can. Mayor Lewellen explained her view on putting out an RFP for city attorney. She noted this has gone on for a while now; City Attorney Ansbro has offered to meet with individual commissioners, but not everyone has done that. He deserves the respect to discuss this with him before trying to replace him. Her recommendation is to go out for RFP for an assistant city attorney, which would cut down on outsourcing, and each of the Commissioners should have a meeting with City Attorney Ansbro. We should also talk about the internship program. If we do an RFP for city attorney, we should require someone who has at least 15 years of experience as a city attorney. She thinks this is unnecessary; if you want to review a person, sit down and speak with them. Vice-Mayor Odman noted this is nothing personal against City Attorney Ansbro; from her perspective, this is purely a matter of fiscal responsibility. Vice-Mayor Odman motioned to go out for RFP within 60 days for city attorney, company or person; seconded by Commissioner James. Commissioner James spoke of influences on Commissioners and noted she votes for all of our residents. This is best practice; it is nothing personal against City Attorney Ansbro and is just what is in the best interest of the City. Commissioner Brandimarte commented we are the Commission and we make the decisions. Lately, developers think they are part of our team; they are not. When developers send out emails criticizing the Commission over an employee, a red flag goes up. She does not recall a developer ever sending out an email to all of the Commission referring only to what was on the agenda tonight. They have to learn there is a division and it is called the Dania Beach Commission. Commissioner Harris suggested the Commission look at what the best practices are, what our vision is, how we can streamline some of the processes we do now, and come to a consensus where we can establish an RFP for what we are looking for. He is willing to look at everything that we can do to make sure what our best practices are and what we can be. Vice-Mayor Odman noted this feels like the fiscal thing to do and it is a given that we would only pick a city attorney who understands the specific issues of our City. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,March 26,2019—7:00 p.m. Mayor Lewellen explained her opinion on this has nothing to do with the email that was referenced. She said regarding the reasoning for this RFP, what was brought up is that a review on an employee is wanted. You do not do a review on an employee by seeking a replacement; instead you sit down and talk to the employee about their work. Putting out an RFP seeking to replace that employee is not the way you do it. The motion carried on the following 4-1 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Odman Yes Commissioner Harris Yes Mayor Lewellen No Commissioner James Yes Mayor Lewellen questioned if a committee would need to be formed that would make decisions and recommendations. City Attorney Ansbro responded there would need to be some parameters. He would want to draft something based on other cities, send it out to each Commissioner within the next two weeks to review and provide comments, and then determine where to publish it. The Commission would probably want to appoint a committee that understands the qualifications in order to review the applications. 10.2 Committee of the Whole workshops - Commissioner James Commissioner James felt what the Commission did today could be avoided if we have workshops outside of the Commission meetings at least once a month. She asked if there was a consensus to do this in order to provide a smoother Commission meeting with less drama. Discussion ensued. Mayor Lewellen explained why she felt this is not necessary. When something major comes up, we set workshops. Commissioner Brandimarte agreed another meeting is not needed. City Manager Garcia felt something in the future to look at would be if there is a very light agenda, to have one Committee of the Whole and one Commission meeting. She added she would be keeping the Commission busy with several workshops that she will be planning; perhaps do it according to what is coming up. Vice-Mayor Odman liked the idea of doing it quarterly in order to tackle a big group of things that come up. The Commission consensus was to have quarterly workshops. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,March 26,2019—7:00 p.m. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented on Veronica Larkins' passing. 11.2 Commissioner Harris Commissioner Harris commented the Meet and Greet was very well done and well attended. Commissioner Harris spoke of the Airbnb workshop with Eric Binzer from Host Compliance via video conference. Marc LaFerrier, Director of Community Development, confirmed Mr. Binzer is available the second and fourth weeks of April and he will coordinate the workshop. Commissioner Harris asked the Commission about a sponsorship for the Broward League of Cities on May 18'h at Margaritaville;the sponsorship of$2,500.00 is available to us. The Commission consensus was to do the $2,500.00 sponsorship to the BLC. 11.3 Commissioner James Commissioner James provided funeral arrangements for Veronica Larkins. Commissioner James asked how the Commission felt about providing an extra benefit for employees whose parent or child living in Dania Beach passes away. We would give them an additional discount of$700.00 on the graveyard services. She would like to create a policy for this for the future and would also like to give this discount now to Veronica Larkins' son, who works in Public Services. A brief discussion ensued. The Commission consensus was to provide a $700.00 discount for graveyard services to City employees for immediate family members who live in Dania Beach and pass away. Commissioner James felt the entire Commission should be invited to events in the future. Commissioner James referenced an email regarding the 2020 census event. Commissioner James spoke of the upcoming Arts & Seafood Celebration. 11.4 Vice-Mayor Odman Vice-Mayor Odman addressed the discussion of the email referenced earlier in the meeting and said she wanted to be clear about the present Commission. We are here to serve the residents Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,March 26,2019—7:00 p.m. and represent the interests they voice to us. On the dais, the relationship with developers who have become respected stakeholders comes with the responsibility to maintain strong boundaries and a mutual appreciation for the ethical practices that have been put in place to make sure that there is equity,transparency and fairness in all of our interactions. She is confident the team will continue in a direction that serves the best interests of the City. Vice-Mayor Odman also addressed the photos in City Hall; along with the digital images we will be doing, she has ideas to display some of the physical photographs. 11.5 Mayor Lewellen Mayor Lewellen expressed sympathy to the Larkins family; there is a collection being taken to donate to the family. Mayor Lewellen spoke of the Meet& Greet held for the City Manager prior to this meeting. She would like to see something like this on a quarterly basis; perhaps we can talk about this at the next meeting. Mayor Lewellen noted she was contacted by a group called The Women's Breast and Heart Initiative; they are coming to Dania Beach as we have a high incidence of late identification of breast cancer. They will be here the first three Saturdays in April, will set up in the SW Community Center, and are looking for volunteers. They will walk door to door educating people on what is going on, and on April 27t', they will have a screening and wellness day for pre-scheduled and qualified women at no cost. 12. Appointments 12.1 Airport Advisory Board—no appointments 12.2 Planning& Zoning Board Vice-Mayor Odman appointed: Janine Rice 12.3 Broward League of Cities 2019-2020 Director Appointments Director—Vice-Mayor Odman Alternate—Commissioner Brandimarte Second Alternate—Commissioner Harris Commissioner James motioned to approve the appointments; seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,March 26,2019—7:00 p.m. City Manager Garcia thanked the Commission for their support, tremendous involvement, and for putting their City first. City Manager Garcia advised staff is proposing April 29, 30 or May 1 for the Parks & Recreation Master Plan workshop. Vice-Mayor Odman noted she is not available on any of the dates. City Manager Garcia said she would reach out to the Commission with another date after she confers with Bermello, Ajamil to reschedule. She asked the Commission to give her dates they are not available in May. City Manager Garcia noted the proposed dates for Tallahassee are to leave on April 10 and return on April 11''. She addressed the issues of importance to Dania Beach and said she will circle back with information. Mayor Lewellen mentioned there was a ribbon-cutting scheduled for April 10Ih Vice-Mayor Odman said she cannot go. Commissioner Harris confirmed he could go. Commissioner James commented she will have to determine if she is able to make the trip. Mayor Lewellen noted she would get back to City Manager Garcia as well. Commissioner Brandimarte said she does not want to go.
