WHEREAS, pursuant to The City's Code of Ordinances, Chapter 28, entitled "Land Development Code," Part 6, "Development Review Procedures And Requirements," Article 625, "Variances"of the Land Development Code (the"LDC"), Chuck Luedemann, on behalf of Q Med Corporation(the"Applicant"),has applied to the City of Dania Beach(the"City")for approval of a Variance(VA-56-19)for property located at 2281 Griffin Road(the"Property"),as legally described in Exhibit"A;" and WHEREAS,Section 625-40 of the Land Development Code states that the City Commission may grant a Variance based on its determination that the Applicant has demonstrated that the criteria identified in the Land Development Code has been satisfied; and WHEREAS,the Applicant has requested a Variance(VA-56-19)to permit sixteen(16)foot hedges on the Property,where pursuant to LDC Section 235-30(B),a maximum eight(8)foot hedge is permitted; and WHEREAS,the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Land Development Code; and WHEREAS,public notice was provided in accordance with law; and WHEREAS,the City Commission finds that approval of the requested Variance is consistent with the City's Land Development Code and Comprehensive Plan. 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28, the "Land Development Code," Part 6, "Development Review Procedures and Requirements,"Article 625,"Variances"the Variance(VA- 56-19), as shown in Exhibit`B" is hereby approved. Section 3. That pursuant to Section 625-50 "Expiration of Variances" of the Land Development Code, the Variance approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings within eighteen(18)months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. The Property is located at 2281 Griffin Road, north of Griffin Road and on the east side of SW 23rd Terrace and west of Anglers Avenue in the City of Dania Beach (the "City"). The Property is identified by the Broward County Property Appraiser with folio number 504229530010. The Property consists of 9.4 acres of land and a newly constructed 180,000 square foot corporate headquarters building ("Building"). The Property is zoned as a General Commercial District(C-3) with an Office Park land use,per the City's Future Land Use Map. The Property is adjacent to residential zoning districts to the west and a mix of commercial and residential districts to the east. Currently, the Property has a decorative precast six (6) foot wall on the north, east, and west property lines. The Applicant is requesting a variance from Section 235-50(B) of the City's Code of Ordinances (the "Code") as outlined in the table below. CODE CODE LANGUAGE SECTION Sec. 235-30(B).- Side and rear yards.Walls, fences and hedges Requirements located in side and rear yards, including corner for placement street side yards and the rear yards of through lots, within required shall not exceed six(6) feet in height in all yards. residential and CRA form-based zoning districts, and eight(8) feet in height in all other districts. For any property abutting a waterway or canal,no hedge,wall or opaque fence located within ten(10) feet of the-edge of the waterway,measured from the outer face of the seawall or top of bank in the absence of a seawall,shall be permitted to exceed five(5) feet in height measured from the height of the adjacent seawall or top of bank;provided, however, a nonopaque fence shall be permitted to be erected up to six (6) feet in height. The Applicant requests a variance from the applicable eight (8) foot hedge height limit listed above for a 16 foot hedge. Because the Building has a finished floor elevation of four (4) feet, the eight (8)-foot hedge will not adequately screen and buffer the Property from the nearby residential properties, nor will it provide effective noise and light control. A hedge of 16 feet will allow the Applicant to ensure that the Property is especially compatible with the neighboring community.The hedges will be located on the southeast and southwest corners of the Property and will consist of clusia guttifera plants, or small-leaf clusia. Pursuant to Section 625-10(A)(4) of the Code, the City may grant a variance from the applicable landscape regulations provided that the request meets the criteria listed in Section 625- 40 of the Code. The Applicant will demonstrate below that the request for a modification of the hedge height requirements as delineated in Section 235-50(B) meets the City's criteria for a variance. Variance Criteria Pursuant to Section 625-40(A): 1) That the requested variance maintains the basic intent and purpose of the subject regulations,particularly as it affects the stability and appearance of the city; The Property currently consists of a corporate building that, while attractive, would absolutely benefit from additional hedging. The Applicant recognizes that landscaping is an important component of any development because it enhances aesthetics and provides a cooling factor in the South Florida environment,particularly when the landscaping is for a site that includes a large building. The Applicant wants to ensure that the landscape design of the Building is even more beneficial to the surrounding communities than it currently stands. The Applicant believes that the proposed higher hedging along the southeast and southwest corners of the Building will offer a more decorative landscape design. This alternative design is proposed so that the landscaping on the Property has a more unique and aesthetically pleasing appearance. In addition, the higher hedging will allow for additional noise and light pollution control. The requested variance will maintain the basic intent and purpose of the Code because it will provide a landscaping design that is appealing, decorative, and functional for residents and visitors. Further,the proposed hedging consists of clusia guttifera shrubs. The clusia guttifera is the shrub form of the clusia rosea tree, which was given a rating of 100 per the City's Landscape Technical Manual. Because of the clusia guttifera's thick and paddle-like leaves, they are especially well-suited for the humidity of the south Florida climate and will contribute to the beautification of the Property. 2) That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; As stated above, this variance requests hedging that will improve the aesthetics of the Building and will not be detrimental to the community. In addition, the use of clusia guttifera plants will provide additional aesthetic appeal to the Property. The Applicant is proposing to enhance landscaping buffers on the Property to ensure that it remains consistent and compatible with the existing uses near the Property. Residential uses are located to the west of the Property and a mix of commercial and industrial uses are located to the east. The Applicant proposes 16 foot hedges at the southeast and southwest corners of the Building to further enhance the Property's buffering between these residential and commercial uses. The heightened hedging will provide for a more attractive and cohesive landscape design, which will complement the Building and will also provide adjacent properties with additional privacy. For the reasons stated above, the variance is intended to enhance the Property's compatibility with land uses in the surrounding area and not detrimental to the community. 3) That the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time,and all other similar plans adopted by the city; The requested variance will further the goals, objectives, and policies of the City's Comprehensive Plan. The land use plan designation for the Property is Office Park("OP"),which are meant to encourage the location of planned office complexes and corporate headquarters in Dania Beach. In addition,the Office Park areas are meant to"... ensure a campus-like atmosphere with substantial buildings and ample open space." The requested variance will facilitate the campus-like feel of the Property by allowing for additional landscaping that will improve the aesthetics of the Property. Allowing the Applicant to improve the Property with these hedges will further enhance the feeling of being on a campus-like development due to the landscaping and privacy elements the hedging will provide. For these reasons, the proposed variance is consistent with the goals, objectives and policies of the City's Comprehensive Plan. 4) That the plight of the petitioner is due to unique circumstances of the property or petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome; and The Code requires hedges with a maximum height of eight (8) feet in all zoning districts but residential or CRA-form based districts. Due to the narrow lot configuration of the Property, there are minimal setbacks located on the Property so as to accommodate the Building. The proposed 16 foot hedges will ensure that the Property is adequately screened and buffered on the southeast and southwest portions of the site, while providing added privacy benefits to the community. Additionally, some of the hedges will be located immediately adjacent to where vehicles will be moving along the Property, which requires the additional hedging in order to alleviate any generated noise or light from any vehicle traffic. Furthermore, the hedging will generally help to reduce any light or noise generated from the use of the Property and will provide a more attractive and decorative design than is required by the Code. Additionally, the use of clusia guttifera plants will ensure that the hedging is particularly visually appealing. 5) That the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community The Applicant is requesting an alternative hedge height from one landscape requirement of the Code and not the elimination of said landscape requirement. The variance requested is the minimum variance necessary to afford relief to the Applicant and still meet the intent of the Code, while providing added benefits to the surrounding community. The variance proposes an alternative solution that will be more attractive, unique, and beneficial for the community for the reasons stated above.
