RESOLUTION NO. 2019-050 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-018-19), VARIANCES (VA-39-19, VA-75-19, VA-76-19), DESIGN EXCEPTION (OT- 73-19), AND SPECIAL EXCEPTION (SE-74-19) REQUESTS, SUBMITTED BY THE PROPERTY OWNER, LIBERTY PROPERTY LIMITED PARTNERSHIP FOR PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF STATE ROAD 7 BETWEEN I-595 AND POWELLS ROAD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The City Code of Ordinances, Chapter 28, entitled "Land Development Code" (the "LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans," states that Site Plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Liberty Property Limited Partnership (the "Applicant") has requested Site Plan (SP-018-19) approval to permit the development of an approximately 321,120 square foot distribution use/warehouse located on the East side of State Road 7 between I-595 and Powells Road in the City of Dania Beach, Florida, (the "City"), as legally described in Exhibit"A;" and WHEREAS, Chapter 28, Part 6 of the LDC, Article 625 "Variances," Section 625-40 states that the City may grant a Variance based on its determination that the petitioner has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance (VA-39-19) to permit a non- screened dumpster where Section 275-170(B) provides dumpsters shall be screened on at least three (3) sides by landscape material that is a minimum of thirty (30) feet in height; and WHEREAS, the Applicant has requested a Variance (VA-75-19) to permit the building to be 45.5 feet in height where LDC Section 205-10 requires a maximum building height of thirty-five (35) feet in the Industrial General ("I-G") zoning district; and WHEREAS, the Applicant has requested a Variance (VA-76-19) to permit 274 parking spaces where LDC Section 265-50 requires 459 parking spaces; and WHEREAS, Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations," Article 511 "Industrial Design Standards," Section 511-20 "Applicability," states that the City may approve exceptions to the guidelines as part of a Site Plan application; and WHEREAS, the Applicant has requested a Design Exception (OT-73-19) to provide approximately four percent (4.2%) of glass windows and doors on the primary elevation and approximately four and a half (4.6%) percent on the secondary elevation where LDC Section 511-30(I) provides that glass windows and doors must make up at least twenty-five (25) percent of the primary elevation and ten(10) percent of the secondary elevation and; WHEREAS, the Applicant has requested a Design Exception (OT-73-19) to permit certain blank walls where Section 511-30(C) provides that large, blank, unarticulated walls shall be prohibited; and WHEREAS, Chapter 28, Part 6 of the LDC Article 630 "Special Exception Uses," Section 630-50 states that the City may approve a Special Exception use based upon its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Special Exception (SE-74-19) to permit a distribution use within the General Industrial (IG) zoning district, pursuant to LDC Section 115- 40; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 018-19), Variances (VA-39-19, VA-75-19, VA-76-19), Design Exception (OT-73-19), and Special Exception (SE-74-19) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by reference. Section 2. That pursuant to Chapter 28, "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan (SP-018-19), attached as Exhibit "B" which is made a part of and incorporated into this Resolution by reference is approved. 2 RESOLUTION#2019-050 Section 3. That pursuant to Chapter 28, "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-39-19, VA-75-19, VA-76-19) are approved consistent with the Site Plan provided in Exhibit"B." Section 4. That pursuant to Chapter 28 "Land Development Code," Part 5 "Signage and Design Regulations," Section 511-20 "Applicability," the requested Design Exception (OT- 73-19) is approved consistent with the Site Plan provided in Exhibit"B." Section 5. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development review Procedures and Requirements," Section 630-50 "Special Exception Uses," the requested Special Exception (SE-74-19) is approved consistent with the Site Plan provided in Exhibit"B." Section 6. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. PLATTING: Provide revised plant with new plat notes that were approved by the City Commission on September 11, 2018, via Resolution No. 2018-126 (Planning and Zoning). 2. SIGNS: Provide copy of all signs for compliance review. • Per Section 505-40(K)(3) "Internally illuminated cabinet signs must be constructed of an opaque sign face with translucent cut-outs for sign copy, such that only the sign copy itself is illuminated, and the background is not illuminated."Identify in sign detail. • Per Section 505-40(K)(6) "minimum setback from an interior property line is 20% of the length of the street frontage. Identify required and provided in data table and show setback dimensions on site plan. • Sheet A4.10, Detail #1 & 2, Sheet A3.10 #1 Building 1 North Elevation and Sheet A3.20 #2 Building 2 South Elevation shows wall signs. Provide dimensions of proposed signs in drawing and identify permitted and proposed sign area for each in data table (Planning and Zoning). 3. The proximity to the airport will be required FAA, 2X request (Planning and Zoning). 4. Application for site development permit shall include, among other items, the following information: a. Exfiltration trench profile and cross section b. Drainage water volume calculations c. Drainage water quality calculations d. Cross-sections at every utility and drainage pipe crossing showing clearances between pipes and demonstrating no conflicts (Engineering). 3 RESOLUTION#2019-050 Section 7. That pursuant to LDC Section 635-100 "Expiration of Site Plans," Section 625-50 "Expiration of Variances," Section 630-70 "Expiration of Special Exceptions," the Site Plan (SP-018-19), Variances (VA-39-19, VA-75-19, VA-76-19), Design Exception (OT-73-19), and Special Exception(SE-74-19) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 8. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 10. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on May 28, 2019. (A) The planning and zoning board or city commission, as applicable, shall review the application to determine whether the special exception use complies with the following standards: (1) That the use is permitted as a special exception use as set forth in the use regulations of part 1 of this code. RESPONSE:Sec 105-40 states that distribution is a permitted use within the IG zoning district. (2) That the use will not cause a detrimental impact to the value of existing contiguous uses, uses in the general area,and to the zoning district where it is to be located. RESPONSE:It is not anticipated that the proposed redevelopment of the site will cause any detrimental impact to the value of the general area. (3) That the use will be compatible with the existing uses on contiguous property,with uses in the general area and zoning district where the use is to be located and compatible with the general character of the area, considering population density, design, scale and orientation of structures to the area, property values and existing similar uses or zoning. RESPONSE:Due to the location of the site many of the adjacent properties provide storage&industrial type activities which are consistent with the proposed warehouse facility. (4) That adequate landscaping and screening are provided to buffer adjacent uses from potential incompatibilities. RESPONSE:The project will comply with all applicable landscaping and screening requirements. (5) That adequate parking and loading is provided, and ingress and egress is so designed as to cause minimum interference with traffic on abutting streets. (8) That the use will not utilize turning movements in relation to its access to public roads or intersections, or its location in relation to other structures or proposed structures on or near the site that would be hazardous or a nuisance. RESPONSE:The project will comply.All site access will utilize the existing driveway location. (9) That the use will not have a detrimental effect on the future development of contiguous properties or the general area,according to the comprehensive plan. RESPONSE:The project will comply with all current regulations. (10) That the use will not result in the creation of incompatible noise,lights,vibrations,fumes, odors, dust or physical activities, taking into account existing uses, uses located on contiguous properties, uses in the general area and the zoning in the vicinity due to its nature,duration,direction or character. RESPONSE:The project will comply. (11) That the use will not overburden existing public services and facilities. RESPONSE:All surface water is to be managed on site;the applicant understands that if any improvements to the existing water&sewer facilities are necessary we will comply as applicable. (B) The city commission or planning and zoning board, as applicable, may deny, approve, or approve the application with conditions. In issuing its decision to grant a special exception, the city may place more restrictive requirements and conditions on applicants than are provided in the code when the conditions are based upon site considerations and its use, and the potentially resulting impacts upon the surrounding area or zoning district where the subject property is located.
