R151501, FOR EQUIPMENT AND TOOL RENTAL SERVICES WITH SUNBELT RENTALS, INC. VALID THROUGH OCTOBER 31, 2020, AND TO EXCEED THE ANNUAL VENDOR TOTAL AMOUNT OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00) EACH FISCAL YEAR THE CONTRACT IS IN PLACE; AUTHORIZING SUCH PURCHASES TO BE MADE WITHIN THE RESPECTIVE DEPARTMENTS' APPROVED ANNUAL BUDGET APPROPRIATIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if she is authorized to do so in advance by a resolution adopted by the City Commission; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor each fiscal year; and WHEREAS, the Public Services Department is seeking authorization from the City Commission to utilize "The Cooperative Purchasing Network" ("TCPN") Contract No. RI51501, effective November 1, 2018 through October 31, 2020, with Sunbelt Rentals, Inc. for the rental of equipment and tools; authorization is also being requested to exceed the City's threshold of Twenty Five Thousand Dollars ($25,000.00) for a single vendor each year that the contract is in place, therefore, City Commission approval is required; and WHEREAS, the Public Services Department is currently in the process of rehabilitating City lift stations and the Department is in need of equipment rentals and tools from Sunbelt Rentals, Inc., to assist with keeping City lift stations in operable condition for the health, safety and welfare of City residents; and WHEREAS, the Public Services Department is seeking approval to exceed the Twenty Five Thousand ($25,000.00) limit for any necessary equipment rental services, provided funding is available and appropriated in the current fiscal year budget and made in accordance with the City of Dania Beach Purchasing Policy for each fiscal year; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the Public Services Department to utilize the TCPN Contract No. R151501 with Sunbelt Rentals, Inc. for equipment and tool rental. Authorization is also being requested to exceed the annual amount of Twenty Five Thousand Dollars ($25,000.00) purchase threshold for a single vendor each fiscal year the contract is in place. Section 3. That the proper City officials are authorized to execute an Agreement with Sunbelt Rentals, Inc., a copy of which is attached as Exhibit "A" and is incorporated into this Resolution by this reference. Section 4. That all Department purchases shall be subject to and made within the Departments' approved level of their respective annual budget appropriations and in accordance with the City of Dania Beach Purchasing Policy for each fiscal year. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. FOR EQUIPMENT AND TOOL RENTAL SERVICES (PURSUANT TO AN AGREEMENT PRESENTLY EXISTING UNDER THE COOPERATIVE PURCHASING NETWORK ("TCPN") CONTRACT NO. R151501) This is an Agreement ("Agreement") dated , 2019, between the City of Dania Beach, Florida, a Florida municipal corporation ("City"), with its principal place of business located at 100 West Dania Beach Boulevard, Dania Beach, Florida 33004 and Sunbelt Rentals, Inc., a South Carolina corporation authorized to conduct business in Florida ("Contractor"), with an address of 2341 Deerfield Drive, Fort Mill, South Carolina 29715. In consideration of the mutual covenants, terms and conditions contained in this Amendment, and other good and valuable consideration, the adequacy and receipt of which are acknowledged and agreed upon, the parties agree to the following: The Agreement existing between the Contractor and TCPN, dated September 1, 2015 for equipment and tool rentals services is effective through October 31, 2020. The Agreement is attached as Exhibit "A", and made a part of and are incorporated into this Agreement by this reference; it shall be considered a part of this Agreement between the City and the Contractor.
